Complaint against BPTP

Guys,

Quick Question: will it be a good idea to send a copy of any complaint filed (say to EOW or to DTCP) to builder as well? The idea is to let builder know that we have filed a complaint against?

Any pros/cons ?

Yes, purpose of complaint is to get it resolved. It will be appreciated if builder himself is able to eliminate the cause of disappointment or be ready for consequences.

Don't do that. If you copy the builder, he will be able to influence the concerned authority and take pro-active action to thwart any action. File the complaint to concerned authority and then authority will take relevent action,

Whenever you file a complaint to any agency like EOW, DGTCP etc. the complaint will go to the builder as the agency will record the statement of the concerned builder as well unless you have all the relevant documents to prove a prima facie charges framed by you. This is how the law is enforced in our country.

Complaining against any wrong doing is your fundamental right.

There seems to be no wrong doing in complaining against any wrong doing. The only thing is that Builder becomes over cautious in future before committing such wrong doings.

Any complaint is like a whistleblower for yourself and the other buyers,too.

I have made a complaint to the connaught place, police station against BPTP Ltd. And provided them proof of the offence several months back. But till date police have not registered a FIR and forcing us to settle the case at 9% interest.

The Public Notice By Office of DGTCP(Annexure 2) specifically states that what you are doing in Sector 76 is a Illegal act ,

Era Divine court Being Developed,Marketed by Era landmark Ltd without Era landmark Ltd having Any neither License nor Land, in Sector 76 is flagrant voilation of The Laws of the land enumerated in Annexure 2.

Since you are the Licensee for the Land 55.98 acres in Sector 76,License no 1042-1061, hence you are the Chief Conspirator in the Crime for which Era directors are facing the Music. You cant hide for Long.

Because of your prime role in this irregularity , the DGTCP is not renewing your License and even the Buyers of Park Floor 2 in Sector 76 Faridabad are suffering. Any way you dont care since you have already collected collected 100% of their money..(annexure 3)

1.Pls explain your utter disregard both for the laws of the Land as well as your customers who have fulfilled your illegal demands, out of their hard earned money only to wait till eternity, to get 2/3 BHK flats.

Dear Sir BPTP has done illegal activity in Whole sector 76(55.98acres), and Buyers in Era divine court(26acres) and Park Floor Buyers in Remaining 29 acres,are suffering since long time. Their Flats are ready but Both Era & Countrywide cannot give them Legal vacant Possession. DGTCP has refused to renew the License. Buyers are Fighting court Battles. Era & Countrywide are fighting amongst themselves.

When the police refuses to take action we all have the Right to approach the courts and file your complaint under Section 156(3).
