Friends,

The marathon arguments lasting 18-20 hours on assorted dates made by Builder's advocates have been completed. The arguments went on for two consecutive dates i.e 23rd & 24th September 2015. It was very well prepared,argued cogently by the builder' advocate.

Following cases like Cses filed by GFWA, BALWAN SINGH & Ors will be argued on 30th September 2015 followed by arguments by the "STATE" and hon'ble judge has assured to complete the argument latest by next Friday.

The next date is scheduled on 30.09.2015.
Next month judgment may be pronounced.

This is for the information.

Friends,

The case pertaining to EDC and infrastructure development filed by builders is being argued prudently & rigorously by the builders advocates.
The hon'ble judges seem to be impressed with the non work culture of state inspite of huge amount collection from the residents of state.

Now the stage of case is that STATE has begun arguments on today( 1st Oct 2015) and will continue on Monday(5th Oct 2015).
Also hon'ble bench has assured that matter will be completed within October 2015.

Also the case pertaining to "RETROSPECTIVE EDC or EEDC" has been detached from the builders case and will be heard once the case pertains to builders or EDC is brought to judgement.

It means the consumers will have to wait for some more time or possibly for a longer period for the logical judgement.

This is for the information to all.

The case has turned out to be " BIRBAL KI KHICHRI".

I am afraid the hon'ble judges start feeling monotony and look like as if they are exhausted.

EDC case next hearing is on 26-NOV-2015. I attended Court hearing in October and was shocked to see how Haryana Govt./HUDA is charging money from middle class tax paying home buyers in name of EDC. Govt is having huge EDC amount of around 3000 crores from Greater Faridabad (Sectors 75 to 89) and earning hundreds of crores of interest every year

- For doing EDC works, Govt. is taking cut of 49%. So, if 1 rupee is spent on development, 49 paisa goes to HUDA pocket and only 51 paise is left

- For calculating EDC, HUDA is burdening Delhi Metro costs on GF residents.

- EDC cost also take into account 10 years Street lightening and Maintenance cost. Then why we pay taxes??

- EDC is getting charged from buyers on even Govt. land and Govt contructions

- No accountability of not doing EDC works for more than 10 years. It may be better for Govt to earn interest in range of 300 crores from hard earned money of home buyers without doing anything every year

Previously Congress Govt was milking home buyers and now BJP Govt.

Dheeraj ji,

In fact the middle class population is the milking cow for all the governments. Aur sabhi political parties are "ek hi thalli ke chhate batte". In fact we are not at all united. Also we are overburdened by the employers to win bread for our families.

Abhi toh aapko VAT nahi laga hai. VAT will be levied on you once you will be offered the possession. Also the middle class could not be proved to be vote bank for any of the political parties therefore all the political parties are least bothered for the middle class population.

Ironically courts seem to be least bothered for the middle class population. If you remember the observation of Hon'ble SC in one of the hearing of Piyush case hon'ble SC observed that BPL( Below poverty line) is the only underprivileged population and middle class are riches because they are buying a flat worth in Lacs. Whereas middle class buy a house once in lifetime for themselves.

High Court refuses to provide relief on EDC on fresh petitions

Please note this order is currently not for GFWA petition whose next date of hearing is 08-Feb-16. But, this order gives idea of High Court mood

Looks like High Court is saying that Govt., HUDA and DTCP can demand as much money and colonizers have to pay which in turn will be paid by consumers. Govt collects 5000 crores and spends only 1000 crores and that is also done more than 5 years late.What is accountability of 4000 crores of rupees who are paid by hard working middle class people ??
