Dear Ajay & Dheeraj ji,

As you may be ware that yesterday( 21st April,2014) was the day fixed for hearing before Hon'ble Punjab & Haryana high court. Sh Aashish Kaul & myself were present in the court.
HUDA( Faridabad) has come with an affidavit to file before the court pertaining to the developments works in relation with the time line of the completion of developments works across Sectors 75 to 89, Fraidabad. In the affidavit HUDA has made some of the commitments in relation to the time line of completion of development works until the date of 2016 or beyond in a case filed by Builders against HUDA( CWP 19069 of 2010). The affidavit filed before hon'ble court on 21st April 2010 is in our possession.

After seeing the affidavit hon'ble Judge was furious on officials and refused to take the affidavit on record and ordered to file a fresh affidavit within next THREE weeks( with specific directions) and the next date for hearing is fixed on 20th May,2014.

Also it is pertinent to mention that Hon'ble Judge wanted to argue the matter on yesterday only and was not adjourn the matter for next date. The senior advocate( Sh Mahajan) was not prepared for the arguements and after the stubborn attitude of the hon'ble judge to argue the matter on yesterday only Sh Atma Ram ji( Sr advocate in a case 19069/2010) and Sh AASHSH KAUL ji had to come/appear before the court(earlier his junior advocate appeared and tried to make futile arguements) took the centrestage and argued perfectly before hon'ble judge and made all the arguements.Sh AASHISH KAUL JI & Sh Rajiv Atma Ram ji made almost all the averrments before hon'ble Judge and the matter is very well understood by the hon'ble Judge.

The matter took almost one & a half hour in the court. Further Sr advocate Sh Mahajan ji reiterated to discuss all the relevant policies & updated facts of developments atleast one week before the next date of hearing.

This is for the information and the legal team for doing the needful. Also let me assure that we( Sh Aashish Kaul ji & myself) will take the court case forward to the logical conclusions and make allout efforts to tilt the case in the favour of buyers.

Hi Umesh Ji, Aashish,

Thanks for your efforts on this and the update. Lets hope that the case benefits us all.

For information of all, GFWA might fall short of funds for legal fee which we might need to pay to lawyers further. We need not to pool in anything yet but might need do pool in small amounts at a short notice later. We will keep you all informed.

Excellent work, Umesh Ji and Ashish Kaul ! I have seen Ashish arguing the matter himself in his case before NDCRC, excellent to see him arguing the GFWA case before High Court also. Though not an advocate, Ashish argued the matter but seems that GFWA Senior Advocate was not very well prepared. Vineet, I think apart from funds collection, this aspect also needs to be taken care by GFWA executive team

Vineet ji,

We draw the energy from the allottees/residents/prospective residents within the greater faridabad/ neharpaar area. The injustice happening with them exudes confidance within ourselves.

I think you have perceived my post differently and corelated the same with the amount. It is our endeavour that we are firmly committed to take the court case to the logical end and upto the level of highest level of court in the country.
Had we related the same with the amount we would not have closely chased the day today activity/proceedings in the court and collecting/replenish with the adequate RTI data, notifications/policies in order to augment the arguement before the hon'ble court.
Had we had all the RTI Replies & copies of notifications along with us yesterday we would have concluded the arguements yesterday only.Rest all will be decided by the hon'ble court only and we will continue to make our best efforts to stop the windfall game between Colonizers & State officers.

I am sure that prayers/wishes from all the residents/allottees/prospective residents will bring the respite to all including myself & Aashish,too.
Without prejudice We will continue fighting for the larger good.

We highly appreciate your effort, Umesh Ji and Ashish Ji. It was great effort on part of you guys to go to Chandigarh and great courage on part of Ashish Kaul to argue the matter in High Court by himself as a buyer along with Shri Atma Ram (Senior Advocate for Builders Association) for pushing the developmental works in Greater Faridabad

Hi Umesh Ji,

I don't know if my mail by interpreted wrongly. My perspective was:

1. We made our last payment to lawyer in Sep'12. It was discussed during various meetings that we might need to make another payment once the case reaches final argument stage.

