Thanks for a lightening fast reply and the letter to be written to the builder. I've my flat in Omaxe and the RTI you have will help us in case we face any difficulty and if possible request you to hunt the question and share the same.

Dear @smv95,

all those documents were already provided to all members by GFWA in the month of April/May.

These documents were collected by GFWA team from CHD and same were posted on GFWA exclusive section.

I think you missed those posts.

And regarding the EDC-Non Profit, that was filed by some GGN person.

So, pls let me know wht exactly do you want? I will try to help u.

I have received today at 12:00noon demand of increased EDC for my unit A1 408 high rise to pay Rs 155775 and time given to do so is 25 AUG 2012.

I received enhanced EDC demand yesterday for my flat in divine court high rise. I have sent the following email to Era with CC to HUDA officials. Request all members to force Era to provide EDC calculation before making the payment.

Dear Mr. Aggarwal,

Please refer to your demand letter no. ------------, dated ------------- for payment of enhanced EDC against Unit No. ------in Era Divine Court, Sector-76, Faridabad. You have demanded enhanced EDC @ Rs.155/- per sq.ft. without any detailed calculation of the same.

We have done a preliminary EDC calculation, which shows that the EDC demended by you is arbitrary and whithout any basis. The calculation is given below –

(A) Total Land : 26.619 Acre (Era Divine Court)
(B) Rate for Group Housing @ Rs. 232.84 lac per acre (as per DTCP Notification)
AxB= Rs. 61.97 crore; EDC to be paid to Govt. by Era Landmarks Ltd.

(i) Total No. of Low Rise Flats (250 Yard) : 272 x area 1225 sqft per flat=333200 sqft
Total No. of Low Rise Flats (180 yard) : 584 x area 890 sqft per flat= 519760 sqft
Total Area of Low Rise Flats =852260 sq ft (250 yard+180 yard flats)
Rate at which EDC taken earlier is Rs. 180
Total EDC : 852260x180= Rs. 15,34,06800 (15.34 crore) (already taken from us)

(ii) Total No of High Rise Flats in tower A1&A2 : 352 x area 1005 sqft per flat=353760 sqft
Total No of High Rise Flats in tower B1&B2 : 352 x area 1305 sqft per flat=459360 sqft
Total No of High Rise Flats in tower C : 110 x area 1625 sqft per flat= 178750 sqft
Total No of High Rise Flats in tower D1&D2 : 220 x area1850 sqft per flat= 407000 sqft
Total Area of High Rise Flats= 1398870 sqft (adding area of all towers),
Rate at which EDC taken earlier is Rs. 180
Total EDC : 1398870x180 = Rs. 25,17,96,600 (25.17 crore), already collected

Total EDC collected for Low Rise and High Floors= Rs. 40,52,03,400 (40.52 crore)
Total area of flats (Low and High Rise) is =2251130 sqft.

Remaining EDC to be given to Govt. : Rs. 61.97 crore- Rs. 40.52 crore = Rs. 21.45 (rounded) crore which translates into enhanced EDC of Rs.95/sq.ft.
Present demand - EDC @ Rs.155 x 2251130sq.ft. = Rs. 34,89,25,150/- (35.89 crore)

This calculation does not include EWS Fltas, Schools, Nursery, Dispensary, crèche, club etc. If we take into account area of all these the enhanced EDC will be much less than Rs.95/- per sq.ft.

Era Landmarks is required to Pay to Govt. Rs.21.45 crore enhanced EDC and demanding 35.89 crore from flat owners. This is criminal breach of trust and day light robbery. The enhanced EDC should be less than Rs.95/sq.ft.

You are requested to provide the detailed calculation by 14th of August, 2012 to enable me to make timely payment. I am not liable to pay the enhanced EDC until and unless a detailed calculation is provided to justify the demand.

Era Landmarks people are not providing the calculation for Enhanced EDC ,because they are charging the raised EDC of those Units which are still unsold from those ,who have already booked their units.
Because the EDC has to be paid for the whole project.

Which is nothing but cheating. When the unsold units will be sold then again they will charge the EDC from those buyers.

Today there was a meeting of investors of mostly low rise unit and the matter was regarding increased EDC, non payment of penalty against delayed posesion,Inferior quality of material used for construction and few other issues.
But most of the discussion was relating to Enhanced EDC demand.
It was decided to go for legal notice/Arbitration against the builder to provide calculation for raised EDC and to provide reasonable time to pay the correct EDC . Legal consultation regarding this issue will be taken either today or tomorow and final decision will be conveyed to all members.Al members present their decided not to pay the Enhanced EDC until the legal option to be explored
Also the option of going to consumer court for penalty and poor quality of construction will be taken soon.
But i think that some of the low rise investors have already filed a consumer case against the builder some time back.
Let us see what is the effect of this legal notice/Arbitration .
But my request to all members of High rise is to send email to era as depicted previous post

I searched Licences of Almost all builders in Greater Faridabad Their is no name of Era Landmarks Ltd. and instead M/s countrywide Promoters Ltd. owns the licence for the Group housing in Sector 76.

Finally i got his licence

“License No. 1042 to 1061 of 2006 dated 25.07.2006. Type of colony and its areas : Group Housing Colony on areas measuring 26.619 acres in Phase-I out of Total land area measuring 55.724 acres. Name of the contractor to whom License has been given : Group Housing is being developed by M/S Era Landmarks Ltd. Vide Development Right Agreement entered with M/S Countrywide Promoters Ltd. & others, Number and date of approval Building plan Memo No. 192/JD(DK)/2010/15759”.

THE DTCP website confirms the actual status of license renewal as of 30th of June 12.

I have confirmed the status in my previous post with valid upto date as 24/07/2011 for the licenses mentioned by you and as per information on the dtcp website.

Please file RTI to get more information.
