Yes, F tower flat owners have been offered possession letters for fitout purposes only. I have been receiving calls almost daily from F flat owners.

Clearly exposes builder cheating, loot & extortion and even courage to do so. He is
offering possession for fit out on back of licence that expired 4 years back and his
application for renewals were rejected due to non-payment of EDC which he collected
from all of us.

I visited Piyush heights site on 22nd after receiving the so called possession fit out letter dtd 5th dec.
In 'F' tower they finished the last work of wooden floor in master bed room in some towers; soon it complete for others in same tower.

So far they have not received the HV electricity from local electricity board. One DG is run for time being.

Although gas pipeline was optional but they have provided in all flats.

An amount of appx Rs. 2.5 lacs have imposed as EEC, FFC, Phone & wi-fi; but no work seen for EEC, FFC and phone at site.

The progress on club, park area is slow and looks distant getting completed in near future. [pic uploaded]

With above status overall, can the builder ask for possession payment (that to escalated one) with a paying deadline of 5th Jan.

Builder has no right to offer possession if his licence is expired. Home buyers are risking their lives as well as their spouses and children if they accept possession without any approvals from Govt. Also, no such term of "Possession for fitout purpose only" exists in Builder-Buyer agreement.

Buyers who have got possession can refer this attached letter for sending a fitting reply to Piyush Group. It covers all points. Piped Gas rollback letter is at resources/file/1101

Dear Dheerajji,

Possession letter has been sent to the flat owners only to convey that Piyush has started offering possession from Dec'12 as earlier communicated by them.
It is nothing , but only a eyewash & only to extract the money from the buyers.
Probably they have not received any Completion Certificate so far & above all at present condition they are not eligible to get Completion Certificate from any Competent authority.
It will be better from our part at this point of time to sit face to face with Piyush Management & seek clarification for all points.
As a group are we ready to meet them & have a discussion?

With regards to letter posted above, there is a minor correction. Service Tax notification date should be July 2010 instead of July 2012.

@dube_s, Piyush Management does not meet with buyers. If many buyers collect at their office, they call police and also some buyers told me that they have now hired even bouncers. On top of all, they level false criminal allegations against home buyers with the police station that is opposite to their head office if someone goes to Chandigarh for collecting RTI replies and revealing truth about their illegal actions. So, no way you can discuss them. Piyush Management has made up their minds to collect money using any means whether illegal or legal and they don't listen to buyers at all. This is clear in their employees approach that if you go to submit any letter or documents at their office, employees simply refuse flatly to give any receiving whatsoever hence even more harrasment and exploitation for home buyers.

Hi,

I hold a flat in G tower in Piyush Heights, Faridabad. Just today I received a letter from them saying they were offering possession but there were some formalities which need to be completed first.

Shockingly, instead of demanding 2.25 LACS as the last installment, they are demanding 7.75 Lacs- ~2.5 Lacs for providing wi-fi, telephone etc; ~1.5 Lacs extra for an increase in area; and many such other frivolous charges such as meter connection- 30K, gas connection- 20K etc.

Can someone please provide an update on the status of the court proceedings for the case filed against them in the Punjab & Haryana HC?

So, now Piyush Group has started distributing fitout letters for G tower. @Mukesh, please note that these are not possession letters but letters for fitout. These letters are invented by Piyush Group to extort money from flat owners who put their life time savings for buying their 'dream' home. Please refer to previous posts in this thread to understand. Give a fitting reply to Piyush Group by using letter at resources/file/1449 . Also, note that there is no case against Piyush Group in High Court of Chandigarh. If you want yourself not to be looted, then please give your statement in support of FIR No. 214 of 2012 lodged by group of buyers against Directors cum Owners of Piyush Group. It is being investigated by 5th Floor,Economic Offense Wing, Mini Secretariat, Sector 12, Chandigarh. Please bring your copy of Possession letter for fit out use only, Builder Buyer Agreement, Allotment letter, unfair demand letters for EDC, podium etc., communications with Piyush. Before going there, please talk with Investigating officer - Sub Inspector Anup Singh, Mobile 9911826577 to check his availability.

Dear Ravi, buyers have power. Builders are because of buyers. Almost all the money in Real Estate Industry which is 2nd largest in India comes from buyers. Unfortunately, even after putting our life time savings for buying our 'dream' home, builder wants even blood and flesh extracted from our bodies and using illegal tactics of demanding money. We should take help of legal system and give our statements in front of Police and Courts for stopping exploitation and action taken against builder.
