dear friends,
We must rush to builder customer care physically or by means of phone calls daily to pressurise the builder for offer of possession. Since builder has gotten OC and at this stage he is not suppose to delay further in issuing of possession letters.

dear friends,
Today I enquired from builder's customer care and they have given feed back that final possession letters are being prepared and ll be dispatched to buyers with in 15 days from date of receipt of OC. They were silent on final demands. We all must be careful about any undertaking which may be asked by builder at the time of final possession. Any undertaking may close our doors of fight in future since we have to fight further for penalty amount, reimbursement of rent being paid by us for extended period and excess amount already paid by us. thanks.

Dear All,

Since as mentioned we may be receiving the possession letter. Can we have a list of things that we need to keep in mind while accepting the letter. I can recall a few , please add more

1. EDC demand adjustments (in case extra being paid by the flat owner)
2. Delay penalty clause (rent to be paid).
3. Podium charges. ( Some of the owners have actually paid this). Are we accepting the rate that has to be paid.
4. Registration of the property.
5. Basic amenities to be provided and clearly written in the possession letter or in some other official form.

Request each member to expand the list so that it becomes a checklist for all.

Piyush Group is silent on final demands. May be their intentions are not right and they are still planning to cheat. Bail cancellation hearing is scheduled on 22nd July (Monday) in Chandigarh High Court. Case Nos are CRM-26284/2013, CRM-26346/2013, CRM-M-22521/2013 and listed with MRS JUSTICE SABINA. Cases are listed at 203 V, 204 and 205V. Please find attached cause list. Those who want to go to Chandigarh on 22nd July to show unity of home buyers can immediately please send an e-mail to Tulinder (Piyush Association President) at TULINDER2003@rediffmail.com with their names, contact details and address. Piyush Association is planning Tempo Traveller for members to and from from Chandigarh.

On 22nd July, both applications for bail extension by builder for 6 months and bail cancellation by buyers came for hearing at Chandigarh High Court. Mr. Cheema, Senior Advocate for Piyush Group appeared and asked for time for filing reply to bail cancellation application since builder received that 2 days back. Court has given time and fixed 11-09-13 for next hearing.

In short, builder did NOT get bail extension for 6 months and by procedure, about 1 month has been given to file their reply,

Builder is in impression that any how he will manage the honourable court too and such relaxation from court may boost their firmness on illegal demands too. In fact the Indian judicial institutions are too liberal and slow. These type of people are taking full advantage of court procedures. Anyway we hope that the offer of possession should not affect due to this relaxation.

Dear friends,

Have anybody enquired about the offer of possession letters from builders office. What reply we got at this stage? Since people of customer care reply the same as letter are being prepared but they don't say about despatch. Kindly update if somebody got latest update.

Is piyush charging ECC\FCC along with EDC as well? If yes, what is the amount?

Where is the relaxation? Honorable Court refused to provide relief of 6 months requested by builders. Builders are under constant pressure of High Court. It is easy to write posts criticizing judiciary. Become a part of fight rather than blaming Courts. Sadly, when I asked for nominations for going to Chandigarh, hardly anyone came forward for the same from this forum.

This is clear failure on our part. We must show our unity and strength at each and every platform to achieve result. Now what should the next course of action to pressurise builder to get possession letter.

Dear Friends,

I enquired for Piyush Customer Care, they stated that final possession letters are ready and going to be despatched next week positively but still they are silent on demands. All of us must chase frequently so that builder should feel pressure.
