Mr Ravi or any other marketing person at the site has no standing . He is just a messenger from customers to the Higher authorities and to and fro. His role is inconsequential.

The company has been singing this song of early possession since times immemorial.

गर देर से मिले पजेशन
सपनों का घर मिले, यह सबका ख्वाब होता है। लेकिन सपने को झटका तब लगता है, जब पेमेंट होने के बाद भी बिल्डर की बहानेबाजी और पैंतरों के चलते घर मिलना मुश्किल नजर आने लगता है। बुक किए घर का पजेशन समय पर न मिल रहा हो, तो ऐसी स्थिति में कंस्यूमर्स के भी अपने हक हैं और इनके लिए वे कंस्यूमर कोर्ट जा सकते हैं। कंस्यूमर प्रोटेक्शन एक्ट 1986 के प्रावधानों के अनुसार बनीं कंस्यूमर कोर्ट मकान संबधी मामलों को सुन सकती हैं।

कंस्यूमर के हित में कानून
•यदि कोई बिल्डर तय वक्त में मकान बना कर नहीं देता, तो इसे सेवा में कमी माना जाएगा और बिल्डर को कंस्यूमर को ब्याज सहित पैसा वापस करना होगा। ब्याज की रकम क्या हो, इसका फैसला अदालत ही करती है।
•सुप्रीम कोर्ट के एक आदेश के अनुसार, अदालतें परिस्थितियों के हिसाब से 18 फीसदी तक ब्याज देने का आदेश दे सकती हैं।
•अगर बिल्डर की स्कीम किसी वजह से कैंसल हो जाती है, तो उसे कस्टमर को पूरी रकम ब्याज सहित लौटानी होगी। ऐसे मामले में भी ब्याज की दर अदालतें परिस्थितियों के हिसाब से 18 प्रतिशत तक तय कर सकती हैं।
•कोई बिल्डिंग प्लान अगर प्रशासनिक कारणों से पास नहीं हो पाता, तो इसके लिए भी बिल्डर ही दोषी माना जाएगा। बिना पूरी और सही परमिशन के बिल्डर किसी योजना की घोषणा कर पब्लिक से पैसा नहीं ले सकता।
•बिल्डर के लिए जरूरी है कि शर्तें तय करते वक्त बिल्डिंग के पूरा होने का वक्त और कब्जा दिए जाने का वक्त तय करे और एग्रीमेंट में साफ-साफ इनका जिक्र करे।
•अपनी जमीन पर बिल्डिंग बनवाने का करार भी सर्विस एग्रीमेंट माना जाता है। अगर कोई बिल्डर तय वक्त पर मकान का कब्जा नहीं देता, तो ऐसी स्थिति में भी कंस्यूमर को ब्याज मांगने का और नुकसान की भरपाई पाने का हक होता है।
•अगर मकान की खरीद-फरोख्त में प्रॉपर्टी डीलर की मदद ली जाती है और प्रॉपर्टी डीलर डील करवाने मे कुछ गड़बड़ी करता है, तो आप उसके खिलाफ कंस्यूमर कोर्ट जा सकते हैं।

इन मामलों में नहीं जा सकते कंस्यूमर कोर्ट
•अगर कोई इंसान नीलामी के जरिए मकान या घर खरीदता है, तो उसे सेवा में कमी के लिए कंस्यूमर कोर्ट जाने का अधिकार नहीं होगा। दरअसल, ऐसे मामलों में एकमुश्त रकम देकर जांच-परख कर खरीद की जाती है, रजिस्ट्रेशन करा कर घर बनवाने की सेवा नहीं ली जाती।
•किसी दूसरे व्यक्ति द्वारा बनाया हुआ या पुराना मकान खरीदने पर भी सेवा में कमी का दावा नहीं किया जा सकता।

