PRANAYAM EDC increase

Hi All Puri Pranayam investors.

Today I have received a letter related to demand for additional EDC as per the revised rates(@ 125/- per sq ft.). If other people have received it please let me know what are we supposed to do? Is everybody paying this demand?

I have also recieved the letter. I was going through one forum of nehar par area where recently there was a meeting happened with Builder 7 investors in the presence of Huda people.
The takeaway for that meeting was to approach respective Builder by the investors to ask the calculations done by the builder to arrive at the respective EDC charges .

Like in pranyam's case we have been asked to pay @125 /sq feet.

And give a week's of time to get a revert from builder. In case the revert didnt came, investor can approach HUD office to get some solution.

Hi,

i have also received letter for paying additional EDC @ 125/ PSF. The last date is 5th nov 2011 (within 30 days from the date of letter). Ironically the web site shows EDC at Rs. 158/ PSF.

To me, the action lies as follows
1. Letter to Puri for calculation of Rs. 125 / PSF as additonal demand
2. Asking the copy of letter received from TCP and HUDA on the basis of which additional demand has been raised
3. Asking the proof of payment of EDC to HUDA and/ or TCP- This is not for Profit and total EDC paid to HUDA / TCP for the entire project.

So far there is no development in the vicinity and it will take 2-3 years. Meanwhile the interest accrued will be of HUDA/ TCP or builder and we will keep paying on EMI at higher rate of interest.

If someone has a better idea, please reply.

I have also received the demand notice for additional EDC at Rs.125/sqft. Since the last date for payment is 5th November and the hearing of the writ petition filed by GFWA is on 1st November, let us wait for the outcome. In the meantime let us formulate a joint reply as suggested by a poster.

I also have recieved a letter.. I will be asking the builder for calculations with justification for the asked amount @Rs 125.

Dear Davesh/T K Varshney/Vivek/ Seadog and SG007(can we have both of your names pl:) and other members of Prayanam,
All of us have received EDC letter and most agree that we should have a joint response/action, let us plan for a small meeting/teleconf amongst us between wed/thurs so that we can discuss our action plan.
Davesh has agreed to initiate this.We need to spread this to as many members as possible. Pl come up with info/ideas (as put up by SG007) so that we can take quick decisions.
Meanwhile, leave your ph no. either on this forum/text Davesh/me.

We must respond to Puri by this week, so it is in everyone's interest that we put combined efforts.

I have received a sample response letter from Ajay Yadav. We may use this as our united response to Puri. The letter may be modified acc to our needs.
Request all members to read and respond so that we send our reply in agreement.

Reg.: Your letter dtd 03.09.2011 Payment of increased External Development Charges (EDC)
Dear Sir,
Kindly refer to your letter /email dated 03.09.2011 on the captioned matter, vide which I have been asked to deposit the increased EDC amount by 05.10.2011.
In this regard, I would like to bring it to your notice that ‘Greater Faridabad Welfare Association’ (Regd.), a welfare association actively working in Greater Faridabad area for development of the said area, in which the undersigned is also a member, has filed a Writ Petition bearing No.14886 of 2011 before the Punjab & Haryana High Court, Chandigarh for quashing the HUDA notification dated 25.05.2011 vide which the External Development Charges (EDC) have been increased from retrospective.
The matter was listed on 06.09.2011 for further proceedings and after hearing the petitioner the Court posted the matter for 01.11.2011.However, upon hearing the plea of the petitioner that since there is no stay in the matter, the possession / registration of flats of the members of the petitioner association is put on hold by the builders for non-payment of increased EDC amount, the Ld. Judge gave strict verbal instructions to the State Government in the presence of their Counsel to ensure that no such coercive action be taken against such flat owners for non-payment of increased EDC amount.
In view of above, since the matter is sub-judice before the Hon’ble High Court, we request you to kindly defer the date of payment of said enhanced EDC amount till further and waive interest thereon, if any, till then. However, we would also like to assure you that we will pay the increased EDC amount without any demur, once the above Writ Petition is finally decided.
Also as a matter of good governance, I would like have the following clearances/documents/reply from your goodself:
1) The copy of the letter No. DGTCP/ACCTTS./2011/803 sent to your goodself by the government authority.
2) The detailed break-up of EDC Charges which you are charging at the rate of Rs 308/- psf. kindly substantiate your answer with documentary proofs.
In GFWA's subsequent meeting with HUDA Fariadad, Mr Ajeeti Balaji Joshi (HUDA Fbad) has categorical mentioned that it is mandotry for the builder to provide details of EDC calculation upon asking and should there be non cooperation, the matter can be reported.
Please take note that if no response is received from you on the subject (reply must for Point No. 1 & 2) within a period of 7 days from receiving this email/ letter, it will be presumed that you have considered my request to defer the date of payment of increased EDC amount and waived the interest thereon, if any, till further, as requested above.

Dear All Respected Pranayam Members
I have also received a notice from the builder to pay EDC @ Rs. 125/= per sq.ft of gross area.[latest by 5th november,2011]
At the time of booking I paid @ Rs.110/= per sq.ft.
We have to evolve a joint strategy to deal with the issue.
As stated by some members that the issue of EDC RISE is under consideration with Hon'ble Court ,therefore M/S Puri Builders must be intimated about it .
After the outcome of the Court judgement , an appropiate action can be taken .
In lieu of the aforementioned M/S Puri Builders have to issue amendment to their letter and also provide a breakdown of EDC Rise in case Hon'ble Court rejects the related petition for rise of EDC.

A gentle reminder about inputs/modification to the letter posted. I have not seen much activity within the group on this (not seen even 50 members in this forum). I am hoping that by tom we will work out our final response.If there is no response by weekend, I will go ahead and send my copy.
Friends, Our other priorities can be adjusted, our response can't, and we can not be complacent on this issue.This will go against our interest and we will continue sulking without doing anything.
I request, one & all to spread word around and lets us work together.

Dear Pranayam Members :
I find very few interact through GFWA website forum .It is not clear to me how many unit holders of Pranayam Complex are acquainted with this forum . Therefore the inference I can make is as under :
1. The majority of unit holders are unaware about this GFWA forum.
2. Some may not have access to GFWA Forum through internet due to lack of facility or other unknown reasons.
In lieu of the aforementioned we need to take an appropriate action ,and I suggest we must inform the builder to defer the implementation of EDC rise related letter until 30th December,2011 until the disposal of the related petition in the Court. Besides we must unhesitatingly ask builder to provide breakdown of the additional EDC rise , incase we are bound to pay if Court rejects the petition.
If you have any question ,please have no hesitation to ask.
