how can piyush ask for fit to possesion i had visited the flat last sunday and even electrical wiring / sanitary work nothing is done what does he mean by fit to possesion.

Today was a hugely successful day with Piyush and other housing soceities members joining in under GFWA for making sure that we start new year with good deed. Administration has woken up and initiated action against Piyush Group for possession. Please find attached letter that has to be sent to builder for reply to possession letter. Senior Town Planner clearly mentions that Piyush licence is expired and also he has not obtained Occupancy Certificate. He recommends to Director, Town and Country Planning that Piyush Group to be restrained from offering illegal possession and collecting money from buyers. This can be used by all buyers who have got possession fit out letters to be sent to builder.

Sir, Good effort has been made which is appreciable but we should not forget that all builders have been united through their association and now they will try to manage the administration and other agencies which is quite easy to manage in our country now a days. we must approach to media too so that the matter can be highlighted in public too to expose the builder.

Local Faridabad media is already in loop. Please see news coverage by Navbharat Times. Faridabad administration is active. Need of the hour is to give statement in support of FIR No. 214 of 2012 as indicated in previous posts.

बिल्डर के खिलाफ एक और शिकायत

एनबीटी न्यूज ॥ सेक्टर 12 : नहर पार ग्रेटर फरीदाबाद के एक बिल्डर के खिलाफ नई शिकायत लेकर मंगलवार को ग्रेटर फरीदाबाद वेलफेयर असोसिएशन के लोग डीसी बलराज सिंह से मिले। लोगों की शिकायत है कि बिल्डर ने टाउन एंड कंट्री प्लानिंग डिपार्टमेंट से अभी तक ऑक्यूपेशन सर्टिफिकेट नहीं लिया है और पजेशन देने की लिए हमें नोटिस देना शुरू कर दिया है। इसके लिए 8 से 10 लाख रुपये की डिमांड की जा रही है। डीसी ने संबंधित अधिकारियों को जांच के निर्देश दिए हैं। ग्रेटर फरीदाबाद वेलफेयर असोसिएशन के अजय यादव, उमेश प्रभाकर, सीमा जोशी, धीरज जैन ने बताया कि हमसे ईडीसी लेने के बाद भी बिल्डर ने टाउन एंड कंट्री प्लानिंग डिपार्टमेंट के पास जमा नहीं कराया, जिसके चलते बिल्डर का लाइसेंस रद्द कर दिया गया था। लाइसेंस रद्द होने के चलते उसे ऑक्यूपेशन सर्टिफिकेट नहीं मिला है। जब तक बिल्डर को ऑक्यूपेशन सर्टिफिकेट नहीं मिल जाता, तब तक उसे हम लोगों को पजेशन नहीं देना चाहिए।

फरीदाबाद। ग्रेटर फरीदाबाद के एक बिल्डर के खिलाफ लोग लामबंद हो गए हैं। मंगलवार को लोगों ने बिल्डर की मनमानी के खिलाफ सुबूतों के साथ उपायुक्त को ज्ञापन सौंपा।
ग्रेटर फरीदाबाद वेलफेयर एसोसिएशन के पदाधिकारियाें के नेतृत्व में निवासी मंगलवार को उपायुक्त बलराज सिंह मोर से मिलने पहुंचे। ग्रेफ आरडब्ल्यूए के महासचिव अजय यादव ने कहा कि नहर पार एक बडे़ बिल्डर का लाइसेंस 2009 को समाप्त हो गया था, ऐसे में यह बिल्डर मनमानी करते हुए एरिया में लगातार निर्माण कार्य करने में जुटा है। इस एरिया में फ्लैट का पजेशन लेटर भी अब बिल्डर 10 लाख रुपये लेने के बाद दे रहा है, जोकि सरासर गलत है।
आरडब्ल्यूए सदस्य उमेश प्रभाकर, सीमा जोशी और धीरज जैन ने बताया कि बिल्डर ने काफी पहले हमसे ईडीसी (एक्सटर्नल डिवेलपमेंट चार्ज) ले लिया था, लेकिन बिल्डर ने टाउन एंड कंट्री प्लानिंग विभाग के पास जमा नहीं कराया। इसके चलते 2009 में संबंधित बिल्डर का लाइसेंस रद्द कर दिया गया था। लाइसेंस रद्द होने के कारण उसे अभी तक ऑक्यूपेशन सर्टिफिकेट नहीं मिला है। जब तक बिल्डर को ऑक्यूपेशन सर्टिफिकेट नहीं मिल जाता, तब तक उसे लोगों को पजेशन नहीं देना चाहिए, लेकिन बिल्डर लोगों को पजेशन देने के नोटिस दे रहा है। डीसी बलराज सिंह ने इस विषय में संबंधित अधिकारियों को निर्देश दिए हैं कि इस पूरे मामले की जांच की जाए और जल्द से जल्द रिपोर्ट तैयार करें। उसके बाद ही आगे की कार्रवाई की जाएगी।

Chronology to Occupation Certificate (OC)
Valid License: If expired, re-validate by paying requisite fee and payment of EDC by builder
Minimum 25% of the units should be complete in all respect.
EWS should be completed
Occupation certificate

In case of piyush, license expired in 2009, builder took EDC at enhanced rates from buyers but did not pay to government. Piyush can't apply for OC because valid license is prerequisite and for license re-validation, EDC along with fee should be paid.

Sir, Everything is going in right direction but still we have failed to involve all buyers of Piyush Project. There must be proper compaining against builder through media/electronic media. Media is the right place to highlight such loots and offences. The administration also will react with solid action if the things reaches to media i.e. electronic media too.

Subject: Request for immediate withdrawal of your demand letter offering possession for fit out purpose only dated 29th Dec, 2012 received by me on 31st Dec, 2012 (Ref# 3403)(enclosed)

Sir,
Greetings and Happy New Year 2013! With respect to subject matter above, I request you to withdraw demand letter of about Rs 10 lakhs immediately since it is in violation of laws of land and agreement executed by us with Piyush Buildwell India Ltd. (hereinafter referred to as Company). Please note the following:

1. Fit out purpose is not defined anywhere in agreement executed with Company. Possession is the term that is stated in agreement.
2. Possession of flat can only be given to us once Company gets the Occupancy Certificate for tower from Department of Town and Country Planning (DTCP) and has a valid licence
3. As per communication attached (enclosed) from Senior Town Planner, Faridabad to Director General, Town and country Planning, Company neither has valid licence nor has occupancy certificate. Additionally, Company has been called for hearing on 28th Jan, 2013 due to lapses. Senior Town Planner has also advised that Company be restrained from offering possession.

In view of the above, I request you to issue demand withdrawal letter immediately. Please acknowledge this letter. In case, Company does not take necessary action, appropriate legal action will be taken as per laws of land against Company.

Do post the response from builder, if you receive any. Personally speaking I doubt builder will respond.

I have sent a letter by mail and speed post to Piyush Buildwell seeking clarification on highlighted points. If builder would not respond in writing then what should be the next course of action.
