From execution of conveyance deeds without occupation certificates (OC) to arbitrarily charging stamp duty, registration authorities and colonisers in Faridabad are allegedly violating the law, according to a flat owners’ federation.

They are allegedly committing glaring irregularities, harming the interests of thousands of flat and plot owners.

Gross violation

The colonisers need to procure OCs for their projects from the Department of Town and Country Planning and submit a deed of declaration before the registering authority can execute the conveyance deed of a flat/plot. But the conveyance deeds are being executed without the OCs and deeds of declaration, in gross violation of the rules Also, the colonisers are charging two rates of stamp duty from the allottees. “Some of the builders are charging 5, 6 and 7 per cent and some are charging 3, 4 and 5 per cent. Since the entire area of Sectors 75 to 89 in Faridabad falls under the Master Plan of Faridabad-Ballabgarh Controlled Area, 1991, it is completely unjustified to charge different rates and should be rectified at the earliest,” said Ashish Kaul, vice-president of Federation of Apartment Owners Association.

The federation has made a written complaint to the Deputy Commissioner highlighting the irregularities and violations and seeking immediate correction and action against those responsible for the illegal acts.

Arbitrary charging

“Another issue is arbitrary charging of Circle Rates by the colonisers, in gross violation of Revenue Department guidelines. While some of the colonisers are charging Rs.2,300 per sq. feet, the others are demanding Rs.4,000 per sq feet. This alarming difference in Circle Rates is causing doubt over the present and future liabilities of home owners towards the registration authorities. Therefore, in the larger public interest such unfair practices should be put to an end at the earliest,” said Mr. Kaul.

Same yardstick

The federation is also opposed to similar circles rates for Group Housing Societies from Sectors 75 to 89 and the rest of Faridabad on the ground that “Neharpar” does not have infrastructural facilities like roads, water supply and hospital at par with the remaining area. “Since the committee has revised the Circle Rates by 10 per cent in other areas, same yardstick should be applied to calculate Circle Rates for Group Housing Colonies,” said Mr. Kaul.

Also it is to inform that FEDERATION OF APARTMENT OWNERS, GREATER FARIDABD is meeting with the committee formed by hon'ble Deputy Commissioner, Faridabad on dated 03.12.2013 at 12.00 NOON.
Once the issue is resolved the Apartment/ Independent Floor owners will be benefited with Rs 50,000.00 to 150,000.00. The benefit will happen for those who have not executed conveyance deed/ Registry till date.

Also the above matter will appear in the National News Channel ( NDTV) as the recording for the same will occur today( 03.12.2013) and the matter will be discussed by Sh Aashish Kaul ji( Sr Vice President, FOAO,GF).

The SDM, Faridabad gave clear instruction to the registrar that henceforth no Registration should be done without the valid OC & Deed of Declaration in Greater Faridabad.

The SDM as Wel as the Naib registrar clearly told that they are charging 3%-Female, 4%- Joint & 5% Male owners as stamp duty.
And the Builder is also paying that much to them. If the Builder asks you to pay 5%,6% & &7% than it is a matter between you & Builder.

Moreover the Naib registrar told that for MCF area they will charge extra 2% as a seperate Challan besides the 3%,4% & 5%.
But there was confusion on which amount he will charge 2%more for MCF charges.

It gives me an immense pleasure that FAOA,GF representatives happened to meet Hon'ble SDM today( 03.12.2013) in the matter published below.

My suggestion for all the esteemed recipients of the mail is that they should communicate to their respective/prospective allottees to withhold the execution conveyance deed/registry for some time. Also it is informed that hon'ble SDM has principally agreed that there should not be any discriminate % of STAMP DUTY levied within the ONE CONTROLLED area. Also EDC, IDC, EEDC, ELECTRIFICATION CHARGES, CLUB CHARGES, PARKING CHARGES, IFMS should not be a part of BSP and the STAMP DUTY is supposed to be calculated as on BSP only.

Once the above comes in BALCK & WHITE from the administration the cost of STAMP DUTY will prune down drastically and all the buyers will be in a position to save an amount to the tune of Rs 100,000.00( Rs One Lacs) to 200,000.00( Rs Two Lacs).

It is therefore requested that message for "WITHHOLDING THE EXECUTION OF CONVEYANCE DEED/REGISTRY" goes VIRAL to the larger number of buyers.

I once again request all the esteemed recipients of the mail to communicate the message swiftly.

The next date of hearing with Hon'ble SDM is scheduled on 10.12.2013.

Thanks for sharing this information.

Do we have any written documentation from the SDM mentioning the details? Would they be sharing with all builders informing them about the same ?

The Law is supposed to ensure that everyone follows the law and its being correctly implemented.

ग्रेफ के बिल्डरों पर कसेगी नकेल
फरीदाबाद (ब्यूरो)। ग्रेटर फरीदाबाद (ग्रेफ) में मनमाने तरीके से रजिस्ट्रियों के आरोप पर जांच शुरू हो गई है। फेडरेशन ऑफ अर्पाटमेंट ऑनर्स एसोसिएशन ग्रेफ ने जिला उपायुक्त से इसकी शिकायत की थी। जांच एसडीएम फरीदाबाद धमेंद्र सिंह ने मंगलवार से शुरू कर दी है। उन्होंने दोपहर 12 बजे फेडरेशन अध्यक्ष नरेंद्र छाबड़ा, पदाधिकारी आशीष कौल, उमेश प्रभाकर, नवीन अरिचवाल और तुलिंदर कटोच को कार्यालय बुलाकर जानकारी ली।
फेडरेशन सचिव उमेश प्रभाकर ने आरोप लगाया कि ग्रेफ में सेक्टर-75 से 89 तक का क्षेत्र कंट्रोल एरिया है, बिल्डर यहां रजिसट्री कराने के लिए ज्यादा रकम वसूल रहे हैं। ज्यादातर बिल्डरों ने ऑक्यूपेशन सर्टिफिकेट नहीं लिया है, पर रजिस्ट्री हो रही है। एसडीएम ने 10 दिसंबर तक इस मामले पर निर्णय सुनाने की बात कही है।
