Rahul Gandhi leads protest against Real Estate Bill amendments

New Delhi: Keeping up his combative stance on new Real Estate (Regulation and Development) Bill proposed by the Bharatiya Janata Party-led National Democratic Alliance government, Congress Vice President Rahul Gandhi is likely to protest with home buyers at Jantar Mantar in the national capital on Monday.

Earlier, he met organisations representing home-buyers at the Congress headquarters to discuss concerns regarding the Bill. Rahul called the bill anti-consumers as it allegedly dilutes penalties for late delivery of homes. The bill also allegedly does not safeguard against money being diverted from one project to another.

"Government, which has been working against farmers and tribals, is working against the middle class in the same manner," he had told reporters after meeting several NCR flat buyers.

He said he would fight for the home buyers the way he has stood by farmers and tribals. "I have assured them that the way I am helping the poor and the tribals, I will do the same for the middle class. I will stand by them."

With Rahul upping the ante on the amended bill, the fate of the bill listed for consideration and passage in Rajya Sabha on May 5 has become uncertain as the NDA does not have the numbers in the Upper House to ensure its passage.

Rahul said that he had learnt that it is not just farmers and tribals but also the middle class people that are suppressed on matters related to land.

"They are told that you will get the flat on a particular day but for years they don't get the flat. They are told the super duper area of the flat would be so much but what is delivered is different," he said.

The Congress has decided to take the issue of changes brought about by the NDA government in the Real Estate Bill to people and bring out the "contrast" between UPA's Real Estate Bill and NDA's legislation on the line of what it did in the case of the land acquisition Act.

Congress' argument is that in the earlier bill, the carpet area was defined in a clear and unambiguous manner as "net usable area" in an apartment excluding the walls.

"It has been amended now with an explanation that the 'net usable area' will be 'rentable area' as defined in National Building Code 2005 or its later versions. This means that an area has been defined in such a manner that it will further confuse the buyer and the area as defined has been linked to the Building Code which can be amended later even without coming to Parliament," the party said.

Congress is also arguing that while in the earlier bill, the builders were not allowed to change the sanctioned plan once approved and the project is launched, now the builders can undertake "minor alterations" just by intimating the buyer and the extent or type of minor alteration is not defined.

After Congress vice-president Rahul Gandhi met distressed home buyers in the NCR, Delhi unit chief Ajay Maken joined a protest of home buyers at Jantar Mantar on Monday, continuing the party’s attempt to reach out to the middle-class and connect with the urban constituency.

Rahul had said that the meeting with the home buyers on Saturday had taught him that the middle-class, like the farmers, were suppressed in land matters. He alleged that the Narendra Modi government had diluted provisions of the Real Estate Regulatory Authority Bill, making the legislation pro-builders from pro-buyers.

Maken, who was the former Housing and Urban Poverty Alleviation Minister, made a similar statement. “Around 20 amendments have been made in the Real Estate Bill which makes it pro-builder instead of pro-buyer. For instance, the carpet area… would be given according to the previous Bill,” he said.

Maken said another provision has been added, according to which the builder can extend the deadline for compensation

Congress and ALLIES should at the first instance come up with a public apology for not having done much for all the protests by Home buyers which took place at Jantar Mantar during their reign.

Continuous Protests against allegedly Congress Politicians front end companies openly running shop in Faridabad. These Congress builder SHOPPEES had all the back up from Local Police, DC, DTCP during hooda raaj and still continue to do so under the BJP rule albeit silently.

Congress MPs have been openly flaunted by builders like Piyush on their websites and many others in public knowledge are having active partnerships of JAMAI Raja in many parts of Haryana and other states.

Key culprits who have swindled money through such alledged syndicates are running scot free. Erstwhile proclaimed offender as per haryana police, eg one of the directors of Triveni. Many suggest that the directors are proclaimed Bhoo mafia book runners of UP and have courage to file frivolous FIRs against those who make an effort to report criminal offences of Triveni to police and move court against them. Proof is crying buyers moving HC, SC in 100s.

Apart from this is our famous High end alledged Condominium shopper Mr Kabul Chawla of BPTP, exposed by New York Times. BPTP owns more than half of the licenses in Greater Faridabad sectors 75-89, benevolently offered to him allegedly due to its association with Jamai Babu and is public knowledge as proclaimed by Baba Ramdev "Aadhe se jyada faridabad inka hai, yeh faridabad ka baccha bachaa janta hai".

DD township was bought and sold to BPTP at hefty profits and money siphoned off through shell companies. This done against any known provisions of HRD and DTCP amended law many times to facilitate both of these congress affiliated builders. DD motors a Maruti Suzuki franchisee/dealer and one of financing companies of DD housng and township etc, is a known congress affiliate and is pubic knowledge. Its public knowledge that congress gets unfathomed patronage from maruti dealers. Both BPTP and DD benefited at the cost of honest law abiding, tax paying home seekers who are stared in the face and dare them to go to court. Police refuses to cooperate, refused to file FIRs and conducts proper investigations after many cases filed under 156(3) after courts interference.

