Faridabad kickstarts Allottees Grievance Redressal Forum, sends notice to builder

The Haryana government recently constituted “Allottees Grievance Redressal Forum” to look into complaints of investors in private residential societies in every district. 41 aggrieved allottes of a residential society here lodged a complaint of cheating with the district officers of Faridabad against a builder. The state authorities immediately invoked provisions of the forum and slapped a notice on the builder directing him to be present at the office of District Town Planner (DTP) on August 3. The DTP slapped this notice as a member secretary of this newlycreated forum. Not only this, even the member secretary of the forum directed the builder not to cancel any allotment, which the complainants claim the builder has done.

In fact a large number of consumers who had purchased flats in Piyush Heights project in Sector 89 resorted to protests a few days ago against the builder for what they claim slapping unreasonable demand notices and also cancelling their flats.

“We were shocked to see the builder Piyush Heights sending us demand of Rs 12 to Rs 14 lakhs etc against the genuine demand of Rs 1.2 to Rs 2.7 lakhs,” said Tulinder Katoch, president of Piyush Heights Apartments Allottees Society. “We were left with no option but to protest and inform the government machinery about this cheating and fraud,” he added.

“It is informed that a group of nearly 41 aggrieved flat allottes visited the office of under-signed on July 21 with banners, slogans against your company. It is claimed by the applicants that they have made 80 to 95% costs of the flat and it is unreasonable/unlawful on part of the company to cancel the allotment of the flats at this stage,” DTP, Faridabad Amrik Singh’s letter to Piyush Buildwell India Ltd said. “In this regard, it is directed to explain on what grounds has the company issued the above stated cancellation letters and inflated the demand as claimed in the enclosed copy of the complaint,” it added.

“It is also informed that gover nment has constituted “Allottees Grievances Redressal Forum” under the chairmanship of deputy commissioner, Faridabad and the undersigned is the member secretary of he constituted committee,” the letter said. “In this capacity this office directs you not to cancel any allotment until any decision is taken on the complaint by the constituted committee.”

Three directors of this real estate company, including its managing director were arrested in 2013 and they remained in jail for almost 40 days.

“The charges are baseless. Even if we have cancelled any allotment it may be because the buyer may have failed to make payments,” said Shewata, assistant manager of the company. However repeated attempts were made to seek comments of director Puneet Goyal, but he did not pick up phone.

where is this forum in Faridabad. I think in Greater Faridabad 90 percent of developers are cheaters and gundas.

बिल्डरों के खिलाफ 500 से अधिक शिकायत, कमेटी साधे हुए है चुप्पी

फरीदाबाद। जिले में बिल्डरों के खिलाफ आने वाली शिकायतों पर एक्शन लेने के लिए बनाई गई कमेटी निरर्थक साबित हो रही है। निवेशकों ने अब इसकी कार्यशैली पर उंगुली उठाना शुरू कर दिया है। उनका दावा है 4 माह पहले बनी कमेटी अभी तक शिकायत आने वाले बिल्डरों के खिलाफ कोई कार्रवाई नहीं की है। जब कमेटी का गठन हुआ था तब इसकी प्रत्येक माह मीटिंग होने का दावा किया गया था। लेकिन हकीकत यह है कि चार महीने में केवल एक मीटिंग हुई है। बिल्डरों के खिलाफ कार्रवाई होने से आलम यह है कि कुछ माह में ही इनके खिलाफ एक जनवरी 2015 से टाउन एंड कंट्री प्लानिंग, सीएम विंडो समेत चंडीगढ़ में 500 से अधिक कंपलेंट पहुंच चुकी हैं। अब ग्रेटर फरीदाबाद की 14 सोसाइटियों के हजारों निवेशक बड़े प्रदर्शन की तैयारी कर रहे हैं।


100 एफआईआर दर्ज

सरकारने यह कदम बिल्डरों के खिलाफ लगातार बढ़ती शिकायतों के मद्देनजर उठाया था। जिले में बिल्डरों के खिलाफ अधिकारियों के पास सैकड़ों शिकायतें और करीब 100 एफआईआर दर्ज हैं। इसके बावजूद बिल्डरों के खिलाफ कोई ठोस कदम नहीं उठाया गया है। इससे निवेशक परेशान हैं। इस कारण सरकार ने कमेटी को महीने में एक बार मीटिंग कर निवेशकों की शिकायतें निपटाने के लिए जुलाई में आदेश दिए थे।


