I have been told that Era Divine floors will offer possession by December 2013, however some people told me that first possession date was June 2011 and still as of now it's not clear if Era will fulfill it's promise this time or not?
I am just confused if i have made a mistake by buying unit in Era Divine or will it deliver some good option to live after some time say 1 or 2 years :huh: . I have invested all my money in this and these negative vibes are confusing and scaring me.

Could anyone, who knows about prospects of Greater Faridabad and in particular Era Divine Floors, please let me know about the future of Era Divine?

India, April 28 -- While the Brihanmumbai Municipal Corporation readies to demolish the illegal floors of seven buildings in Campa Cola compound in Worli and residents continue to make last-ditch attempts to prevent it, a larger question remains unanswered - who is responsible for the mess that 140 families have found themselves in?
"When we purchased the flats, the builders falsely made us believe that the permissions were in the process of being cleared. If the builder defaulted on the permissions, why didn't the BMC take any serious action against the builders?" said Ajay Mehta, whose 10th floor flat is on the BMC's demolition list.
However, many, including civic officials, believe that the residents were complacent about the irregularities, a fact confirmed by the residents' application for regularising the illegalities only in 2005, 17 years after the buildings were constructed.
Civic chief Sitaram Kunte claimed that local officers regularly issued notices to builders, but they sought stay orders and went on to add illegal floors.
"The notices were issued to the builders even when they were constructing the buildings, pointing out violation of the permissible limit. However, several stay orders were acquired from court during the last so many years that the work continued," said Kunte.
Residents, on their part, moved into their flats in the seven buildings without demanding the occupation certificates and verifying the developers' documents.
While residents claimed that they had applied for regularisation in 2005, the prospect of getting it was squashed as they had inappropriately applied for it through the Development Control Regulation of 1991, they said.
"We approached the BMC to understand the basis of the demolition notices, but we were refused a hearing," said resident Rohit Malhotra.
Kunte however said that there was no negligence on part of the BMC authorities.

One member from Era RWA Mr Ashish Dua had asked about Building plan approval ,License and host of other inquiries about this project via RTI from SPIO, DTCP Chandigarh,
He got a partial response fro SPIO .

This is just a partial response and he is in the process of getting much more information about this project from RTI.

This is the reality of Era divine court project and this fraud company that is promising possession of home to all of us , they do not have license in there name and still collect money in in name of EDC by showing Govt Notification , and is openly Violating the laws of the land.

Its Directors should be behind bars for cheating common public.

Thanks Naveen for your post. It's really scary that ERA is blatantly selling flats for which it doesn't even have a license in it's name. I'm also invested in ERA as a end user. What could be the implications of this? Do we have to worry about our flat allotment?

Can we take any legal action against ERA to safeguard ourselves?

As per Finance Bill 2013, the stamp duty value shall be calculated based on circle rate as on date of agreement and not based on date of registration. Here is the text from Finance Bill 2013. Please advice about the stamp duty value for Neharpar area.

The Bill proposes to provide that, where the date of the agreement fixing the amount of consideration for the transfer of the immovable property and the date of registration is not the same; the stamp duty value may be taken as on the date of the agreement instead of that on the date of registration. This exception shall, however, apply only in a case where the amount of consideration or part thereof, has been paid by any mode other than cash on or before the date of the agreement fixing the amount of consideration for the transfer of such immovable property.

Pls note that as per Finance Bill, 2013, (which is passed on 30th Apr'13), the below clause only applicable from 1-April-2014 (Moreover Stamp Duty Structure can be decided by State Government, so it is upto State Government, whether they adopt this clause completely or not/or part of it)