मिलेगी राहत

कंस्यूमर 20 लाख रुपये तक के मामले में डिस्ट्रिक्ट कंस्यूमर कोर्ट में, एक करोड़ के मामले के लिए स्टेट कंस्यूमर कोर्ट और एक करोड़ से ज्यादा वैल्यू के मामलों के लिए नैशनल कंस्यूमर कोर्ट में केस दायर कर सकते हैं। केस उस क्षेत्र की अदालत में दायर होगा, जिस क्षेत्र में बिल्डर का ऑफिस होगा। सिविल कोर्ट की तरह कंस्यूमर कोर्ट में मामला दर्ज करने से पहले लीगल नोटिस जरूरी नहीं है। इसमें सीधे केस दर्ज हो सकता है। कोर्ट में एप्लिकेशन देते वक्त कंस्यूमर कब्जा दिलवाने या ब्याज सहित पैसा लौटाने की मांग के साथ-साथ मानसिक कष्ट के लिए मुआवजा और वास्तविक नुकसान की भरपाई के लिए भी कह सकता है, मसलन वक्त पर मकान न मिलने के कारण किराए पर रहने की वजह से हुआ खर्च आदि।

Dear members (of all era divine low rise project).. we all have been suffering from mental agony n apathy due to long awaitedness for getting possesion of our respective units in dis project. Time has come for us to take speedy decision n act nw.we need to file case against dev in district consumer forum..

Meeting has been postponed to 9th Feb 2015,DGTCP had to attend emergency meeting in Delhi on 12th Jan

I wonder whether we will now be getting different dates of the meeting like the dates of court cases. Doesn't court has stipulated any date when DGTCP has to report to Court about the resolution of issues between Era and BPTP. As far as I can understand, Court had fixed three months to resolve the issue

DGTCP does not care about any court order,not even Hon.Supreme Court order,viz.Durga builder area order.

Any action on violation of the terms & conditions of the law(HRD act1975) has to be retified by the Chief Minister.

Meeting on Feb. 22, 2015 (Sunday) at 11 am (Era Divine Court Site, Sec-76, Faridabad)

Dear Friends,

As we all know that Era Divine Court Project has been in doldrums since long due pathetic attitude of Adel (Era) Landmarks Ltd. Most of Low rise flat owners have booked in 2009 and High Rise owners Later. It is more than 5 years and company has done little to legalise the project.

But as you may be aware of fact that 12+1 people filed case in Chandigarh High Court for regularization of the project and got a favourable decision. In our petition, we have made BPTP as the main party, as they are the original land and license holder of the project. Due to ongoing dispute regarding payment between BPTP and Era, not only Era Divine Court Project got stuck, but Park Floor-II project also entangled. Now both projects are in limbo.

But owing to the decision of High Court and aggressive stand taken by us, BPTP and Era have come to talking table with DGTCP and the Petitioners. We (BPTP, Era and Petitioners) have TWO VERY SUCCESSFUL MEETINGS with DGTCP in Chandigarh. Earlier, Era was not interested in any kind of negotiations with BPTP and us but now they are talking.

But to get the projects regularised at the earliest, we need support of all, not one or two people. We have got some favourable decisions. There are many useful information to share with all the allottees regarding regularization of the project. For this we have called a meeting on Feb. 22, 2015 at 11 AM. The venue of the meeting is Era Divine Court Site, Sec 76 Faridabad.

We request everyone to come there irrespective of High Rise or Low Rise and formulate a plan for early approval of the project. This is a time of final thrust and we need support from everyone. Please be the part of the movement. You would be helping yourself by coming there.

Looking forwards to see you all on Feb. 22, 2015.

with real estate regulatory bill.passed by govt...it will boost investors confidence and increase demand for residential properties.....property prices to move higher in near futurr....

Real Estate Regulatory Bill has been passed by CABINET only. It has to be tabled before Parliament and Rajya Sabha for get the clearance by majority.

Therefor it has to implemented yet.

great days are ahead for property market...leading banks like icici bank.and hdfc bank have cut lending rates from 10% to 9.75% and 9.85% respectively...lending rates to be effective from april10 onwards....demand for residential properties to shoot up...
