naveen ji i would like to participate in all this as strufling a lot with ERA for my booking in ERA Divine Court High rise. i convyed earler i have paid 95% of basic and 100% of other charges.
if this team is fighting for High rise project irregularities i am keen to join. can i know the person with whom i can talk understand and join this fight against wrong doings of ERA.
please suggest name and contact number with whom i can contact

How a corrupt judge continued in Madras HC
Justice Markandey Katju


This expose is by Markandey Katju, who was chief justice of Madras high court before becoming a Supreme Court judge. He is now chairman of the Press Council of India

There was an additional judge of the Madras high court against whom there were several allegations of corruption. He had been directly appointed as a district judge in Tamil Nadu, and during his career as district judge there were as many as eight adverse entries against him recorded by various portfolio judges of the Madras high court. But one acting chief justice of Madras high court by a single stroke of his pen deleted all those adverse entries, and consequently he became an additional judge of the high court, and he was in that post when I came as chief justice of Madras high court in November 2004.
That judge had the solid support of a very important political leader of Tamil Nadu. I was told that this was because while a district judge he had granted bail to that political leader.

Since I was getting many reports about his corruption, I requested the Chief Justice of India, Justice R C Lahoti, to get a secret IB inquiry made about him. A few weeks thereafter, while I was in Chennai, I received a call from the CJI's secretary saying that Justice Lahoti wanted to talk to me.
The CJI then came on the line and said that what I had complained about had been found true. Evidently the IB had found enough material about the judge's corruption.

Since the two-year term as additional judge of that per son was coming to an end, I assumed he would be discontinued as a judge of the high court in view of the IB report. However, what actually happened was that he got another one year's appointment as an additional judge, though six other additional judges who had been appointed with him were confirmed and made permanent judges of the high court.

I later learnt how this happened. The Supreme Court collegium consists of five senior most judges for recommending names for appointment as Supreme Court judges, and three senior most judges for dealing with high courts.

The senior most judges in the Supreme Court at that time were the Chief Justice of India, Justice Lahoti, Justice Y K Sabharwal, and Justice Ruma Pal. This collegium recommended that in view of the adverse IB report the judge should be discontinued as a high court judge after his twoyear term was over, and this recommendation was sent to the central government.

The UPA government was at the Centre at that time.
Congress was no doubt the largest party in this alliance, but it did not have a majority in Lok Sabha, and was dependent on the support of its allies. One such ally was the party in Tamil Nadu which was backing this corrupt judge. On coming to know of the recommendation of the three-judge Supreme Court collegium the party strongly objected to it.

The information I got was that Prime Minister Manmohan Singh was at that time leaving for New York to attend the UN General Assembly session. At Delhi airport, he was told by ministers of the Tamil Nadu party that by the time he returned, his government would have fallen as their party would withdraw support to the UPA (for not continuing that additional judge).

On hearing this, Singh panicked, but he was told by a senior Congress minister not to worry , and that he would manage everything. That minister then went to Justice Lahoti and told him there would be a crisis if that additional judge was discontinued. On hearing this, Justice Lahoti sent a letter to the government of India to give another term of one year as additional judge to that corrupt Judge, (I wonder whether he consulted his two Supreme Court collegium members), and it was in these circumstances this corrupt judge was given another one-year term as additional judge.

The additional judge was later given another term as additional judge by the new CJI Justice Sabharwal, and then confirmed as a permanent judge by the next CJI Justice K G Balakrishnan, but transferred to another high court.

I have related all this to show how the system actually works, whatever it is in theory.
In fact, in view of the adverse IB report the judge should not even have been allowed to continue as additional judge.

Hi All & Naveen,

After the SEBI order, I think we cannot even sell our unit even at a big loss.

So just want to know what all option do we have, just in case ERA/ADEL runs out of money.
1. Move against builder in Court and wait for judgement Or
2. Takeover the ownership and every right from ERA/ADEL and start construction on our own (Obviously using any 3rd Party contractor)

I googled a lot and found that most home buyers are at mercy of Biulders & Court Judgment. Below is an article which says time limit does not apply in builders. But why wait?

Buyers have moved to court Long time Back SIR, You have missed the Bus. Their are only two options wait for court judgement or kill or get killed.

Era offers so many cause of actions to all buyers that they dont have to wait for delayed possession.

The cause of action happened at the very beginning when you booked the Flat in Era divine court.

Anyway even without this SEBI ban, if you sell your era divine court unit to someone else you automatically become liable to be prosecuted.

Builder may save itself but what about you.

Thanks Naveen ji for the update. Definitely i have missed the bus :blushing:
Regarding moving to court, have buyers gone collectively in court or individually? And is it against delayed possession or the wrongdoing of BPTP & ERA filthy nexus?

Finally we all want our home to get rid of Rent and EMI burden. So isn't there any option that we all as group/society take land & construction right from ERA and hand it over to any other contractor to get it all done fast? Kindly advise.

Criminal Case can be filed Individually, although all have hired a single lawyer and That lawyer is representing all as a group.Criminal case is against the Illegality done by Era with the Buyers.
Consumer case is from the RWA side.Regarding the penalty for Illegality, Cheating, Delayed possession etc.

As far as Taking over the project from Era, The Land belongs to BPTP & not Era , also the License belongs to BPTP, Hence Era is a Illegal entity their without any ownership right.

Hence you cannot take over from Era as Era itself is not the Owner.

Since the first hearing in high court the Counsel of Petetioner has Compromised with the Criminal and sided wth them.

Its written that "Counsel for the petitioners and counsel for the complainant are hopeful of matter being compromised in near future." . what is the meaning of compromise there?

Compromise means GIVE & TAKE, if complainants are satisfied than they will withdraw the complaints.Anyway the complainants have suffered a lot and they deserve the benefits of the fight, they should get the alternate home or Money,

Sending Era directors to jail will not serve their purpose it is alternate Legal home that will serve the purpose and will be real Victory.

What is Illegal is Illegal. To hell with it.

Naveenji can I ask you as to why you are not with us.
Didn't we start the fight together? Aren't you originally an Allottee of Era Divine Court high rise?
Then how come you are residing in Redwood residency another project by the same criminal builder.

Once I receive answers I will make things more clear.

Anyway Pls tell all whatever you may want to tell all.

I am not at all afraid.

Anyway pls tell what COMPROMISE HAVE YOU DONE WITH ERA your Vakeel has accepted this fact before the Honorable high court , this cannot be without your consent.

Congratulations for the compromise , Nothing is going to be acheived by sending the builder to Jail but the real victory will be to get a fully legal Home which is the thing for which we were fighting.Some get early some get it late, it does not matter much.