After section 43C of the Income-tax Act, the following section shall be inserted with effect from the
1st day of April, 2014, namely:—
“43CA. (1) Where the consideration received or accruing as a result of the transfer by an assessee of an asset (other than a capital asset), being land or building or both, is less than the value adopted or assessed or assessable by any authority of a State Government for the purpose of payment of
stamp duty in respect of such transfer, the value so adopted or assessed or assessable shall, for the
purposes of computing profits and gains from transfer of such asset, be deemed to be the full value
of the consideration received or accruing as a result of such transfer.
(2) The provisions of sub-section (2) and sub-section (3) of section 50C shall, so far as may be,
apply in relation to determination of the value adopted or assessed or assessable under
sub-section (1).
(3) Where the date of agreement fixing the value of consideration for transfer of the asset and the
date of registration of such transfer of asset are not the same, the value referred to in sub-section (1)
may be taken as the value assessable by any authority of a State Government for the purpose of
payment of stamp duty in respect of such transfer on the date of the agreement.
(4) The provisions of sub-section (3) shall apply only in a case where the amount of consideration
or a part thereof has been received by any mode other than cash on or before the date of agreement
for transfer of the asset.”.

नहर पार डिवेलपमेंट कर रहीं बिल्डर कंपनियों की मनमानी थम नहीं रही है। मंगलवार को एक बार फिर नहर पार हाउसिंग प्रोजेक्ट डिवेलप कर रही बिल्डर कंपनी के खिलाफ लोगों ने सीनियर टाउन प्लानर, डीसी और पुलिस कमिश्नर को शिकायत दी। लोगों का कहना है कि त्रिवेणी बिल्डर्स कंपनी ने कई साल पहले लोगों से लाखों रुपये लिए, लेकिन आज तक उन्हें फ्लैट नहीं मिले। लोगों ने अधिकारियों से मांग की है कि या तो बिल्डर का लाइसेंस रद्द कर इस प्रोजेक्ट को सरकार टेकओवर कर ले या फिर उनके पैसे वापस दिए जाएं।
त्रिवेणी फरीदाबाद अलॉटी असोसिएशन के नेतृत्व में मंगलवार को दर्जनों लोग सेक्टर-12 के टाउन पार्क में इकट्ठा हुए। यहां से लोगों ने सेक्टर-12 स्थित सीनियर टाउन प्लानर के ऑफिस तक जुलूस निकाला और एसटीपी को बिल्डर के खिलाफ शिकायत दी। मौके पर असोसिएशन के प्रधान सौरभ और जरनल सेक्रेटरी बी. के. जैन ने बताया कि यह बिल्डर ग्रुप ग्रेटर फरीदाबाद सेक्टर-78 और 89 में हाउसिंग प्रोजेक्ट डिवेलप कर रहा है। बिल्डर ने यहां पर 6 लाइसेंस लिए हुए हैं, जिससे वह यहां पर दो प्रोजेक्ट पर काम कर रहा है। इस कंपनी ने 2006 में फ्लैटों की बुकिंग शुरू की थी। लगभग 3 हजार फ्लैट बुक किए जा चुके हैं। उस समय बिल्डर ने कहा था कि 2011 में पजेशन दे दिया जाएगा। बिल्डर ईडीसी और अन्य कई तरह के चार्ज लगातार ले रहा है।
लोगों का आरोप है कि लोगों से लिए हुए पैसे से बिल्डर प्रोजेक्ट डिवेलप नहीं कर रहा है, बल्कि पैसे को दूसरे कामों पर खर्च कर रहा है। बिल्डर ने मौके पर कुछ फ्लैट डिवेलप किए हैं, जिन्हें दिखा कर वह पैसे ठगने में लगा है। बिल्डर के खिलाफ लोग कई बार पुलिस में शिकायत दे चुके हैं, कई बार टाउन एंड कंट्री प्लानिंग के अधिकारियों से बातचीत की जा चुकी है, लेकिन अभी तक कोई कार्रवाई नहीं हो पाई है। शिकायत देने के बाद भी पुलिस बिल्डर के खिलाफ एफआईआर दर्ज नहीं करती और न ही कोई एक्शन लिया जाता है। लोगों का कहना है कि उन्होंने अपनी बरसों की कमाई इन फ्लैटों के लिए इनवेस्ट कर दी है, लेकिन अब बिल्डर फ्लैट नहीं देने की बात कह रहा है। लोगों ने मांग रखी कि बिल्डर का लाइसेंस रद्द कर दिया जाए और लोगों का पैसा वापस दिलाया जाए, या फिर सरकार प्रोजेक्ट को टेकओवर कर लोगों को उनका आशियाना दिलाए।
एसटीपी गीता प्रकाश ने लोगों को आश्वासन दिया कि वह उनकी बात को डायरेक्टर ( टाउन एंड कंट्री प्लानिंग )के सामने रखेंगी और उन्हें न्याय दिलाने में मदद करेंगी। डीसी बलराज सिंह ने कहा कि इस बिल्डर के खिलाफपहले भी शिकायतें आती रही हैं। जल्द ही इसके खिलाफ कार्रवाई की जाएगी। वहीं पुलिस कमिश्नर अरसिंदरसिंह चावला ने लोगों से कहा कि वे बिल्डर के खिलाफ सारे सबूत उनके पास जमा कराएं , बिल्डर के खिलाफजल्द ही कानूनी कार्रवाई की जाएगी। उधर , इस बारे में जब बिल्डर कंपनी का पक्ष जानने के लिए उसकेप्रतिनिधि से संपर्क करने की कोशिश की गई , लेकिन संपर्क नहीं हो सका।

