Hello @kumard31/All,

Reply for super area by Piyush is hiding facts and misleading. It seems to be suggesting that we (Piyush) had forced an unfair agreement with you and now we have right to demand unjustified money.They have not answered even first question that was asked:

1. Complete calculations (i.e. with break-up dimensions of each area/ room /amenities) for arriving at the super area of 1446 sq.ft. as per earlier declaration mentioned in Buyer’s Agreement, Annexure-A, Page 14.


Piyush Group should answer this question. Please note that calculations done by Piyush Group in arriving at number of 1446 sq ft were detailed and accurate to even 3 decimal places. In allotment letter, they have mentioned area as 1446.070 sq ft. Whereas in case for 1576 sq ft, they arbitrarily increased this for extracting money from buyers. They should share calculations for both 1446.070 sq ft and 1576 sq ft for truth to come out in open. @kumard31, you should reply back to Piyush Group mentioning that reply sent is unacceptable and seems to be hiding facts and misleading, we are bound to honour buyers agreement but you MUST share calculations.

Variation of 9% between tentative super area (declared in BBA) and the actual after final measuerment, is really shocking. If this variaion is found between +2% and -2% then there could be some sense because it is both sides (in some case plus side and in some cases minus side). As suggested by Dheeraj the builder should strongly be asked to clearly define from where 9% variation that too in plus side has appeared. If this much varaition comes in all the cases in plus side only, it may definitely effect the safety of structural design as the original dimensions based on which it was designed are now found increased as 9% which is a great burden of the building structure!!!.

Yes!! it is there. First of all the area can't be changed if the measurements of the structure is same as previous. Builder has claimed the increased super area i.e. 9% on previous. This is clearly breach of planning & design of Civil structure and the concerned government authority must inter vein in the matter. We must approach to concerned authority at earliest and the authority will get clarified if the changes has been made by builder from the original approval of designs. Surprisingly builder has figure out the increased area to grab money from buyer to compensate the present construction cost which is much higher than previous 6 years. At the one end builder has delayed construction and at another hand not ready to adjust the amount on account of late possession and arbitratory pushing the illegal demands to grab money. We must do something at earliest kindly advice.

We are having field reports obtained through RTI for Occupation Certificate of Piyush Heights. According to Field Report, due to extension of lift lobby and telephone shaft, there is an increase of 10.25 sq mt from original area of 2124.462 sq mt for these 3 blocks. This increase comes out be just 7 sq ft increase which is 0% increase on super area of 1446 sq ft and we don't need to pay anything. This exposes cheating and loot done by Piyush Group on super area.
