They have a wedding in the family in May so everything is expected to move after 1st week of May. The internal transfers in Piyush Heights are also closed right now.

National Consumer Commission passed order today clarifying "status quo" order given on project on January 29, 2013. NCDRC clarified that stay is not applicable for construction activities and handing over possession to buyers. But, stay continues on illegal demands. At time of handing over possession, builder can't demand any payment on account of:

1. Open Car parking
2. Enhanced EDC.
3. Additional Charges.
4. Sale of Podium
5. Cooking Gas Charges.
6. Increased Super Area.

Also, stay continues on sale of common area and construction of school etc. on green area.
So, builder has to handover possession without these demands. Congratulations! everyone as this order is applicable for all 1100 flat buyers. Builder lawyers made every attempt to make this order applicable only for 53 members involved in this case, but they failed. It is the result of effort and dedication of 200+ members in Piyush buyers Yahoo! group and sacrifices of front line members.

Yes, you don't have to pay nothing additional, not even for super area. Super area increase is illegal and just was the way for builder to churn money.

We have seen the progress of work in Piyush Heights. It is impossible to hand over the project even 3 towers F,G & H with in 3 months time. There are still many pending works to be done by builder in these 3 towers too. The contractors are not working in full swing and even there is shortage of materials at work site. Flooring, Aluminium Shuttering, Plumbing, Ceiling and colour washing works are still pending. Builder is not in intention to hand over the flats with in stipulated time. He only trying to applying for OC to authority in parts and then he would represent in the court that he is trying his level best, since in court order this liberty was provided to builder. So in conclusion we are not getting the flats with in 2 to 3 months and builder may delay it further.

Dear All,

The NCRDC / The Court rejected all builders' arguments and confirmed the Status Quo Interim Order and further clarified that "the Status Quo exists / remains and that it is clarified to the extend that the construction of flats may continue & that the possession of the flats be given".

Now let to me clarify further that order dt. 15.4.2013 / clarification says that the builder has to complete the flats & give possession of the flats without the illegal demands contested in the petition and restricts them to sell Open Car Parking & restricts them of illegal construction mentioned in our petition.

We are yet to get a certified Court Order Dt. 15.4.2013. Shall laod it no sooner we get it. More clarity we would have once we read the same.

But all depends how the builder interprets the order & acts / reacts / goes to jail again. :lol:

Hi All,

Thanks for the updates, earlier we heard that the builder is out on conditional bail, as he has to provide possession to the buyers within 3 months, but still the condition is the same. does any one has a real picture of the project, that when the possession is expected to start.

Furthermore, Dheeraj your efforts are highly appreciated, to support all the buyers of Piyush Group.

I just got over phone with a friend of mine. The progress is not happening at the speed it should. Infact no progress at all.I have no clue what's happening.... when would we actually see some progress.... I have nothing else but this on my mind every day.... We have already put in so much of our hardearned money in this project

I think the members who have filled the case should show the court, the number of workers actually working in the project even after the court gave them 3 months time to complete the project.

looks like they have already planned something about what should do after 3 months conditional bail. they don't have intention to give possession coming soon. don't know how much time they actually need to complete this project:(

Piyush Group should have to give possession very soon without illegal demands otherwise they will again face buyers anger.
