As you all are aware, During our meeting with DC on 20th May, we were requested to submit our individual complaints in the DC office, DTP Sanjeev Maan has requested that all these individual complaints should come on GFWA letterhead and they would keep GFWA in loop in any action taken in this regard

A total of 430 complaints were submitted to District Town Planner and District Commissioner against RPS Infrastructure Limited on Monday 06 June 2011. The issues were surrounding following areas

    01 Significant and Intentional Delay in construction
    02 Misrepresentation of Fact and duping Customers
    03-Violating Law by Sale before project sanction
    04-Not Sharing Project layout
    05-Inferior Construction Quality
    06-Cheating in name of PLC
    07-Not Allowing Site Visit
    08-Not Paying Penality despite delay
    09-Sharing amenities with other project
    10-Voilating Supreme Court judgement by selling open/slit Parking and other common area

We have raised these issues with DC and DTP offices earlier as well several times, and based on the response of DC during 20th May meeting, this entire exercise was carried out to submit all issues once again with individual supporting, This was a long exercise and all the supporting proofs have been shared with DC and DTP, Hope the authorities empathize with the situation of customers and take strict action against the guilty.

The following were the amenities committed to provide but not a single amenity seems to be provided as the project is delayed by at least two years. we had booked in 2007 and the builder committed to give possession in 30 months but the scenario is quite different as even 50% construction work has not been completed so far more over they are not concerned of their commitments and work is slow or u can say no significant developments are seen at the project sight.

Response has been received from RPS Group against the complaints submitted to DTP.

As expected, they have denied any wrong doing on their part and says everything is as approved plan and commitment.

Interesting point to note at the end of the response to DTP..

Before concluding the reply, it is pertinent to mention that only a group of customers is habitual of making false complaints as they firstly filed their complaints to Hon’ble DTP Faridabad, then to the Mediation Center, Govt. of Delhi and then to the Economic Offences Wing (EOW), Delhi, none of the complaints could sustain being devoid of merits.

Dear Jayanta,

I have gone through the reply from RPS to DTP. RPS has referred to Haryana Development and Regulation of Urban Areas Act 1975 & Bye-Laws of the State Government.

1. What is DTP's reaction to the reply?
2. Can we ask for a copy of the laws mentioned in the reply from DTP or some other authority?

RPS does seem to be grossly irritated seeing us united.
I sincerely appreciate the good work done by you for providing the common platform and other active members for working tirelessly towards common interest.

All home buyers should refer the National Building Code 2005 instead a very old acts. NBC 2005 is more relevent in terms of high rise buildings and applicable to whole country since its inception. This my advise to all and it can dounloaded from the net. NBC 2005 contains every tit and bits of construction inductry in detail. The builders, in their reply to DTP is citing acts as per their benefits not as per the latest act NBC 2005, which is the Bible for this industry.

I was able to find Haryana Development and Regulation of Urban Areas Act 1975 on website india.gov.in which seems credible. I am trying to go through it and understand the implications.

COMPLAINT OF FRAUD & CHEATING
AGAINST RPS BUILDER
Sir

1. I took this opportunity to write to you in view of a number of complaints being filed against Mr RC Gupta , MD, RPS infrastructure Ltd and their Board of Directors having their office at :-

1117 – 1120, 11 Floor
Tower “B” DLF Towers
Jasola District Centre
New Delhi - 110025

2. The Coy is managed by team of poorly reputed builders operating in the local areas of Greater Faridabad. This was suppose to be their second project for which even after 8 yrs they are still struggling for approvals and planning what to do inspite of 95% of amount has been collected from 2300 families that are planned to stay in the said township . There are various malpractices being followed by this builder

(a) Deviating from Layout plans and approvals without knowledge of Buyers by selling stilt parking as ground floor houses at hefty prices and commercial spaces created out of parks /open areas.

(b) Sudden increase in super area from the initial plans and layout leading to additional revenue of Rs 60,000 -95000 per occupant.

(c) Exorbitant charges on account of Free Parking spaces, which is neither existing nor earmarked.

(d) Collection of Enhanced EDC of Rs1.41 Lakhs through Fraudulent ways even when stay by Haryana court.



(e) Threatening the customers of time constraints and collecting money at heavy rate of interest of 24%, forcefully and fraudulently

(f) Hidden charges to the tune of 5.0 Lakhs in last instalments being imposed

(g) Delayed penalty to buyers of Rs 3.81 lakhs is denied

3. It has been observed that the builder does not respond to any queries and issues of the customers. The phone lines are not being attended to and entry to the office has been made strictly on the required basis through private security guards. Presently none of the following directors are approachable or contactable giving the symptoms of bankruptcy and ill intensions of the coy :-

(a) Sh S C Gupta & Sh RC Gupta (Chairman & MD)
(b) Mr Pradeep Seth CEO
(c) Mr Anshu Singhal , President
(d) Mr Vinay Kakkar , Vice President
(e) Mr Rajesh Jain , DGM Mkg

4. It seems the builder has no fear of the law, system or administration. He has made a self style well drafted agreement, which is Fake and biased with no legal backing, just to protect himself. Local reputation, prevailing corruption and time consuming judiciary has made his job a lucrative business of 21 century. If immediate steps not taken this will set a wrong example to the respected citizens of the country and encouragement to fake builders who will use the same tactics again and again.

5. In view of the poor credibility of this builder and non payment of salaries to his staff, it is perceived that he may vacate the existing rented accommodation any time and vanish duping hundred of crores of money of innocent govt and retired people of our nation.

6. Inspite of repeated notices, the builder is not ready to take any corrective steps. There are indications on net and various forums as a warning against this builder. The case is also being projected to various other govt agencies and court for necessary help & penalising this builder.

7. In view of above, as a timely support, may I request you to pl issue instructions on the subject for necessary investigation and file an FIR under section 420 for Fraud & cheating, 120B for criminal conspiracy & 408 for breach of trust against the members of RPS Group.

I have been reading posts about all the effort being put in to fight for what was promised to us, wish to understand if there has been any success in fighting with RPS since most buyers continue to get unjustified demand letters with VAT, penalties etc