2. As GFWA treasurer, I am aware that our finances now will be just sufficient or slightly short to meet next legal fee demand. The exact details can be worked out only once the demand is raised.

As I see from the mail that case is at argument stage, I just wanted to keep members aware of the financials. My worry is only on giving the next cheque and legal matters is up to the legal team :) .

Dear All

This is good to see that our representatives are visiting chandigarh on day to day hearing. Sometimes, if somebody is not available from Faridabad to go to Chandigarh, we arranged our members from Chandigarh or Panchkula to visit court and attend the hearing. We can see whatever development is there in Neharpar that is only because of our Writ Petitiion filed in August 2011 and when we raise non development issue before Court during initial hearings, he Govt. started development work just to show to the court that the work is going on.

As regards the EEDC issue is concerned, we are very hopefull that the matter will be definetly in our favour at the end and GFWA being the Petitioner is confident for the same and even if in worst case scenario it goes against us, we will not let it go and will challenge the same till Supreme Court.

One thing I want to clarify that we should avoid to allege that the lawyers are not ready to argue or this and that. In legal procedures and strategy it generally happens when there are connected matter. Since the issue is identical, any of the lawyer can start arguments whose files are in Judge's hand at that moment. During such proceedings the other lawyers role gets restricted only to any query if raised by the Court in their matter. Ultimately, if any positive order comes, it is going to benefit all the buyers. Similar situations arose during initial hearing when our Sr. Lawyers use to argue the matter on non development and builders lawyers and other concnered lawyers were seeing him.

I agree with Vineet ji, that we should ready with some more funds, as we may have one more senior lawyer on board, if required, during next hearing or subsequently.

Let's hope for the best.......We are confident to have some fruitfull results out of these writ petitions.

There is no denying the fact that Development work started due to protests and High Court case by GFWA. But, development works are now going at a slow pace. Deadline for completion of master roads has been missed and revised many times now. There are Court stays at many places due to which there are portions of road which are not connected. Bridges work for connecting Greater Faridabad from HUDA side is going at snail pace. There seems to be no deadline for finishing of other EDC areas like Sewerage works as HUDA told Court that they are yet to acquire land.

HUDA wanted to push affidavit in High Court which would have pushed development works to 2016 and beyond which would have been very damaging for 50000 home owners and their families in Greater Faridabad. Senior Advocate from GFWA was not prepared very much, hence he rightly requested High Court to allow Mr. Ashish Kaul who is not an advocate but a buyer to argue the case. Whenever there have been arguments in High Court related to Greater Faridabad development, it is Shri Atma Ram who in fact is Senior Advocate for Builders Association in Greater Faridabad to argue the matter.

As quoted by Umesh Ji, Sh Mahajan ji who is Senior Advocate from GFWA reiterated to discuss all the relevant policies & updated facts of developments atleast one week before the next date of hearing. I believe that needs to be taken utmost care by GFWA Working Committee. With regards to losing this matter in High Court and pushing this matter in Supreme Court, when there is a funds crunch even for High Court, from where money will come for Supreme Court? It is very important that GFWA puts maximum efforts in High Court to win the case for giving confidence to GFWA members so that they can contribute.