नयी दिल्ली।। रीयल एस्टेट क्षेत्र के नियमन के लिए प्रस्तावित विधेयक में विकास प्राधिकरणों के लिए कारपेट एरिया के आधार पर भवन योजना को मंजूरी देने की अनिवार्यता होगी। एक उच्च सरकारी अधिकारी ने यह जानकारी दी।

सरकार रीयल एस्टेट (नियमन एवं विकास) बिल को संसद के अगले सेशन में पेश करेगी।
आवास क्षेत्र पर एसोचैम के एक सम्मेलन को संबोधित करते हुए आवास एवं शहरी गरीबी उन्मूलन मंत्रालय के सचिव अरुण कुमार मिश्रा ने कहा कि बिल में केवल कारपेट एरिया को मान्यता दी जाएगी।

एसोचैम के एक बयान में मिश्रा के हवाले से कहा गया, 'स्थानीय निकायों एवं विकास प्राधिकरणों को कारपेट एरिया के आधार पर नक्शा पास करना होगा और इसकी अनिवार्यता होगी। सरकार सुपर एरिया या बिल्ट-अप एरिया जैसे अन्य मानकों को मान्यता नहीं देगी।'

राष्ट्रीय राजधानी क्षेत्र (एनसीआर) में रीयल एस्टेट डेवलपर सुपर एरिया के आधार पर मकानों की बिक्री करते हैं और सुपर एरिया में बिल्ट-अप एरिया के साथ लिफ्ट, गलियारा, क्लब हाउस और सीढ़ियां जैसी आम सुविधाओं की जगह शामिल होती है। सुपर एरिया आमतौर पर बिल्ट-अप एरिया से करीब 25 प्रतिशत अधिक होता है।

Many era divine court(low Floor) members who have not paid EEDC till now , have received threatening letter that if they do not pay the EEDC than the contact will be cancelled, i.e. the flat will be cancelled.
This is despite the clearcut stay order by High court on this issue. And also the fact that this builder does not hold any license in its name from DTCP to demand EDC/EEDC or any money whatsoever in name of sale of Flat.

Naveen ji,

The same can be taken care of while in the complaint filed in the office of EOW.
The order pertaining to EEDC may not prolong for a longer period as the Government is under tremendous pressure and duress and is dying to get the stay vacated or the matter disposed. Wait until 08/05/2013. I assume things may get cleared on 08/05/2013.

Hi All,

One of my friend who booked his flat in Ansal has received a demand letter for enhanced EDC (Rs. 2 Lacs). Another who booked in BPTP recd the same kind of demand letter.

Has anyone who has unit in Era Divine received such kind of demand for further EDC?
