Please find attached very useful document downloaded from Town and Country Planning, Haryana website. (http://tcpharyana.gov.in) consisting of licences of all builders in Haryana with vailidity/renewal status upto July 2012.

Hi Dheeraj,
very useful info...thanks for sharing this...few queries if you are aware of that...
1) For most of the builders I found that license is expired in 2011 / 2012, but still they are carrying out construction activities. I guess legally no one can carry out construction quality with valid license (but every thing is possible in India). Is this a normal practise whereby colonisers reapply the license renewal while nearing completion.

E.g KLJ had two licenses in 77, one .expired in aug 11 and other in aug 12 while from RTI replies on EDC it was clear that KLJ had paid complete OLD EDC

2) Is there any legal rule / condition which is evaluated by HUDA before renewal?

In Faridabad esp. greater Faridabad this M/s countrywide Promoters Pvt Ltd is a major licence holder i want to know where are its offices and address.

Legally may be Yes, if licence is expired, then developer should not be allowed to carry out construction activities. But, in actuality, no action gets taken and even Town and Country Planning keeps on sending their demands of money to expired licence holders. To give you an example, Piyush licence expired in March 2009 and not renewed due to non-payment of EDC/IDC. But, construction activities were not put on hold due to this.

How is it that these Nationalized and big corporate banks keep on disbursing loans to the demands from a expired licence company and what right does a expired licence holder company have to demand enhanced EDC and also how can it be ensured that the EDC that it collects ,is not diverted .

Builders have right to demand even if their licences are expired because Govt. demands from them. That is a very vaild point that Govt. should sure that funds collected from EDC amounts are not diverted for builders private use. But, it seems Govt. is hands in glove with these builders

I think this can be a important issue in court of law ,that a unlicenced company is asking for a enhanced EDC. Just like the example that a quack may be doing his practice of a doctor just by the side of a police station,but in court he cannot justify his buisness and court cannot say that he can continue to do the same.

Also like a Pharmacist Licence is used by many medical shop owners for running their buisness , but if the licence of the pharmacist expires then all stand to be exposed.

Hi Naveen, root starts from Govt. Govt. is NOT distinguishing between valid or expired licence holders.Govt. has sent enhanced EDC demand letters to both valid/expired licence holders. It is a mockery of law from the top. When builders receive enhanced EDC Demand letters, they will ask from buyers to pay.

Thats absolutely right Dheeraj.

At the very first instance what was the need of securing bank guarantees from builders against EDC??
Why were bank guarantees not encashed by DTCP in case of default by builders??
Why has the DTCP given extended and relaxed penal interest terms to builders for a further 12 months to pay outstanding EDC??
Why is DTCP renewing licenses of builders who are at Defaulting??

As I understand EDC is now being treated as Land Renvenue in the latestEDC RELIEF POLICY, which if not paid should be recovered from the personal properties and business of directors of the company, if the DTCP has an intent to clear the mess of Rs 3500cr outstanding EDC amount.In all probability, builders have taken most of this money from buyers and have digested it.

Would request if a RTI can be filed with DTCP regarding these matters to seek clarification on
- status of pending edc for builders under the latest scheme to accommodate defaulting builders
- what would be the consequencies if the builders do not pay beyond this grace period
- Reasons why licenses are not renewed or are rejected by DTCP for various builders
and any other relevant information

This becomes pertinent as the following licenses have either been executed or expired.

Chances are that these licenses have expired and those invested in these licenses should move appropriate authority for suitable recourse. Builders cannot take govts money and enjoy while their licenses have expired/not valid any more.

BPTP is the biggest defaulter as evident from above list as per DTCP website data. Their only business is to harass and extort from the customer with unethical and illegal demands and still not deliver.

RPS, Piyush, Triveni, KLJ, Era, Zion, Shiv Sai buyers be equally beware.

The list gives absolute clarity on the intent of these builders which is not a comfortable sight.

I had already filed RTI in this regard and it is clear from RTI reply that Department will NOT renew licence if original EDC is not fully paid. With regards to consequences, DTP (HQ) verbally informed that it can well be cancellation of licence which they have already done for some builders in Gurgaon. RTI reply is availble at:

Hi,

This Builder is defaulted to a tune of 24 Cr in account of EDC abd IDC??? Is he going to Pay such a huge amount ?

which builder is this ? The letters are very old (2009) ... do we know the current state ?

Well spotted!!!

(list is as available on DTCP website containing license no, area, sector, valid upto date, developer name etc.

WIsh that the builder has paid the amount since 2009, otherwise please add 15% pa penal interest on unpaid EDC/IDC amounts from the dates mentioned. The amount would be 34Cr+ appx, if nothing is paid by this builder in the meantime.

If EDC/IDC if not paid with interest, the EDC payment policy announced in May 12 states- outstandings will qualify as "Land Revenue Arrears". In which case may then be recoverable through liquidation process by the govt. Would like to mention here that homeseekers as in the case of TRIVENI hold the status merely as UNSECURED CREDITORS.

Please check RTI reverts available with invested members for more clarity on outstanding of PIYUSH and Other builders.. BPTP is the biggest defaulter as per DTCP website, with licenses for 942acres not renewed/valid (out of which 550 acres licenses not renewed/valid since 2008!!!- primarily sector 88/89 land)

Once this huge amount is paid, license MAY be revalidated by DTCP and process for OCCUPATION CERTIFICATE MAY be started on builder request. If construction is as per approvals, OC takes anywhere upwards of 6 months.

Rest your guess is as good as mine on the question "Whether the builder will pay or not"

Good thing is that the market is on the upside and most projects are above 2500 psf. GOD FORBID, if recession sets in, looking into the current shaky economic/political/social situation, then only god will be able to help.

Please make the 30th September protest POCKET MAAR a resounding success with your participation and encouragement. Would request all RESIDENTS/enduses/brokers/investors to join to protest against slow pace of development by administration and unethical charges/harassment by builders.
