BPTP cheating the customer

BPTP emerging as major cheater in naharpar area. today they are launching new booking for elite floor but people like me are still awaiting for there allotment after paying them huge amount(35% of total value),they are enjoying our money from two years.Even they are not listening to our complaints. any body can suggest me what we can do against these fraud.

We should file cases in Consumer forum. Also approach National Consumer helpline (1800114000,011-27662955-58), file online grievance at http://www.ccccore.nic.in, send letters to Ministry of Consumer affairs, Krishi Bhawan, New Delhi-110001 as well as to HUDA, Faridabad, DTCP, Faridabad and Chandigarh. In a nutshell unless, we put all round pressure on all the concerned authorities, big builders like BPTP will not do justice to ordinary consumers. For more information, feel free to contact me at 9818433670.We should also use the RTI route to find from DTCP the dates of sanction of building plans since it can be proved from the same that these builders were making false promises at the time of booking. BPTP has done a big fraud by putting "FIRST COME FIRST SERVE" condition in the Advance Registration Form while the actual allotment was done by Computerized Draw system through which BPTP managed to allot flats to its preferred brokers at the lower floors while ordinary consumers ending up getting flats at higher floors whose market value is less.
All of us should file mass action appeal before PMO as well as President and expose these fraudulent builders. They should not be allowed to start any fresh project till the existing projects are completed.

We have to plan to make Publicity in such a way that they could not book their new flats. What to do for it - is open to all. Requested to send the suggestions for it.

BPTP HAS TREMOUNDOUSLY DONE FRAUD WITH Park Elite Floors user.First they have advertised the flat at 25 lacs and suddenly they have raised demands that super built up area has been revised hence you have to pay 6 lacs rupees for incres therby costing the floor on 250 sq yard appraox 32 lacs.

We have to go and see the calculation of super buildup area. They are including the mumty and boundary in buildup area. Which was already in plan and should not be include in the buildup area.They are not ready to provide the calculation sheet and saying that sheet is not ready for circulate. I have the customer care, when your sheet is not ready then how can you send the demand notice.

We should take the sheet first.

Please submitt your complain to DC with this unreasonable demand letter of unreasonalbly increased of area in the history of NCR and mark copies to CM office, all the news papers and electronic media's offices.
Let every one be flooded with letters, as I understand PARK ELITE FLOOR has been sold in huge quantity and the volume of scam must be running in crores.

Definitely , we should fight and they are not ready to provide the calculation sheet. They are saying come to the office and they will describe , how the super buildup area got increased. If there is no change in plan then buildup area can not increased. Please advise how we can submit our complaints.

BPTP has done injustice to all the flat owners. And believe me if BPTP succeeds in this cheating, all other builders will follow the same method and extract more money from us. We are bound by the builder buyer agreement and at any stage if we create a dispute, the builder can cancel our units and return us our invested money. Since the prices have increaed over a period of time, the builder is happily ready to get back the units at the original prices. Hence all this new methods of cheatings are devised by the builder against the helpless investors.

Can we not get a stay against this injustifiable demand of BPTP ? Since it is a builder related issue, can the DC/DTP put a stay on this demand ? This demand of BPTP must be stayed otherwise it will become a tool for all the other builders to extract more money from the flat owners.

BPTP has every intention to cheat customers. They have been playing all tricks to cheat customers of their money - by not alloting, by cancelling allotments, by charging interests (due to delay on their part), by manipulating built up area, charging more EDC/IDC charges, by not giving back money with interest etc. etc.

A Legal case is really neccessary here. Does anyone have media connections to get this highlighted in news as well?

I am also a victim of BPTP Park Elite floor. They have increased the area of 180 Sq yards unit from 876 sqft to 1047 sqft and increased the BSP by 171*2425= Rs 414675 and send a demand. I have asked them the justification of new area and new floor plan, layout approved as per HUDA norms. They simply refused to provide them ans said u have signed addendum in which it is mentioned what are the things included in super builtup area. But there should be a maximum limit, a proportion to built up area. This 20% increase in area is excessive and they charged this area with current market rate i.e. Rs2425/- ( not that rate Rs 1835 at which we booked our unit in june2009).Generally builder increase the price upto 5-10% only at the time of possession.

BPTP has planned to charge extra on the basis of increased area(which is not in actual)because of the premium on the project.BPTP wants to encash all the premium from their innocent customer to bring the project at par with market rate. I am sending them legal notice as discussed with a lawyer and filing a case in consumer court if no reply is received from BPTP. I would request all of u to unite together and not to make any payment against the unjustified demand of BPTP. BPTP did the same thing in their Freedom Park colony at Gurgoan but exposed by allottee through media(AAJTAK) and RTI Act. See video clipping on you tube. We can also follow the same route if no proper reply is received from BPTP.

Buyers having such type of problems of cheating customer by given back the money must move to the court. Dont expect any help from the civil administration. I am also fighting a civil suit agaisnt Shivsai as they have reduced the size of the lift upto 60% and in any circumastances builder has to abide with the promise made to the cutomer. If you have made payment as per their demand, No builder can cancel the flat/booking.

BPTP group has given its customers of "ParkLand Elite Floor Project"
a sudden setback be raising a demand of Rs 4 to 5 Lacs citing the
reason that super built-up area has been raised. One of their demand
letters says :

"We would also like to use this opportunity to inform you that at the time
of booking the tentative Super Built Up Area of the above mentioned unit
was 1,203 Square foot (111.76 sq. meters). However, on measuring the
dimensions of the unit now, with construction at an advanced stage, the
Super Built Area stand revised to 1,394 Square foot (129.51 sq. meters)."

Also, this cited increase in super-built up area will be charged at
new increased rate instead of initial rate of Rs. 1860 per sq-ft.
Due to this demand, customers will be burdened with an extra amount of
4 to 5 Lacs which is not a small and easily arrangeable amount. Only 21
days have been given to make this payment.

Customers are not comfortable with this sudden and unexpected demand.
Even customers have not been told clearly where this increase of
super built-up area has been made. 15-16% Increase of super built-up
area is certainly a not mistakenly increased area, but it seems to
be intended and well planned strategy of BPTP to cheat its customers
and make money. BPTP knows that at this final stage of construction,
its customers will not opt for surrendering the flats and they will
have to obey its cheater demand.

In Gurgaon also , bptp has done the similar thing for freedom Park life. However,
BPTP was forced to withdraw the demand when the issue was highlighted by media
and opposed by flat buyers .(media coverage by aajtak - available on net).

The Gurgaon Resident Association faught with the BPTP on its unreasonable demand and got a rollback. Aajtak also featured the news. Same cheating is now being planned by BPTP in Faridabad. We all must stand together and stop BPTP on its ill designs. What can be done by us ? Can this case be forwarded to Aaj Tak again ? Anyone having contacts there ? If the case features again in Aaj Tak then BPTP will have roll back it as it is a undue demand. GFWA shuold strongly take up this matter to the press.
