Haryana lays down details mandatory for realty ads

New Delhi: The Haryana government has made it mandatory for all private realtors to specify their project licence number, layout plans and the total number of apartments to be built in their advertisements.
Any failure to do so could invite a three-year prison term, said a town and country planning department (DTCP) notification on Friday. The rule will come into effect immediately.
Haryana is the first state to introduce such a regulation. Mushrooming projects have prompted realtors to put
catchy advertisements often overselling their projects and sometimes giving sketchy details. Analysts say this move will help bring transparency and provide home buyers clarity to help make a choice.
“Private developers have been putting out all kinds of advertisements, and in many cases buyers are clueless about whether these projects are approved by the government or not,” DTCP director general T C Gupta told TOI.
There have been complaints galore to DTCP from buyers since they are worried about the projects’ authenticity. “People spend their lifetime savings to buy a house. We can’t allow developers to loot people like this,” Gupta said while interacting with realtors in Delhi. As complaints of fraud grow, Haryana reins

Haryana industry secretary Y S Malik agreed with Gupta. He said he has been flooded with calls from harried buyers. “I have been receiving calls from several people, seeking projects’ details. I would often take DTCP’s help to gather the information,” Malik said. Officials are concerned about growing complaints of fraud. “Several FIRs have been filed with Economic Offence Wing of police in Haryana and other states,” DTCP’s Gupta said. He cited several examples, where builders had sold apartments well above the licencing authority’s sanctioned limit.
Gupta said he has asked district town planners (DTPs) across the state to file FIRs against violators. “I’ve asked each DTP to get an FIR lodged every week. There will be no compromise,” he said. Realtors welcomed the move. “It’s a historic move by any state. It will help clear the dirt. People will have greater faith in the industry,” Navin Raheja, chairman of ASSOCHAM national council on real estate, said and urged other states to follow Haryana’s example.
DTCP has cleared maximum files related to change of land use (CLU) – mainly for residential purpose – in the past year. “We’re compiling a list of such CLUs in the past two years. These will be posted on our website so that people get a fair idea of the projects,” Gupta added.

Thanks Manish for sharing this. This is published in today's TOI also. Scan copy is attached.

Now this can be used by all buyers to demand required proofs of licence of project which builder are not sharing today and declaring that these are their confidential documents. Just to share that RPS is still not ready to send copy of licences and layout plans and forcing buyers to come to their office to verify these documents.

This is an excellent news !! Imprisonment of 3 years will definitely deter builders.

Haryana has become first state in India to adopt some of provisions of Real Estate Regulatory Bill :-)

I can confidently say that GFWA and myfaridabad forum has also made some contribution in achieving this. Builders have started putting some of details in advertisements. Also, advertisement by BPTP clearly states that all approvals can be checked in their office. So, now builders have NO right to say that check the approvals at DTP office.
But there is a catch, BPTP has said that still minor changes can occur. Who will define and how will you quanify those minor changes?

Let us check how these mandatory guidelines are getting followed by developers. Biggest developer in Faridabad has come out will full page ad of launch of new tower called 'The Deck' in Park Grandeura. While specifying licence details, approval dates and number of nursery schools in fine print at the bottom, it also added one line at end.

".....Site plan and unit plans are subject to change that may occur during course of construction based on working drawings which shall be regularized by developer"

It seems from line that developer can play manipulative increases in super area etc. and exploit buyers. Also, how can developer be sure that whatever changes he has done will be regulaized by DGTCP? Has he taken Govt. and buyers for granted?

That needs to be brought to the notice of DGTCP

Atleast the builder has openly admitted that he is authorized to change layout, before people start to fall in trap... That reminds of the builder complaints submitted last year on layout changes (along with others issues), to which the authorities had come out with a report citing builder is free to make desired changes after paying due fee.... well we all know what this fee is... when the money is pouring at all directions, its not difficult to shut eyes or make necessary amendments to allow such dupings.. After all who has cared for middle class creatures like us.....

Hope these officials are keeping there general awareness up and know that people are not ready to accept such corrupt practices for long, we want accountability from Builders, Officials, Government and anyone or everyone, who has taken money from us, and will do everything possible to ensure accountability on the services.

DTP (HQ) Chandigarh informed now developers in Haryana are also instructed to specify number and type of schools that will come up within Housing society in advertisements. This has been done seeing the large number of complaints from buyers that developers hide schools when selling houses. Advertisements are getting audited by department. So, if someone finds advertisement of builder in Haryana that does not comply to these regulations to bring this matter to notice of department of Town and Country planning for necessary action.
