Rakesh Bhardwaj

I just called Mr. Rakesh Bansal (DCTCP office) to check about the yesterday hearing. He is saying the hearing could not be conducted as the Director was not available again. Dont know whats going on.

Dear Rakesh Bhardwaj ji,

The official hearing has taken place though a short one and next date has been fixed also. DGTCP, Haryana was taken back by the arguments made by the learned counsel of complainants.

The buyers may listen some good news by the next date of hearing.

Developers can't take investors for a ride: SC

NEW DELHI: Supreme Court on Monday directed real estate giant Supertech to refund money to the flat owners within 30 days, saying "developers can't take investors for a ride."

"You cannot be holding back money of investors who do not want to be relocated in other projects ... Developers can't take investors for a ride. If they want refund of their investments, can we deny them this relief," a bench headed by Chief Justice H L Dattu said.

"We direct the respondent (Supertech) to refund the amount sought by the petitioners. Principal amount shall be paid in 30 days," the bench, which also comprised Justice A K Sikri, said.

The apex court also directed the company to refund the interest within 60 days after the principal amount is paid to the investors.

Earlier, it had directed Supertech to give back money within a month to flat owners who had sought refund of their investments, after the 40-storey residential twin towers Apex and Ceyane in Noida were directed to be demolished by the Allahabad high court.

Holding that flat owners cannot be forced to remain in limbo and wait indefinitely due to litigation, the bench had also directed the company to pay compound interest at the rate of 14 per cent per annum to allottees by the end of October last.

It had turned down the plea of Supertech which had contended that it was not in a position to pay back the money as the interest part has grown more than the principal. The price of the flats, located in the outskirts of Delhi, ranged from 65-90 lakhs.

The bench was today hearing a plea filed two investors who had approached the apex court seeking refund of the money.

The high court, while passing orders for demolition of Towers 16 and 17, had erred in directing the company to refund the consideration received from the petitioners and other such flat owners, the plea said.

Heard that OC has been granted to Low rise flats of ERA DIVINE COURT But still not a confirmed news.

Dear Friends

We had a very successfull meeting on March 9, 2015. It seems that our troubles are finally falling in line. You will be delighted to know the outcome of the Chandigarh's meeting. We are very thankful to all the persons who took so much pain to visit Chandigarh for a greater cause. If we all keep on supporting each other like this, days will not be far when we will be in Era Divine Court Flats.

We will be discussing the outcome of the Chandigarh's meeting on March 22, 2015 at 11am. Venue will be Era Divine Court Site. Faridabad. Therefore all are earnestly requested to join the meeting.

One important fact is brought to your notice that fight like this entails a great sum of money and effort of all of us. We are paying a reasonable amount of money to our lawyers Shri Rahul Rathore for this. But the efforts he has put in into this case to cherish our dream of a legalised flat, makes money trivial. Other than that also, all are spending quite a sum of money on visiting Chandigarh. What we need a fund for all this kind of expenditures.

What we propose in this regard, donation of a paltry sum of Rs. 1500 from every stakeholders. This is a meagre amount if you see what result we are going to have. And one more important thing, it is completely voluntary, those who feels that this fight is going in the right direction, will understand the plight of us and will be part of this donation.

Otherwise, it is on persons' discretion whether to donate or not. NO OBLIGATION. We respect all and our love and support will not subside in any case. We will be providing a account Number soon in which money should be donated.

Dear friends

Yesterday(22-3-15) around 80 members joined together to further the cause of possession of our much delayed flats. We are thankful to all those who attended by taking out their precious time and also thanks to others who could not joined us due to their busy schedule. We hope you will cut some time out from your busy life for our next meeting.

This meeting was well briefed by our dear friend Dipak Madan to the satisfaction of all of us. We thank him and must appreciate efforts of Ashish, Raghvendra, Manoj, Pankaj, Arun and all (sorry friends can not not list all names as list is never ending) who are part of this fight.

Consequent upon our third visit to Chandigarh and persistent pursuit of our goal, our dream of a flat seems to be coming true.

Almost 40 fighters visited Chandigarh on March 9 to fight against injustice done to us by builders. We waited long there although attempts were made to discourage us to go home as DG was not there. On his arrival to office, astonishment on DG face must had been seen on seeing so many persons there for a single cause. It must be known that he has recently joined as DG and still he gave us a patient hearing. Our cause was well presented by Adv. Rahul and in between we also apprised him of our grievances. In front of us he acknowledged the wrong done to us asked why they (Era & Bptp) should not be punished for their offences. He told them both the builders will be prosecuted for their offences and assured us our interest will not be hampered in this way.

DG assured us he will issue an order within 3 days in this regard and will see for an early possession of our flats.

It has come to our notice that Order in this regard has been issued and we may receive the same soon. The contents of the order was explained by Dipak today who got some info about this order from his source. As the land and license is with Bptp, DG has asked Bptp to pay Rs 2 crore for illegal transfer of development rights to Era and payment of other dues amounting to Rs. 6 crore for renewal of license. And to our surprise 10 days period have been given for fulfillment of this order. You must know that for transfer of land and license to Era, documents have already been submitted in TCP office barring few. I have also talked to PA to DG and he has too given me same information.

Now we assume that once this due is paid, channels would be opened for legalization of the project. But Era is shrewd and can not be trusted. We have to keep on fighting till the flat is in our hand and definitely later also as they will have maintenance rights.

If everything goes as we are thinking, some of us may get flats in 6to 12 months.

Dipak Madan Bhai may elaborate it more.

Other than that as we have already apprised you for creation of a fund to keep our fight alight, a solid step has been taken today in this regard and contribution poured in by many of us. We thank all those. Many of us wants to contribute electronically so here is the account no. in which you can send money. We have proposed an amount of Rs 1500 per person or more but as it voluntary, you may decide the payment.

It must be mentioned here that all the expenditures would be transparent and spending would be intimated to contributors.
