How to Draft a Good RTI Application

The Right to Information Act is a great tool endowed upon the people of India. But tools are useful only when used, and used properly.

Here is a guide to use the RTI Act to obtain the desired result

1. Do not ask for information just for the sake of it. Ask information that you intend to use

2. Make questions in your application short and precise

3. If you suspect some mishandling of responsibilities on someone's part, make sure you ask the name of officers who are responsible for the same

4. Put in a question asking what action will be taken against the erring officers

5. While trying to clean the system using the RTI Act, it is important to note that we shouldn't always be trying to treat the government officers as the accused. We can only succeed when we get the Government Officers working with us and not against us

6. If there is a larger matter that you intend to pursue make sure that you galvanise support around you. Many people asking for the same information in a matter of larger public interest is bound to yield results

7. Share your views and replies with the press and on the site

8. Follow up with action based on the information received. This could be issuing a show cause notice in case of erring practices, sending information to the law enforcement agencies etc.

Hope that all of us will use this great tool with a great sense of responsibility it deserves

Besides actual area measurement and authenticity of their demand,One thing which has been highlighted by the one legal councillor is that as per their agreement the rate Rs. 2425/- per sft is applicalable for only increase in area due to re-sizing of any accomodation.The clauses of their addeddum says that if any area was left unmeasured w.r.t. plan provided in the agreement that shall be charged with the base rate of Rs. 1835.62/-. That may be the reason ,BPTP is not giving details.

Dear All
One of the customer has given details of breakup of increased area for 1203 Sq ft floor, according to BPTP. Balconies : 140 to 181 approx Staircase : 93.25 to 119.7 approx Areas mentioned below are common and hence will be divided by 3 Shaft : 129.168 Mumty : 78.25 Boundary Walls : 107.64 Common Area :14.10 Canopy : 6.75 Projection Elev : 32.29 ,not sure of some of features like MUMTY, Shaft seems to be incorrectly measured. as 129.168 Boundry wall It may be around 50-60 max.

All those who got the notice will asked BPTP to verified this by a qualified architect. Some components seems to be bogus which qualified architect only will confirm.

If we know of any architect or anybody among ourselves who has invested in this project or someone who knows an architect who could help. even if there is a nominal fee allottes can pool and get an authentic record.

Dear All,

I have come to know that some of the allottees have moved the consumer court in this regard. I tried to contact some of them but I regret to say that it seems they want to fight alone. As jayant has already said, and I reiterate, that we should all get together in this fight. Last date to pay demand is 14th July and it is reaching nearer and nearer. Lets not waste further time. I am in consultation with an advocate for serving a legal notice. Those all who are interested in joining this fight may contact me on 9810585747 or write to me at vikkibans@gmail.com.

In case any of you have already served the notice or are contemplating to do so and are further ready to go to the consumer court, please allow me to join you.

Hi guys,

I am preparing a draft agenda points which will be a base to represent our case in front of any authorities, BPTP, Court, Media. I would share it soon as google doc on this forum. I would request all of u to go through it and provide me your valuable feedback so that I will incorporate all your suggestions into it.

There is one more request to you, if any one knows a good lawyer who has work experience in property related case, please let me know. We have to finalize the draft by friday and saturday we are planning to discuss the matter with a good lawyer. Meanwhile BPTP is providing the new dimension certified by their architect so I would request you to ask these detail in writing from BPTP. These document are essential to fight the case in consumer court.

Here is small story........

As my friend was passing the elephants, he suddenly stopped, confused by the fact that these huge creatures were being held by only a small rope tied to their front leg. No chains, no cages. It was obvious that the elephants could, at anytime, break away from the ropes they were tied to but for some reason, they did not. My friend saw a trainer nearby and asked why these beautiful, magnificent animals just stood there and made no attempt to get away.

"Well," he said, "when they are very young and much smaller we use the same size rope to tie them and, at that age, it's enough to hold them. As they grow up, they are conditioned to believe they cannot break away. They believe the rope can still hold them, so they never try to break free." My friend was amazed. These animals could at any time break free from their bonds but because they believed they couldn't, they were stuck right where they were.

Like the elephants, how many of us go through life hanging onto a belief that we cannot do something, simply because we failed at it once before? So make an attempt to grow further.... Why shouldn't we try it again?

I would reiterate to update/enter your contact details on following excel sheet to unite all the Park Elite floor buyers from all of your contacts. We will send them sms about the date, time and venue of meeting with lawyer.

We should first file a formal complaint to DC , copy to DTP.Then we will meet a lawyer on sat to discuss the legal angle in the matter. Accordingly when we are having solid agenda points, documentary proofs then we will move to court & approach media. We also need active support and guidance from the active members of GFWA to make our fight concrete and to ensure success in this case because this is becoming a tool for every builder to charge exorbitant money from consumers who are abide by the agreement.

Hi friends,
One more burden on your pocket, an internal news is received from BPTP official. very soon(in july month) a new demand is about to be raised by builder on account of increase in EDC/IDC charges(double from existing). Be prepared for additional Rs 1.2 to 1.5 lac. It is also come to know that at the time of possession the total cost of unit will be increased again up to 10% under the cost escalation clause of agreement. This is in addition to registration charges(5-7%) will be collected by builder. Now the unit price will come almost equal to market price at the time of possession. Is it the "quality housing at affordable price" as promised by builder during the advertisement 2 years before in E-brochure. I have soft copy of that E-brochure, if anybody need it I'll send it through mail as its size is large. I m also uploading application forms terms and condition agreed at the time of booking for ur ref.

we should support and contribute in big numbers for GFWA fund to file case for EDC very soon.

Dear All,

Good to see so many members coming forward and uniting to fight against the mal-practice done by BPTP.
We have already submited few complaints to the DC and DTP. Incase you need GFWA to file complaints on the project specific issues, please provide the write-up as per attached format.

None of our complaints have been addressed till now and we surely have to file legal case against BPTP. Since BPTP has got political backing, I request Mr Rajinder Chaudhary (Deputy Secretary, Ministry of Consumer affairs, New Delhi) to come forward and advice us on way forward. Mr. Rajinder has invested in BPTP and been impacted by their unprofessional approach.

Incase, anyone has already file the court case, request them to include all other members as collectively we would be able to present our case stronger and support each other.

We do not have much time left and need to act quickly. Lets unite together and fight against this injustice.
