After common areas judgment, Allahabad High Court has once again provided justice to home buyers. It has ordered demolition of symbolic Supertech 40 storey twin towers in NOIDA. Also, to send strong message to NOIDA Authority being in nexus with builder, it has ordered prosecution of NOIDA Authority officials. Hope builders and Authorities in Haryana learn lesson from this judgment.

Noida: In a major setback to Noida Authority and realty major Supertech, the Allahabad High Court on Friday ordered the demolition of two 40-storey towers in Sector 93 A, Noida.

The court has also directed the prosecution of officers of Noida Authority and Supertech for carrying out the illegal construction. They have also been asked to return the money to the investors at an interest rate of 14 per cent.

The towers whose demolition has been ordered by the court are a part of the Emerald Court Project of the Supertech Group.

Much relieved by the court's orders, Amit Saxena, petitioner's lawyer told CNN-IBN that the case would be a torch bearer for all such cases in the future. "The complaint was that certain promises were given to the buyers but later excessive construction took place that congested the area.This case will be a torch bearer for future cases," he said.

"None of the towers that are due for demolition were occupied; though they were sold and now the buyers will be compensated," added Saxena.

In Greater faridabad also, BPTP has also constructed A tower named "THE DACK " in GRANDURA SOCIETY. RWA GRANDURA should also initiate such action against BADMASH BUILDERS.

Dear Madam,

It is not only the DACK in Park Grandeura but 4BHK Tower in Omaxe heights and various other societies wherein Licensees/Colonizers have altered the Lay Out Plans without obtaining the cosent of the stake holders/allottees/residents in the said societies.

Jointly the could be fought in the court of law. Only words are not adequate to fight against the mighty colonizers & arrogant Sarkari Babus.

NEW DELHI: In a relief for Supertech, the Supreme Court on Monday stayed demolition of two buildings of the developer in Noida.

The apex court also directed that status quo be maintained and restrained Supertech from selling or transferring any flat in these two towers.

On April 11, the Allahabad HC had directed the company to refund money to homebuyers with 14% interest in 3 months. Noida authority, Supertech Group and homebuyers had last week filed a special leave petition demanding review of the high court order that had directed demolition of the twin residential towers for allegedly violating building regulations and UP Apartment Act 2010.

The Authority said no norms were flouted in approving the maps for the two buildings in Sector 93A. "The Authority had allowed a requisite gap of 9 metres between the two building blocks and the realtor complied with it. We will appeal to the SC to review the HC order that did not take these things into consideration," said a senior Authority official.

Hundreds of family who bought flats in the towers said that they were the most affected party in the episode, and that their voice was unheard.

Emerald Court RWA counsel Kunal Ravi Singh, however, took a different stand. "We will request the SC to continue with the Allahabad high court order directing Noida Authority to demolish the twin towers. The case is pending for a long time and the realtor should not be allowed to carry on construction or give possession to homebuyers because it will create a third party interest," he said.

Supreme Court raises serious questions about collusion between Noida authorities and builders

NEW DELHI: The Supreme Court on Monday agreed to examine real estate major Supertech Ltd's plea against the Allahabad high court's order directing demolition of two 40-floor towers in Noida and ordered the company not to sell or transfer flats in the buildings.

A bench headed by Chief Justice RM Lodha issued notice on a batch of petitions filed by Supertech, Noida, flat owners of the controversial buildings and the petitioner on whose plea the high court had passed the order. It also expressed surprise on how Noida (New Okhla Industrial Development Authority) had permitted the construction of 40-floor buildings and said that if they are to be demolished then the authority will have to face the consequences.

If the towers are demolished then money must be paid to flat owners by the authority as it colluded and participated in giving sanction for them, the court said. The bench also raised questions on how the floors was raised from 24th to 40th floor during the construction.

The bench was hearing pleas in which the petitioners had submitted that the high court order to demolish the towers — Apex and Ceyane — be immediately stayed. The high court had ordered demolition of Supertech's two under-construction towers in the real estate firm's Emerald Court project.

The two towers have 857 apartments in total. Of these, about 600 flats have already been sold. In its petition, the firm has claimed that the two towers were being constructed as per "approved building plans" and "there is no violation".

On April 11, the Allahabad high court had ordered demolition of the two towers and directed the company to refund money to the home buyers. The HC order came on a petition of the Emerald Court Owner Resident Welfare Association, which had alleged that the approval and construction of the two towers was "in complete violation of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act".

The association has also claimed the authority had given permission to raise the height of the two towers, which was earlier supposed to have only 24 floors each, "without maintaining the mandatory distance of 16 metres from an adjoining building block," making it "unsafe, apart from blocking air and light".

SUPREME COURT HAS UPHELD THE HISTORIC ORDER ON THESE ILLEGAL TOWERS OF SUPERTECH, AND ORDERED THE DEMOLITION OF THESE TOWERS. ALSO ORDERED THAT BUYER SHOULD GET THEIR MONEY BACK WITH 14% INTEREST.

SC का सुपरटेक को आदेश, ग्राहकों के पैसे लौटाएं

नई दिल्ली। सुप्रीम कोर्ट ने अपने फैसले में सुपरटेक बिल्डर को तगड़ा झटका दिया है। नोएडा के सेक्टर 93 में सुपरटेक के दो टॉवर गिराने के मामले में सुप्रीम कोर्ट ने सुपरटेक बिल्डर को ग्राहकों के पैसे लौटाने का आदेश दिया है। इससे पहले इलाहाबाद हाईकोर्ट ने सुपरटेक के एमरैल्ड कोर्ट अपार्टमेंट के दो टॉवर एपेक्स और सेयान गिराने के आदेश दिए थे।
सुप्रीम कोर्ट ने आज अपने आदेश में कहा कि इन दोनों टॉवरों में फ्लैट खरीदने वाले लोगों को उनका पैसा वापस मिलना चाहिए क्योंकि ये उनकी मेहनत की कमाई है। और इसके लिए वो बार-बार कोर्ट के चक्कर नहीं लगा सकते। इसी साल मार्च में इलाहाबाद हाईकोर्ट ने एपेक्स और सेयान टॉवरों को अवैध बताते हुए उन्हें गिराने का आदेश दिया था।

It is a landmark judgement and will set examples. Such judgments pronounced by hon'ble SC will help prune down the very existence of crony capitalism in other states,too.
