builder wont get occupation certificate from authorities until EWS flats are built

Dheeraj,

Do we have any update from the members who filled the case earlier about the status based on the last hearing. I fail to understand why the High Court is not taking any action against the defaulters.The members who filled the case has they withdrawn the case or are they satisfied with the decision because the group has applied for Occupancy for the 3 towers. Would the remain members have to file the case together again for judgement to happen now.? Are the members who filled the case planning to request the high court for cancellation of bail from the High Court?

Yes, we are filing for bail cancellation application for directors of Piyush Group. Please note High Court is closed in June and our application hearing will be in July. All buyers should unite and defeat loot, cheating and forgey done by these builders. EWS flats completion is proportionate to progress of project and there is no restriction for Piyush Group that prevents them from offering possession

Dheeraji,

Its good news but what about their bail cancellation. Since our prime motto is to get possession with paying extra demands to builder. To achieve the goal we have to pressurise builder in all the ways and one of the way is " getting bail cancelled by honourable court". Kindly post update if anybody aware with that.

Dear All,

This is the time not to keep quite. We must in touch everyday with the builder as well as authorities pursuing for possession. The Piyush officials are telling another 2 months for Tower F,G & H and every time they are increasing the target date of possession. The authority is not issuing OC due to non completion of EWS flats. This the clear failure of builder on his part and it is his duty to get occupation certificate in time duly satisfying all authorities. Matter must be produced in front of honourable court immediately to get the action taken against builder.

All,

I agree the court is going to open up in the month of July now and we all might be doing everything possible. I wanted to understand that if the work gets completed some how with pressure from the Court and all , does some one check the quality of work done inside the house ? Last time when i visited i was very much disappointed with their work.

Can we not request the Court to appoint a body to keep a check on the Quality, timely possession and no extra demand being requested to the customers. The increase cost in terms of registrations would add just add more pressure on the middle class. I have already done everything to get my dream house and i have no clue how will i pay these demands that would come from the builder.

Mr. Singh, EWS flats may have nothing to do with occuptation certificate (OC) of first 3 towers (EWS flats completion is considered proportionate to completion of project).

@dp2013, matters that you have raised are related to Consumer Rights. For that, you have to approach Consumer Forum.

Hi All

I received RTI reply today for Occupation Certificate of Piyush. (RTI reply is dated 22 May, 13??, but it was actually dated and sent 16th June after my strong e-mail to Shri Dhillon). Anyways, I am having another RTI appeal pending. If required, I will also go to Chandigarh for the same for getting more information. Following are the questions that was asked by me and attached is RTI reply.

Please provide following information under Right to information (RTI) Act 2005 for project Piyush Heights developed by Piyush Buildwell India Ltd. in Sector 89, Faridabad (Licenses 161 and 162 of 2007):

Copy of applications with supporting documents submitted by colonizer if any for getting Occupation Certificate.
Copy of Occupation Certificate(s) given by department to colonizer if any.
Copy of replies if any given to colonizer by department with respect to colonizer’s applications for occupation certificate
Reasons for not issuing occupation certificate(s) to colonizer if any.

Date of application for OC 2nd April 13,
Date of RTI reply May 22nd May 13,

Builder bailed in March I Guess

It takes minimum 3 months for OC after application date for biggies like DLF. That too if no defect is found. Here DGTCP will ascertain everything to save itself from any further embarrassment. Keep the pressure up and success will surely come.

Fail to understand that even after such delays, why only three towers have been applied for. What is the fault of other buyers for other towers.

Can a buyer from another tower object to issue of OC by DGTCP for few towers?

Builder is able to complete only these 3 towers and that is why he has applied only for these. I believe he can't apply OC for towers that are not complete.

Just talked with CC of Piyush and they are saying that they will receive OC for the same within a month. Regarding final demand amount, she refused to say anything.

Dear All,

How are we going to tackle the penalty on the delay in possession(Some 5k per month). While getting possession and asking for the final amount should we also deduct the penalty amount.

Also should the penalty amount now be calculated on the increased area (like balconies esp for 1st floor).
