Dear GFWA Members,
Couldn't attend yesterday's meeting due to some personal urgency but wanted to share my view / opinion...
Currently we are struggling with Problems at 2 fronts:
1. Delay in Development of external Infrastructure & Increase in EDC by HUDA - Even if Builders are giving possession of the flats, we the residents are not in a position to shift there today or in near future due to lack of basic infrastructure in place. On top of all this HUDA is asking for extra money in terms of increased EDC which is giving us lot of pain.
Initiative by GFWA members is appreciable in terms of filing writ petition against the government to put a stay on the increased EDC and also putting pressure on HUDA to fasten the development work in Neharpar area. With the given circumstances and progress in last 5 years, Court is the only hope which can push the Government agencies to work for public interest and good part is this is the one area where both the residents and Builders have common interest and I guess Builders are also putting pressure on HUDA to get this issue addressed. More or less we will have to wait for Court's decision on this.
In my opinion, we should hold the EDC payment till next hearing and basis on the outcome of next hearing we will take a joint call on this.
2. Delay by the Builders - This problem also need attention from the members. In case of External Infra development, we are having common problem and hence with a single writ with less complexity in nature can serve the purpose but Problems created by Builders are different in nature and individual members are faing the issues at different timeframes. Some of the Key problems which we should jointly think of fighting in my opinion are:
a. Delay in Delivery of flats
b. Ensuring Builders are adhering to the Penalty clause as per the agreement
c. Ensuring Builders are giving possession to the individual flats owners after completing the common facilities like shop, Parks, parking, Electricity, club etc as per the agreement
d. Ensuring the final delivery by the builders are in-line with original commitments
Above stated problems are not new and Association has really put-in good amount of efforts in fighting these issues with Builders and HUDA but unfortunately we haven't progressed much on these except gaining some media attention.
In my opinion, we must look for similar legal initiative for this issue as well b'coz HUDA officials are not acting on it and in fact they are using our complaints for their own advantage. If we can jointly take a call and file a common case (or even we can think of PIL but I am not sure of technicalities) to get these point addressed this may help all of us. I know legal process is going to take it's own sweet time but at the same time I feel our issues / battle will be long drawn one and it's not going to finish in next 2-3 years. GFWA members can decide the amount for each members and I hope all the members will go by the Association decision.