Worst is that the incapable BJP govt of Haryana has chosen to side by these erstwhile perpetrators of heinous crimes against common man and for CM to hold meeting with likes of BPTP etc to bend HRD act further by offering them to facilitate splitting of licenses and help congress book runners monitise the license largeese dolled out by erstwhile congress govt. All fake assurances of GOVERNANCE of BJP are now proves as not one errant builders being put behind bars.

SHAME on Congress Vice President to have cheek and tongue to protest while collaborators of their party and criminals are enjoying the bander baant of licenses by Hooda run congress govt. Mr Hooda and Mr Gandhi should offer a public apology for abetting congress sponsored builders before they hold a drama rally in favour of home buyers.


20000+ acres of Bander Baant of Licenses in favour of congress helped, partnered and abetted builders happened during the 10 years of Hooda Raaj in Haryana... loot continues.

Absolutely, it is a DRAMA for managing headlines and part of a well thought out campaign..

Not that the BJP bill is any good. It is ineffective and toothless and HUGE HOLES and AMBIGUITIES.

Clearly proves that both BJP and CONGRESS do this BAARI BAARI and I remember having corresponded with Capt Abhimanyu and Kirit Somaiya during BJP campaign earlier and was promised full support.

1. Has Haryana Govt. ever investigated the antecedents and credentials of the companies before they were allowed to acquire land in Haryana and engage in colonization, buildings and consolidations of land?

2. Has any one, including the income-tax department, ever enquired the source of funds flowing into these companies, as also the fact whether their net wort matches to that of the value of the land they own or have acquired?

3. Has the Haryana Govt. asked for compliance reports from builders, colonizers and land consolidators regarding the completion of the projects, as claimed by them in the newspapers?

4. Has the Haryana Govt. investigated why builders, colonizers and land consolidators are charging extra amount on flimsy grounds from customers due to the delays in the project, whereas the customer is not responsible for any delay?

5. Has the Haryana Govt. developed any mechanism to address and rescue the customers from the clutches of builder's mafia for non-compliance of terms and conditions of buyer-seller agreement and delay of the project?

6. What was the rationale behind Chief Minister Hooda holding all departments relating to land and urban development with himself? Was there no competent MLA in entire Haryana or was it to control land deals?

7. It is true that your Government has not utilized more than Rs 10,000 crores collected towards External Development Charges (EDC) from the end consumers through the builders in the last 5 years for creation of basic amenities?

8. Why did you shift the powers of the DTCP to grant or refuse the licences to the office of the minister in charge, which happens to be the Chief Minister? Don't you agree that this was done to directly give massive benefits to builders like BPTP?

9. Why did you bring in the policy of removal of height restrictions for Group Housing projects? What was the rationale behind increasing the per hectare population density in Haryana? These orders allegedly doled out direct benefits/favors to 391 group housing societies.

10. You have allegedly created three Master Plans which will create concrete jungles without providing basic amenities of roads, water, electricity, sewerage etc. Your comment.

11. As per the norms, one plan is implemented in full and only then another plan is envisaged. You have stated that you will implement Master Plan of 2031?

12. Why you have created a virtual monopoly of builders in different parts of the State? Like in Rohtak, Sonica builders control 67% of the total land licence, BPTP in Faridabad etc. Same story is there in every district of Haryana

13. Why no action is being taken against the shell companies and subsidiaries of various builders which bypass the land holding laws in the State and also avoid paying registry charges on transfer of ownership of immovable property

14. It is alleged that the proposed changes in the Master Plan were leaked to favored builders like Ramprastha, BPTP etc. who took advantage of such information and purchased huge stretches of land in the very sectors, hence benefiting to the tune of thousands of crores.

15. It is alleged that the Haryana Govt. is run by de-facto Chief ministers like Venod Sharma, Kunal Bhadd, Arvind Walia, Anil Sharma, Sameer Gehlaut, K.P.Singh and Kabul Chawla. What made you allow these extra constitutional authorities to act on your behalf?

I agree with you, BlessU for charges that you have against Congress. But, BJP is also in same boat. Builders in Greater Faridabad who previously had links with Congress Ministers now have links with BJP MPs and ministers. I am not going into Congress-BJP debate. Let us talk about Real Estate Bill. Main concerns of every home buyer is :

- Long delays in project
- Arbitrary Super Area and its increase
- Change in Layout plans
- Penalty and prosecution of builders.

What the amendments in bill have done:

* The threshold of 70% of buyer money, which was to have been set aside in a separate bank account and only be used for construction costs, has been reduced to 50%. Thus allowing builders to divert funds and result in delays

* The earlier bill had a clear definition of “carpet area” contained within it. The new BJP bill refers the definition of “carpet area” to the definition of “rentable area” as used by the National Building Code. This Code, however, can be amended by the government without running it though parliament, thus allowing for quick changes later on which, presumably, would be anti-buyer.

* Earlier, builders couldn’t change the plan once it was approved by the regulator. Now they can make “minor altercations”.

* The new bill provides an escape clause for delayed projects which will not penalise delays due to “issues with completion certificate, approvals etc”. This can be easily misused by the builder to delay and get involved in legislation with buyers.

There are 16 other amendments that have been have made to bill hence making bill pro-builder instead of pro-buyer
