Hi all,
I also own a unit in low rise 250 sq.yd. in Era. Last week I received a demand from Era for advance maintenance, meter connection etc.without giving possession.
They are not talking about the possession and keep on demanding illegal amounts every time.
I wish to know if any of the members knows about their licence status, whether they have received it or not. I have heard few Court cases are also going against them.
Are u all planning to pay this time or not.
What to do senior members pls guide.

And a letter has been written to D.T.C.P Faridabad in this regard but no reply has been received till now. After observing the site, construction is in running stage. And a agreement “Buyers Agreement” has been signed by buyer with developer that if any unnecessary late in delivery of flat by developer then consumer will be compensate, if matter can solved in Consumer Arbitrator then matter can be taken to Consumer Court. And matter is related to Delhi Consumer Court. It is only for your information.

Why is DTCP not replying to BPTPs request for subdivision of license made on 13th April 14??

Investigation is one sided and not in accordance with allegations made in the FIR. None of the charges have been investigated and email simply shows that commissioner police is acting as postman of BPTP and ERA.

DTCP,Chandigarh knows fully well the illegal activities of these builders- era-countrywide-bptp-fraud-exposed-by-dtcp-t2253.html, but has deliberately not taken any step against either, and also not replied to Police despite several reminders. Actually the main culprit is the DGTCP. Police says that despite repeated reminders(proof available) DGTCP has not replied to the Police. Hence action has to be taken against the DGTCP. Or it could be that DGTCP & Police are both protecting the Criminals.

Still a Petition has been filled by FAOA,GF @ P&H High court against DGTCP(Civil Original Contempt Petition 352 of 2014) regarding illegal activities of Builders in Faridabad and Inaction of DGTCP, and we all have to wait for its hearing 26-9-14.

Police cannot overlook serious white collar crimes being committed on law abiding tax paying citizens. They cannot be biased in their investigations and conduct COMPLETE and PROPER investigations on aspects of the Aledged crimes in the FIR.

You may want to move court requesting an order for proper Investigation of FIR.

SC ORDER- CITIZEN RIGHT TO GET COMPLAINT INVESTIGATED PROPERLY BY POLICE

Of course it is a Criminal negligence of Police in Investigation of Crime but we all know the BIG political hand behind the Builders,which prevents them.

Even the Court of Magistrate who passed the order http://eraredwoodfbd.blogspot.in/2014/0 ... filed.html seems to be deliberately going slow on the case, the Tactic of the Builder is to prolong the Case and exhaust the complainants,

The Fight has to be fought on multiple Levels with emense Patience and determination,It is encouraging that several buyers who were reluctant to participate in Court cases have come forward and contribute silently.The ultimate aim of all is to get a Legal House.

In Sebi order's, they have mentioned about some era projects like Era Redwood, Faridabad, Cosmocity, Gurgaon and palwal project. but Era Divine Court, Faridabad is no where mentioned..

Adel Landmark Ltd. has deliberately not mentioned Era divine court as one of its asset. And as per view of Senior members.

Greetings

All Era projects which qualify under the definition of CIS (Collective Investment Scheme) should come under the scanner.

If not then, it depends on the buyers who must not have filed any complaints. Besides, Investor grievance and education personnel of SEBI are mentioned in my previous post, which may be contacted with proof of Agreement, Application form, Advertisement, Website Screenshots, Accounts statement.

Sebi has already stopped ERA from refunding, selling, buying, creating encumberance on assets of 103 project gurgaon, Sector 9 Palwal, 78 Faridabad.

As a first step a copy of this order be sent to registering authority in the district highlighting the restraints applicable.

It appears that SEBI has started to take action after Ponzy scheme by Private individual,companies,corporate e.g Shardha Chit fund scam,NSEL Scam,Sahara Real estates Bond Scam etc.

What happens when Adel L L gets itself registered with SEBI.?

GPA is no good,
- Has this GPA been registered in any court of law?
- GPA does not transfer and convey any rights, title and interest in immovable property
- Rights through GPA can therefore be only that for developing flats and not rights on proportionate land or rights to transfer flats built on such land without ownership of such land,
- GPA being barred by limitation does not mean BPTP can transfer ownership rights or JV/rights in license granted by DTCP to BPTP
- GPA is not sale or transfer and is only an agreement between BPTP and ERA to develop flats
- For sale, coveyance deed and stamp duty are must for rights on land/transfer of property in flats etc
Hon’ble Supreme Court of India in “Suraj Lamp- &Industries Pvt. ltd. vs. State of Haryana &Anr. (201 1 STPL(Web) 879 SC)”


DTCP is merely a licensing authority and has not approved any any partnership/jv/subdivision of license given to BPTP on which ERA is making flats. That is why it is not reverting to BPTPs letter dated 13th April 14.


What if BPTP and ERA have a fight?? Check Affidavit filed by TRIVENI in case of ZION claim ex-triveni-management-shocker-affidavit-in-high-court-against-zion-asking-for-auction-of-entire-project-land-t2109.html?hilit=Affidavit by Triveni#p15917


Even if Licence is split in future (after era has fraudulently signed BBA with buyers claiming license and land ownership), DTCP is not a registering authority to provide ownership of Land to Era
or
In effect giving ERA completion certificate or any power to transfer, sale of interest in land on which it is building flats.


As it appears, investigation is biased, devoid of facts and is overlooking criminal conduct and conspiracy by both ERA and BPTP, possibly in connivance with DTCP to hoodwink innocent and . PerhapsProper investigation be demanded as per original complaint

Basic question is when there is a Policy of granting License, THAN is GPA overiding document over License, GPA is of NO MEANING IN HARYANA Where LICENSING POLICY IS IN PLACE. No Court can favour Era Landmark if it shows this Bullshit GPA.
To Build Market & Sell any Group Housing Project in Haryan a LICENSE has to be obtained by the Builder(here Adel LL) from DGTCP. Otherwise it is unauthorised construction.

Isn't ERA already registered with SEBI? Does a mere company name changes de-registeres it?

It's obvious why ERA has not listed ERA Divine Court as an asset but what does it has in store for the investors?
Is there any light at the end of tunnel?
