NOIDA Extension in Trouble - Farmers win in High Court by filing writ petition

Looks like farmers are more educated than us and know how to protect their rights. We keep on thinking of filing writ petition in High Court but farmers actually did that in Greater NOIDA and won.

This judgment has led to many projects in trouble in NOIDA Extension (again cheating by builders). There is no NOIDA extension. This is a Greater NOIDA area.

ALLAHABAD: The Allahabad High Court on Thursday quashed the acquisition of land by the Greater Noida authority in Sahberi village in Gautam Budh Nagar where leading builders Amrapali, Supertech and Mahagun have launched their residential schemes under the name of Noida Extension.

In its order, the bench comprising Justice Sunil Ambwani and Justice K.N. Pandey, denotified the entire land of Sahberi village for not giving the farmers an opportunity to file their protest under section 5 of the Land Acquisition Act (LA Act).

The Greater Noida Authority had on June 10, 2009 notified the village land of Sahberi and later took physical possession of it by entering it in revenue records. It deposited the compensation in the district treasury to be given to farmers whose land was acquired. After formalizing the process of the Land Acquisition Act, the land was allotted to the real estate developers.

Farmer leader Satya Pal Chaudhary and 20 affected farmers challenged the acquisition process and filed writ petitions before the Allahabad High Court against the 'arbitrary acquisition' of land by not giving farmers an opportunity to file their objections. The high court clubbed the 21 cases together and initiated legal proceedings.

After hearing arguments from both sides, the bench set aside the process of acquisition and declared the entire land of Sahberi village as denotified. In their judgment, the court observed that the entire process of acquiring the land was illegal.

Very true ...Farmers are more vigilant about their rights and more educated than us.....
They fought and won the case proving big builders claim null and void......
We are less educated and not aware about our rights and scared of inviting many problems....we want only our flat to live to save our EMI and rent so We are ready to pay builder watever amount is commanded as we are very rich....but we dont have time to get united with one vociferous claim and voice when we know very well that we are totally RIGHT.Our one little voice has made many builders to start issuing possession letter and speedening the work...HUDA is also trembling and started working....
So imagine if all cum together with one unanimous voice against builders ....without filing a writ we will win and this builders will run away...

Dear Dheeraj
I strongly agree with you. We should file PIL / some writ in court for asking why the External Development of G Fareadabad could not be completed even now. In one meeting you were planning for it. What happened? Any difficulty! Please think for it. We should hire one lawyer if required.
