Dear All,

I am planning to file RTI for below points for BPTP Park Floor II, Sector 76. I am right now preparing a draft of the RTI application, so any help will be greatly appreciated.

1. Seeking License number and other details of License.
2. Project approval related document with applicable date etc.
3. Copy of the approved plan with any latest changes.
4. Any special conditions for approval.
5. EDC/IDC charges collection amount with details till date.
6. Our option of sorting disputes with builder - with exact name and address.

Please let me know, if anyone has already filed anykind of RTI or is planning to file the same with Chandigarh DTP.

I have been allotted L1-08-SF floor in Park Elite Floor and received the enhancement of approx. 3.75 lacs towards increase of super area. There is no increase in the area in actual and its only the greed of builder which has resulted in this price to tap whatever little premium market is offering now. For the last 2 years, this project was not attracting any premium and just when the things were looking up, builder's greed has bought this.

Anyway, i have already filed a case in the consumer court of Delhi central ( covering CP ) and hearing is due on 19th Aug. 2011, however i have decided not to make the payment which is getting due on 15th July 2011.

Consumer court is very slow process.....we are planning to file stay writ thru Delhi high court on this increased super area demand....

नहरपार निवेशकों की शिकायतें एक हजार, कार्रवाई कुछ भी नहीं

वर्षों से आशियाने की बाट जोह रहे नहरपार निवेशकों ने प्रशासन को बिल्डरों के खिलाफ एक हजार से अधिक शिकायत दी हैं, लेकिन अभी तक कोई कार्रवाई नहीं हुई है। आश्चर्यजनक बात तो यह है कि यहां फ्लैटधारकों ने अधिकारियों को बिल्डर्स के खिलाफ पुख्ता सबूत दिए हैं। बावजूद इसके अधिकारी कार्रवाई करने को तैयार नहीं है। एक साल से निवेशक लगातार सरकारी दफ्तरों के चक्कर काट रहे हैं, लेकिन अभी तक इनको केवल आश्वासन मिला है। अधिकारियों के पास बिल्डर्स के खिलाफ शिकायत देने का सिलसिला जारी है। इस समस्या को लेकर कई बार निवेशक हंगामा, प्रदर्शन व नारेबाजी कर चुके हैं। पर, इसका कोई असर नहीं हुआ।

इनके खिलाफ है लड़ाई : नहरपार सेक्टर डेवलप कर रहे बिल्डर्स ने लोगों से फ्लैट के बदले दाम लेने के बाद अपने वादे को भूल गए। यहां बड़े गु्रप सक्रिय हैं। इनमें एसआरएस, आरपीएस, बीपीटीपी, त्रिवेणी, पीयूष, ओमेक्स, शिव साईं गु्रप, एरा सहित अन्य शामिल हैं। आशियाना के चक्कर में रुपए फंसाने में जिले के लोग काफी कम है, जबकि दिल्ली, नोएडा, गाजियाबाद, गुडग़ांव के लोग अधिक है। यहां पांच साल से लोग इनके पास फ्लैट बुक करा रहे हैं। निवेशकों का आरोप है कि बिल्डर प्लाट बेचते समय जो वायदे करते हैं, उन्हें बाद में निभाते नहीं हैं। बिल्डर्स के खिलाफ धोखाधड़ी के केस दर्ज होने का सिलसिला जारी है।

बिल्डर्स के खिलाफ लड़ाई के लिए कुछ निवेशकों ने नहरपार ग्रेटर फरीदाबाद वेलफेयर एसोसिएशन गठित कर ली है। इस एसोसिएशन के प्रधान जयंत बरुआ, अजय यादव, धीरज जैन, सीमा जोशी का कहना है कि वे सभी शिक्षित हैं और जब उन्होंने यहां निवेश किया था तो उस समय एग्रीमेंट हुआ था। उनके व बिल्डर के बीच में सभी मूलभूत सुविधाओं को लेकर सौदा हुआ था। इसके बाद न तो समय पर फ्लैट्स का निर्माण हुआ और न ही अभी तक यहां कोई सुविधाएं मुहैया कराई गई हैं। यहां तक कि बिल्डर अब उनसे बात करने को भी तैयार नहीं हैं। इस बारे में जिले में डीसी, हुडा प्रशासक, एसटीपी व डीटीपी को कई बार सैकड़ों शिकायतें दी, लेकिन अभी तक कोई कार्रवाई नहीं की गई। डीसी के आदेश पर एक बार बिल्डर्स को मीटिंग में बुलाया लेकिन इसके बाद क्या हुआ, इस बारे में कुछ नहीं पता।

I appear to be utterly confused and nervous as the deadline approaches. It seems that there are two or may be more groups who aspire to take legal route but I don't see any plan of action from anyone. It could be that people are not posting on this forum, for reasons we all know. But, in that case, we have high chances to be out of sync with one another.

Please confirm if any group is working and the plan of action asap.

Dear All Affected persons of Park Elite Floors ,
Agreed with the opinion of Avinash,that Intially we were jolted with the sudden escalation of price by BPTP. But after making so much of hue and cry ,no concrete course of action have been formulated till date.Intially we met on 2nd july at Saket court,but the layer chosen there was dismissed when the proposal went to bigger group.Also,the group that were intially pumped up, have now cooled their heels down.Alright we are searching for another lawyer.But in the meanwhile, we should draw inspiration from sufferer of Greater Noida .As on date we cannot say what lies ahead in their luck,but they have got good coverage through media through TV and today almost all the newspaper have given the news on their front page.This happened only due to people taking to street in protests.In my opinion, till the time we are searching for lawyer we also take to streets with banners and all that and walk in protest(Peaceful) to illegal demand by BPTP.Others are advised to to respond.
