Some correction to details posted by nitinomaxe. I am providing these corrections wiht respect to Omaxe Heights Sec 86, if nitin has posted details for Omaxe new heights then that holds true.


For Omaxe Heights Sec 86 Project:

Draw held for Pre Launch customers: 14 Oct 2006 for 630 3BHK Flats and 1068 2BHK Flats
Project launch date (MMM-YYYY) __________________ 13 Nov 2006
Promised delivery period (MMM-YYYY)__________________ 30+ 6(months grace period) from the Agreement date

Tentative possesion dates given by Omaxe Care has changed always
-Tentative possesion date by Jan 2010 as told by Omaxe Customer care in Sep 2009.
-Tentative possesion date by June 2010 when enquired in Feb 2010.
-Tentative possesion date by July 2010 when enquired in Mar 2010.
-Tentative possesion date by Sep 2010 when enquired in May 2010.
-Tentative possesion date by Dec 2010 when enquired in Aug 2010.
- On personal visit to the site on 01 Mar 2011, It is now being told that the possesion is
likely to be given out for 3 BHK flats after 8-10 months for Oscar tower.

- Complaint filed with Consumer Coordination Council on 06 Aug 2010, complaint ID 15563/3/2010, but no response from the builder to the Council

- Increase in supper area by without informing customer, they have made a Podium just to provide covered parking and now that is beign charged to customers as increased common area.

Promised delivery period (MMM-YYYY) : Not applicable. Builder has not yet signed the agreement

Tentative/Expected Delivery (MMM-YYYY) : Feb 2012

What is the penalty rate (x rs per sq ft) : No information. (Builder ha snot yet signed the agreement)

Have you started to receive penalty payments as promised in agreement (Y/N) : N

Please provide rate of Interest for delayed payment : 15%

Amount of Green Area Promised (% Green) : No information

Expected Amount of Green area in actual (%age) : No information

Did you requested for sanctioned layout from Builder (Y/N) : Y

Did you received sanctioned layout from your builder (Y/N) : N

Is Super Area found to be changed at time of possession (Y/N along with +/- SQFT change) : NA (Possession yet not offered)

In case of Possession received, Are appropriate approvals and NOC received (Y/N) : NA

Specific Construction Quality/Safety Issues (You would like to bring attention) : Not at present. (Construction still under progress)

Previous meetings with Builder/STP /Authorities approached so far (preferably authority name/DD-MM-YYYY More than 40 letters and E-mails have been sent to BPTP. No worthwhile response has been received. The main issues are as below :-

1. At the time of booking, BPTP promised allotment on first cum first serve basis. Arbitrarily it changed the criteria to computerized draw system to favour its own brokers.

2. Inspite of being the earliest applicants BPTP allotted 19th floor in Tower ‘D’ and mislead us by saying that it would have the terrace rights.

3. Later on when we represented it offered allotment on 4th floor in Tower ‘A’. However, it levied the condition of PLC which should not have been since as per the original application we had requested for first and second floor. Further on the website also there is no mention of PLC for above 3rd floor.

4. BPTP has been raising demand notices for interest for the so called delayed payment whereas the delay is attributable due to wrong allotment of BPTP.

5. An amount of Rs. 11,63,500/- has been paid to BPTP during the period Sept 2005 to Feb 2009. The payment have been stopped thereafter because of unfair demand of interset from BPTP regarding interest.

6. No agreement has been yet signed for the payment already made to BPTP due to inaction of BPTP.

7. BPTP has placed an online customer support system on the website but actually there is no action on the request/queries that is placed through this mechanism.

8. BPTP has flouted the regulations by

a) Accepting payments from consumers even though there was no sanction for the building plan.

b) Changing the building plans on design without any consent from the consumers

c) Excessive delay in construction resulting in a situation that even after 6 years of launch of the project possessions are yet to be offered.

d) Lack of any grievance redressal policy in the orgainsation

e) No nodal officer has been appointed for redressal of complaints of consumers.

f) EDCs have been calculated for the development charges but the roads/sewerages are still not in place. In fact HUDA has not even acquired the land for master road. Thus BPTP was wrong in collecting EDC’s from consumers when there was no development on the ground.

The main issues are as below :-

1. No clarity by Builder on the possession date for the tower M.
2. No clarity by Builder on the status of infrastructure like water, road , electricity.
3. No clarity provided by Builder on penalty payment due to late delivery, inspite of giving a written letter approx 2 months back.
4. No clarity on the overall plan having green area, club, shops, shools as intially conceptualized when selling this project.
