The case was filed 8-9 months back in Court. and the builder is under pressure . Before that we were the only people who were under trouble & now he is also in trouble. Next date is 25-9-14. After the case was taken up by the court things have moved . Only glitch has been that the Court have provided him the relief from Imprisonment.

Those who are needy for the flat are fighting the case, and they are doing with a purpose. & They will get what they deserve first.

Hi All,

We are fighting the case and as of now only 8 of us. Although, the Builder has been granted bail by Hon'ble High Court, the builder has been asked, by hon'ble High Court, to appear on each and every date in the trial court.

We are standing strong and will fight till end. We know that the Judiciary has some corrupt Judges but not all are corrupt. We want this matter to reach Supreme Court as early as possible and the builder has already blessed us with so by filing Anticipatory Bail and Revision in a hurry.

This builder has willfully violated all laws of land and was confident that he would manage/manoeuvre everything in its favour.

Now, after filing of the case he keeps trying to negotiate and is trying his best to avoid being arrested/convicted.

To make things clear I am appending below the details you would require to understand the precess of Law:

Flow chart (Builder is taking advantage of - Buinder thinks so):
Trial Court/Sessions Court/High Court/Supreme Court

Delay Path usually adopted by the Accused:
Anticipatory Bail/Revision filed by the builder to delay trial.

Status:
Trial Cout: Case going strong with full avidence and statements from Concerned Authorities.

Sessions Court: Anticipatory Bail Rejected. Now has to deliver verdict on Revision Petition filed by Builder.

High Court: Anticipatory Bail Granted with conditions. No party approached as verdict on revision petition will decide course of action.

Supreme Court: Will approach when appropriate.

We need help in any form either strategic/legal/resource. Though, till date we are managing good and are supported by some for the cause.

Sincerely, request to all who are part of this society to come forward and be a part of this fight between common man and the corrupt.

This builder has no legal papers nor does he hold the title on land. Whatever, the builder showed us is fake/forged.

He has submitted unregistered MOU/Development Rights Agreement before Courts. Once this matter reaches Supreme Court the builder will face reality. We all know Supreme Court is dead against unreigstered docs.

Thanks
S.

Will publish everything, when appropriate, from daily orders/final orders to show you how things get manipulated during the course of court proceedings.

Needless to say, all we want is our dwelling units and we will fight till end for that. If we unite, even now, we will get what we deserve and we all will have an opportunity to live with people who never bend before wrong.
Thanks

Dear Sir,
If you see previous pages, you will know that it includes both. Era Divine Court is one and it includes both. low and high rise. ultimately both are constructed on the land that is deemed illegal and thus both are constructed without proper license.
Sorry to disappoint you. I can empathise with you and understand that you are a low rise flat owner and hope that some how your flat is delivered at the earliest without going through these hurdles.
Sorry
