But isn't this was changed to 1%?? There was a pdf shared by someone in this very forum about it.
Below is the text from the same document:

A developer liable to pay tax under the Act, and duly registered may pay, as an option, in lieu of tax payable by him under the Act, by way of composition a lump sum tax calculated at the compounded lump sum rate of one percent of entire aggregate amount specified in the agreement or value specified for the purpose of stamp duty, whichever is higher, in respect of the said agreement. The Developer opting for this scheme here-in-after shall be referred to as the composition developer.

Anybody intrested to take this builder legal against unjustified demands let me know. My no is 9540894400.

Lets not let these things go easy for this builder as otherwise this malpractices will continue like this for generations.

RPS group is asking BG(bank garuntee) from flat owners @4.2% else refusing to register!Can anyone suggest ligitimity?

Dear Friend,
"VAT' ON COLONIZERS HAS NOT BEEN IMPLEMENTED/NOTIFIED IN HARYANA TILL DATE. HOWEVER HON'BLE SUPREME COURT HAS ALREADY PRONOUNCED A GREEN SIGNAL FOR "VAT" IN A CASE PERTAINING TO KARNATAKA AND MAHARASHTRA.
HARYANA COULD NOT NOTIFY TILL DATE ON ACCOUNT OF LEGISLATIVE ELECTIONS SCHEDULED ON 15th OCTOBER. TE SAME MAY BE NOTIFIED VERY SOON IMMEDIATELY AFTER THE NEW GOVERNMENT TAKES CHARGE AFTER 19th October.
Also it is pertinent to mention that colonizer can not demand ANY AMOUNT in anticipation of NOTIFICATION. ANY AMOUNT DEMANDED IN THE NAME OF VAT BY COLONIZER ON TODAY IS ABSOLUTELY ILLEGITIMATE. Please resist paying VAT until the notification comes in public.

For T9 flooring completion demand has been raised by RPS. Did any T9 flat owner has verified completion of flooring?

I have paid the installment demanded for completion of flooring for my flat in tower T 10.I have got a written commitment from RPS that the penalty amount for delay in offering possession for this flat will be adjusted against the final installment payable during the time of possession.Can somebody help me understand the calculation of penalty that RPS builder buyer agreement imposes on them.For calculation purpose they will consider the date on which they receive the possession certificate from the authorities .Rps have also mentioned that they are likely to offer possession of 8 more towers in the first quarter of 2015 including T 10.Is there any truth in that claim ???

Hi,
even we were also told the same by the RPS group. However please do not be hopeful that they will be adjusting or paying the amount. There is clause in the agreement which says that a builder can charge more in case there is increase in the cost of raw material. So they will be adjusting the penalty amount against these charges which again works out in favor of the builder only and not in favor of us. That is why they are telling us that they will adjust the penalty in the last installment.
This can be taken up legally however it makes sense only when we pursue as a group of 40 or more owners. Aprox .per owner the penalty amount should come to 3.5 to 4L. If we go individually then the case will first go to district court and then high court. It will be difficult to run to Chandigarh for every hearing. However if we file it as a group of 35-40 or more owners then the total penalty amount will be more than 2Cr and the case can be filed with National Consumer Forum Delhi, and also becos the amount will be big, the hearing and decision will speedy.

Hi Sonila,

Your message is really helpful to lot of people, but in my view you missed few thing.

1/- Project should be deliver during year 2010 and builder is giving excuses that from year 2010 the cost has gone up. If they deliver the project well in time, there will not be such dispute including the VAT which they are charging now was not in force (or say, wasn't in picture during year 2010 including few more charges). Please read the clause of "Price escalation". "prices are firm & is not subject to any escalation towards cost of construction unless there is an ..........". So, word "unless" is not communicated or published or circulated to anyone. Though legally, these kind of agreement are stated "one sided" and not valid.
2/- Penalty on late delivering the project denied by Company saying that if someone delayed their even one installment by one day, Company will not pay the penalty which is Rs.5/- per sq feet. But on the other hand they are charging the penalty @ 18% on delayed payment from customer. Is that justified?

3/- While going legally you can claim the penalty @ 18% p.a. which builder has justified themselves by charging the interest element in their demand letter. If you calculate the penalty element @ RS. 5/- psqft, it will come appx Rs. 290k for 4 years (till year 2014) for a standard 2 bhk of 1200 sqft. But if you calculate the interest element @ 18% p.a. on Rs. 18 lacs (appx - assumption of value) for 4 years, it will come appx Rs 12.96 lacs at simple rate of interest plus you can claim for harassment and maintenance.

4/- Going in group have a lots of hurdles and complications, though it is very good idea. But group of 30-40 ppl and all will be on same frequency......little bit difficult.

just joined this community. Have purchased a flat in RPS savanna in 2007. was to be complete by 2010.
Got possession letter in jan 15. with whole lot of weird demands.
any one else got the possession letter.