वसूली पर अधिकारियों की चुप्पी

फ्लैटधारक तुलींद्र, उमेश, आरपी उन्याल, सुरेश पाल, बीपी शर्मा के अनुसार बेशक प्रशासन लाख दावा करे लेकिन बिल्डरों के आगे सभी बौने हैं। नहरपार बिल्डर मूलभूत सुविधाओं के नाम पर निवेशकों से लाखों रुपए वसूली के नोटिस भेज रहे हैं। इनमें कार पार्किंग, क्लब मेम्बरशिप, पॉवर बैकअप, गैस कनेक्शन के चार्ज, बिजली के मीटर के चार्ज, टेलीफोन के कनेक्शन के नाम पर, वाईफाई सुविधा देने के नाम पर मोटी रकम वसूली की जा रही है। इन सभी सुविधाओं के लिए सीधे कंपनी की तरफ से काफी कम चार्ज लिया जाता है जबकि बिल्डर 5 गुणा से अधिक दाम वसूल रहे हैं। इतना ही नहीं फ्लैट बुक कराने के बाद अब उन्हीं फ्लैट के दाम बिल्डर ने 7 से 10 लाख रुपए बढ़ा दिए हैं।


क्या हो सकती है कार्रवाई

टाउन एंड कंट्री प्लानिंग के नियमानुसार यदि कोई भी बिल्डर डिपार्टमेंट के नियमों की अनदेखी करता है तो उसका लाइसेंस रद्द किया जा सकता है। उसके खिलाफ कानूनी कार्रवाई भी की जा सकती है। इसके अलावा निवेशक के साथ धोखाधड़ी करने में बिल्डर के खिलाफ एफआईआर दर्ज की जा सकती है। धोखाधड़ी में सजा जुर्माना दोनों का प्रावधान है।


उनके पास आई शिकायतों की जांच चल रही है। उन्होंने नहरपार जाकर फ्लैटों के मैटेरियल की

जांच भी की है। मैटेरियल को जांच के लिए लैब भेज दिया गया है। जांच रिपोर्ट आने के बाद उचित कार्रवाई की जाएगी। -अमरीकसिंह, डीटीपी।


बिल्डरों के खिलाफ कोई भी निवेशक डीटीपी को शिकायत दे सकता है। डीटीपी रिपोर्ट आने के बाद कार्रवाई होगी। बिल्डर की मनमानी बर्दाश्त नहीं होगी। कमेटी आज भी अपना काम कर रही है। -डा.अमित कुमार अग्रवाल, डीसी।

प्रदर्शन के बाद कार्रवाई नहीं

सेक्टर-87निवासी काफी लोग वैट (वैल्यू एडिड टैक्स) के खिलाफ कई बार प्रदर्शन कर चुके हैं। पीड़ित वरुण बांगिया, अवनीश कुमार, अनिल, अरुण, अजय के अनुसार सरकार ने अभी वैट बढ़ाया नहीं है, इसके बावजूद बिल्डर बढ़ा हुआ वैट मांग रहा है। बिल्डर द्वारा उनको रजिस्ट्री कराने पर 4 प्रतिशत वैट देने के बारे में कहा गया है। मनमानी से प्रत्येक बिल्डर पर 2 लाख रुपए अतिरिक्त बोझ पड़ेगा।


वसूली कर रहे हैं बिल्डर

सेक्टर-89निवासी तुलींद्र के अनुसार उन्होंने 19 लाख रुपए में फ्लैट बुक कराया था। अब उनसे 13 लाख रुपए अतिरिक्त मांगे जा रहे हैं। आरोप है बिल्डर सुपर एरिया, ईडीसी सहित अन्य कर के नाम पर अधिक वसूली कर रहा है। उन्होंने बिल्डर के खिलाफ केस दर्ज कराया है। मामला कोर्ट में है। प्रशासन की तरफ से आगे कार्रवाई नहीं बढ़ रही है। इसलिए यहां के निवेशक अब प्रदर्शन करने की तैयारी में हैं।
