I had also get the demand having 6.3% VAT,18K Electric Meter charges and 28K of AMC charges.

It's time unite and protest against him.

This is height of cheating. Where in the world is this VAT figure (6.3%) applicable?

We are also forgetting an important issue - what about the rent against the delay in project completion?

Sometime back it was Rs 6 per sq feet from the expected date of delivery.

We need to unite against this. We are not supposed to pay VAT, we are supposed to get money for the delayed project.

Also, why AMC charges? Can I go and use the swimming pool or the gym? It's all mud and water there, no roads..no one can live there.

Thanks for this useful piece of information. It says VAT of 3%. Still 6.3% is a question.

I think we are the first victims of Supreme Courts order to charge VAT on new constructions. May be this would throw some light on the current situation:

Hi All,
Thanks for sharing all your queries and comments over here...

I have also got the possession offer letter for my B4 unit with VAT 6.3% on BSP, 18K for elect. meter charge and Annual Maintenance charges@ Rs.1.85/Sq.ft/month.
I have mailed to SRS customer care regarding the queries on VAT & AMC but yet to receive any reply. Hope they are not going to clear any queries and finally put the penalty if fail to deposit the demand amount by 7th April.

Hope all our queries can only be sorted out once we get united....

...More suggestion please from Senior Members...

Hi..All,



I got the possession letter for my Flat in Pocket P5.. SRS Pearl floors... they are asking me for inters test of Rs 4.0 lacs including interest on late payment of enhanced EDC/IDC..which I believe was not be be paid till it got settled with the court..



Please suggest what to do..

Did anyone get EDC/IDC back/return from SRS ? the amount which we paid as extra ?

Did anyone get any demand in Feb/Mar 2014 for A1 tower ?

Yesterday , I called SRS Office and asked about these

VAT Charges

Their Reply " Humko 200 crore jama karwane hai, aapko to dene padege"

Delayed Possession

"Jo karna hai kar lo, ek paisa nahi denge, kyoo apna time waste kar rahe ho, humara to yeh kaam hai"

OC Certificate

"Legal Dept se baat karo"

Please suggest what to do.

Hi all

I think we should approach to consumer court against SRS vat charges. because according to govt. order it is only 4% and it is applicable on the flat material cost and also VAT is not apply on labour cost. So if SRS charges VAT then we must pay it according govt. & legal norms.
We must have a meeting with SRS management team and discuss about this illegal VAT charges.

Dears

Vat is chargeable 4% round on construction material only. Vat is not applicable on labour cost.
Builders as well as flat buyers are confused over the payment of VAT charges on selling and buying property. The recent directive has been issued over the amount of Value Added Tax (VAT) that needs to be paid to the State Government against property sold or bought between June 20, 2006 and March 2010. Jagran Cityplus reports

According to the law, Value Added Tax (VAT) is applicable on mobile things. Things which are immovable are not counted under VAT. October 31, 2012 is the last date to pay for this year. Every builder is pressurising his customer to pay VAT.
When a consumer gets such threats from his builder, he has the right to know for what reason is he paying this VAT. If an apartment is an immovable property, then why are they paying VAT on it?

How to tackle the issue
Prakash Patankar, expert on VAT Rules recently addressed residents of several societies .He said, “Government is demanding VAT from builders, not from flat owners. However builders can charge VAT to flat owners / buyers with certain conditions which builders must have registered with VAT authorities. The registration date must be 15/10/2012 or before. And most importantly builders must pay the due amount of VAT to Govt. before 31/10/2012.
He further said, “If any builder does not fulfill anyone of above 2 conditions, then he cannot demand VAT amount from flat buyer with retrospective effect; i.e. from 20/6/2012. In such cases builder can demand VAT from the date of registration and onwards. Another point is that builder must give detailed break up of VAT calculations and a tax receipt as laid down in VAT rule books. This is mandatory requirement because VAT is applicable only on purchase of under construction flats. VAT is not applicable for ready possession flats.

IF YOU WANT EARLY POSSESSION,MAKE THE PAYMENT UNDER PROTEST.,AFTER TAKING PHYSICAL POSSESSION FILE THE CASE IN CONSUMER FORUM FOR RECOVERY OF VAT,DELAY IN POSSESSION PENALTY