ग्रेफ में विकास का हुडा को देना होगा हिसाब

जागरण संवाददाता, फरीदाबाद :

एक ओर जहां किसानों के विरोध के चलते हरियाणा शहरी विकास प्राधिकरण (हुडा) ग्रेटर फरीदाबाद (ग्रेफ) में विकास कार्य शुरू नहीं करा पा रहा है, वहीं दूसरी ओर बाहरी विकास शुल्क (इडीसी) को लेकर हुडा घिरता नजर आ रहा है। पंजाब एवं हरियाणा उच्च न्यायालय द्वारा पूछे गए सवालों ने हुडा प्रशासन की मुसीबतें बढ़ा दी हैं।

ग्रेटर फरीदाबाद वेलफेयर एसोसिएशन, फरीदाबाद की ओर से दायर एक याचिका में सुनवाई के दौरान हुडा, फरीदाबाद की ओर से एक शपथ पत्र दायर किया गया था, जिसमें ग्रेटर फरीदाबाद में विकास परियोजनाएं 2016 तक पूरा होने की बात कही गई थी, लेकिन उच्च न्यायालय ने इस शपथ पत्र को खारिज कर 21 अप्रैल को एक अंतरिम आदेश जारी किया है, जिसमें नए सिरे से शपथ पत्र जमा कराने को कहा है।

उच्च न्यायालय ने हुडा प्रशासक से कहा है कि वह अपने शपथ पत्र में बताए कि 31 मार्च 2014 तक कितना इडीसी वसूला गया है? इसमें से कितना पैसा किस काम पर खर्च किया गया है? बाहरी विकास का काम कितने समय में कब तक पूरा किया जाएगा? एक निर्धारित समय सीमा से अवगत कराया जाए। अदालत ने हुडा के मुख्य प्रशासक से इस तरह की जानकारी दूसरे शहरी क्षेत्रों के बारे में भी देने को कहा है।

दिलचस्प यह है कि ग्रेटर फरीदाबाद में कालोनाइजरों ने जब लाइसेंस लिया था तो उस समय कालोनी के अंदर का विकास की जिम्मेवारी तो कालोनाइजर की ही थी, लेकिन बाहरी विकास जैसे पानी-सीवर-सड़क आदि की जिम्मेवारी हुडा ने ली थी, लेकिन कोई समय सीमा तय नहीं की थी। बल्कि कालोनाइजर से यह लिखवा लिया था कि जब तक हुडा बाहरी विकास नहीं करता, तब तक कालोनाइजर ही पानी-सीवर का इंतजाम करेगा।

अब कोर्ट के इस अंतरिम आदेश के बाद हुडा को यह सुनिश्चित करना होगा कि वह कितने समय में बाहरी विकास का काम पूरा कर देगा। इतना ही नहीं, अब हुडा या हरियाणा स्टेट इंडस्ट्रियल एवं इंफ्रास्ट्रक्चर डवलपमेंट कारपोरेशन (एचएसआइआइडीसी) को यह भी बताना होगा कि गैर लाइसेंसी इलाके में वह बाहरी विकास पर कितना पैसा करने वाला है।

जानकार मानते हैं कि इससे ग्रेटर फरीदाबाद के विकास के मामले में हुडा की जिम्मेवारी बढ़ेगी और ग्रेटर फरीदाबाद में विकास कार्य में तेजी आएगी। वहीं फ्लैट खरीद चुके लोगों पर बढ़ाई गई ईडीसी की मार भी कम होगी, क्योंकि हुडा को वूसली गई ईडीसी का पूरा ब्योरा पेश करना होगा।

विशेषज्ञ कर रहे हैं पड़ताल : दहिया

उच्च न्यायालय ने जो भी अंतरिम आदेश दिया है, हमारे विधि विशेषज्ञ उसकी पड़ताल कर रहे हैं और अगली तारीख से हमारी ओर से शपथ पत्र उच्च न्यायालय में दायर कर दिया जाएगा।

