SRS can’t take forceful undertaking in lieu of penalty adjustment1. DC has taken serious note on pressurizing by builder and at the time of possession, taking sign on forceful undertaking to forgive penalty in lieu of Rs 9390(6 month free maintenance).DC has immediately instructed to DTP to issue show cause to SRS and advise home buyers to not sign on any such documents and complain immediately to DTP and copy to DC by registered post with proof of your final payment and your issue.
DC said-“No one is above rule of law and no builder can force to sign any illegitimate documents to homebuyers.”2. DC said every builder will have to honor the penalty contract as per agreement and if builder is charging 24% interest to buyers, with same formula they need to return/adjust penalty to home buyers with bank interest. Under DC instruction and pressure Omaxe, BPTP, Piyush immediately promised and agreed for penalty refund.
DC clear action and instructions revived hope to SRS buyers to get back penalty amount and so those who have not taken possession are advised not to sign on any forceful undertaking and lodge a written complaint with DTP and copy to DC for your concern and demand of penalty from builders.

Those who have taken possession and compelled to sign on forceful undertaking to take flat possession/shift flat, we are still fighting for them and for their penalty amount refund which is very substantial amount . For 2 BHK it is 1,43,440 and interest 63112=2,06,552 and for 3 BHK, it would be around 171270 + 73357=2,44,627.
4. Every buyers should write your individual complain to DTP and copy to DC asap.