ग्रेटर फरीदाबाद (ग्रेफ) के विकास कार्यो का पहिया अब ज्यादा तेजी से घूमेगा। विकास कार्यो में आ रही तमाम तरह की अड़चनों को दूर करने के लिए सख्त कदम उठाए जाएंगे, ताकि इस साल के अंत तक कई विकास परियोजनाओं को पूरा किया जा सके। विकास कार्यो में कई जगह अतिक्रमण है तो कई जगह भूमि अधिग्रहण का काम बाकी है। हुडा प्रशासक सुप्रभा दहिया ने शुक्रवार को अपने कार्यालय में ग्रेफ के विकास कार्यो की समीक्षा करते हुए अधिकारियों को इन सभी कामों में तेजी लाने के लिए जरूरी दिशा-निर्देश दिए।
ग्रेफ में मास्टर रोड, बरसाती पानी की निकासी, सीवर लाइन, पावर सब-स्टेशन, जलापूर्ति, सीवर ट्रीटमेंट प्लांट, स्ट्रीट लाइट लगाने जैसे अनेक विकास कार्य चल रहे हैं। मास्टर रोड बनाने और स्ट्रीट लाइट लगाने के लिए खंभे खड़े कर तार डालने का काम तेजी से चल रहा है।

मास्टर रोड : ग्रेफ में सेक्टर-75 से 89 तक 15 नए सेक्टर तैयार हो रहे हैं और बिल्डरों द्वारा गगनचुंबी इमारत भी तैयार कराई जा रही हैं। इन सब की बेहतर कनेक्टिविटी के लिए 27 किलोमीटर मास्टर रोड बन चुका है, जबकि 12 किलोमीटर सड़क सितंबर तक बना दी जाएगी। सड़क बनाने के लिए जमीन पर कब्जा लेना सबसे बड़ी मुसीबत है। हुडा प्रशासक ने संबंधित अधिकारी राजीव शर्मा को कब्जा लेने के लिए कहा है।

तिगांव रोड : हुडा प्रशासक ने तिगांव रोड की भी जानकारी ली, क्योंकि तिगांव रोड ग्रेटर फरीदाबाद के लिए मुख्य सड़क है, लेकिन यह रोड लोक निर्माण विभाग (भवन व सड़क) के अधीन है। हुडा प्रशासक ने इस संदर्भ में लोक निर्माण विभाग के अधिकारियों से बात कर सड़क बनाने के आदेश दिए।

जलापूर्ति : हुडा प्रशासक ने कार्यकारी अभियंता जेएस सौरोत से जलापूर्ति की प्रगति रिपोर्ट मांगी। जेएस सौरोत ने हुडा प्रशासक को बताया कि जलापूर्ति के लिए तेज गति से कार्य चल रहा है। 31 दिसंबर 2014 तक हरित पट्टी में 15 टयूबवेल लगाकर आंशिक रूप से पानी की सप्लाई शुरू कर दी जाएगी, लेकिन जलापूर्ति की योजना का पूरा काम वर्ष 2016 तक होना है।

सीवर ट्रीटमेंट प्लांट : सीवर ट्रीटमेंट प्लांट का काम शुरू नहीं हो सका है, क्योंकि इसके लिए भूमि अधिग्रहण के लिए सेक्शन चार व छह हो चुका है। जल्द ही सेक्शन-9 की प्रक्रिया पूरी होने के बाद भूमि अधिग्रहण का अवार्ड होना है। भूमि अधिग्रहण होने के बाद भी काम शुरू हो सकेगा।

सीवर लाइन: सीवर लाइन के काम से हुडा प्रशासक संतुष्ट दिखीं। अधीक्षण अभियंता एके गुलाटी ने हुडा प्रशासक को बताया कि फिलहाल27 किलोमीटर सीवर लाइन में से 22 किलोमीटर लाइन डल चुकी है और बाकी काम भी जल्द पूरा कर लिया जाएगा।

बरसाती पानी की निकासी : बरसाती पानी की निकासी का काम भी अपने निर्धारित समय के मुताबिक ठीक स्थिति में है। 36 किलोमीटर में से 27 किलोमीटर तक बरसाती पानी की निकासी का काम हो चुका है। बाकी काम 30 जून 2015 तक करना है। सब-स्टेशन व हरित पट्टी बनाने के लिए अधिकारियों को आदेश दिए गए हैं।
