Hi All,

As you all might be aware, we have sent a email letter to RPS Group, addressed to Mr. Rajesh Jain on 27 Feb 2010 requesting for a meeting to discuss some basic issues regarding the Savana project.

Dear Mr. Rajesh Jain,

Warm regards from the Savana forum. It is an immense pleasure for us to inform you about the conception of the Savana forum, a resident community forum exclusively for the residents of RPS City. This forum has been created as a platform for the residents of RPS City to interact with one another and build a constructive environment and society. We believe that this forum will be instrumental in building a strong relationship among the members and the RPS Group.

Having said that, at the very outset we would like to state and reiterate that the forum has not been created as a community against RPS Group, but as a community to facilitate the members and RPS build a better and stronger society. We would not want anyone to have a preconceived notion about the community, rather join us in our journey forward.

After the recent RTI information being published regarding the development of Naharpar area and the delay in Savana project, there is a growing apprehension and concerns among the Savana owners which we would like RPS Group to address at the earliest before it fuels more rumors and panic among the members and prospective customers. We understand that RPS Group is trying its best to complete the project at the earliest and also appreciate the fact that you have been regularly publishing construction update pictures. We have no intention of interfering or pressurizing RPS to complete the project at the cost of compromising quality of construction, we trust and believe in RPS to deliver its promises as per agreed standards.

However with no signs of infrastructure development seen in the area from the authorities and the RTI response stating that work might begin in 2013, and the Savana project also nearing completion, it is of great concern how RPS is planning to cope with providing the basic amenities like water and electricity to the Savana residents once the project is complete. In this regard, a few members of our forum would like to arrange a meeting with RPS group to discuss these core concerns and provide any assistance if required from the members. We can assure you the discussion will be completely healthy and constructive, every member is educated and civilized to act responsibly. We also understand that some of these factors would be beyond the control of RPS Group, so we as residents would want to extend our support and provide any assistance to RPS if required to help us overcome these issues together. This gesture from RPS would go a long way in comforting the savana residents that their investment and dreams are in goods hands and will reassure end-users and prospective customers. The RTI responses have been a great dampener to the hopes and spirit of several thousands of customers in the Naharpar area, there is a lot of apprehensions and uncertainty floating around regarding the Savana project which is affecting the brand image of RPS Group as a reliable builder if they will be able to live up to the expectations and promises made to customers, which in turn impacts our image being the end-users who have invested in RPS and Savana with their life savings.

An official response and reassurance from RPS will be an immense boost to the confidence of the residents and be a great help to prevent any further uncertainty regarding the Savana and other RPS projects. We will greatly appreciate this gesture from RPS group if we can have this meeting and get an official version from RPS. As I mentioned earlier, please be assured that the meeting will be completely healthy and constructive. It can be held either at the RPS office or Savana site as per your convenience. We believe that our concerns are justified and reasonable and deserve the requisite action. This letter is not an offshoot of our emotional outburst but rather is a proactive approach towards finding a solution.

We look forward to your co-operation to start this relationship on a positive and good note. You considering this letter will be much appreciated as your actions with respect to this recommendation will have a direct bearing on all future correspondence and dealings with all Savana residents.

Minutes of the Meeting March 24, 2010 with Mr. Rajesh Jain

After our meeting request to RPS Group to discuss the common concerns of the Savana members regarding the project, we were invited by Mr. Rajesh Jain ( DGM Commercial) to address some of the concerns. Five members of the forum met with Mr. Rajesh Jain on 24 March 2010 at their Okhla office.

The five members were

1. Jayanta Barua
2. Ajay Kumar
3. Seema Joshi
4. Gaurav Gupta
5. Pankaj Bhasin

We were not able to get any conclusive or transparent clarifications from Mr. Jain as he avoided any fixed commitments from RPS. The following issues were discussed,

1. Green To Construction Ratio –

RPS Savana will not have the 85:15 (green:concrete) ratio anymore as the most of the green areas promised and advertised in brochures earlier have been allocated to schools and a dispensary. The main green area near the entrance which was earlier marked as a Theme Park, 5 acres has been allocated to KR Mangalam World School for a high school and 1.25 acres has been allocated to a Dispensary. The 2 green areas between Bluebeech and Bayberry towers have been allocated to primary schools. (Please see the attached maps for reference)
When enquired about the change of plan from the initial advertised master layout without intimating the Savana owners, they said as per DTCP (Directorate of Town & Country Planning Haryana) schools and dispensary falls under basic amenities which need to be provided by RPS to have the master plan approved by the authority. Has sold another tract of land within Savana earlier shown as badminton, tennis courts, as commercial land. They said they are not liable to inform any Savana allotees in any change of plan to the master layout.

2. Possession –

No clarity given for the entire project, they said RPS is targeting completion and handing over possession of the following towers by end of 2010 which is indicative

3. Construction Quality –

Quality of construction is being followed as per NBCC guidelines, 4 Contractors have been engaged by RPS for construction of various towers, refused to divulge the names of the Contractors. Quality checks are conducted by 3rd party. Not open at all to allowing owners to visit the actual building site. Names of these agencies withheld.

4. External & Internal Development –

Regarding basic amenities like electricity, water and sewerage, RPS is also not too optimistic about getting regular supply from the government in the immediate future, indicated might take 2~3 years for govt. to provide supply. Till that time RPS will provide on a temporary basis while handing over possession, the cost of which will be borne by the customers. They said they have highlighted the issue to the authorities and Mr. Jain provided us a copy of the CREDAI NCR Meeting notes in this reference. (Check attachment)

5. The govt has announced/ proposed reduction in EDC/ IDC – how will this amount be adjusted in the final payouts by owners.

Has no ‘formal communication’ from the authorities. As such any reduction will have to be paid back/ adjusted by all builders including RPS.

6. Internal Development : internal roads, greenery and plantation etc (how much time this will take)

Though he has said one year, we all doubt if RPS can even deliver.

7. Access road to Savana – when will it be widened, completed.

No Clarity



We asked for some specific information from RPS which Mr. Rajesh Jain promised to provide us soon,

1. Estimate of running cost for maintenance(electricity, water, sewerage, etc.) after possession in absence of facilities to be provided by government.
2. Exact dimensions of the proposed green areas, parks, swimming pools, club houses, etc..
3. Final approved map of Savana layout with the proposed new constructions.

Everyone is welcome to express his/her opinions on the issues highlighted after deriving their own conclusions. We do not wish to impose our thoughts or views on the entire group about the future of the project. People might perceive the news as good news or bad news depending on their perspective.

Let the thoughs flow..


Going forward, requesting everyone to start posting on the forum for any news that you want to share, any information that you require or any opinions that you want to express. The forum helps us to keep a record of each and every information that we want to publish regarding SAVANA, also it’s easier to navigate through the forum as all the information is recorded as per the chronological chain of events happening instead of several emails floating around and important information getting buried in our mailbox. I understand posting on the forum requires a little more effort than just shooting off an email, but we would need to give that little extra effort to make our forum stronger. Every bit of information that we publish on the forum gets published to the entire world through search engines, just like you found this forum on the internet, we would like everyone to find us on the internet.

Also as mentioned earlier, everyone is free to express their opinions on the forum, but without hurting anyone’s feelings or personal attacks on one another. We would be very disappointed if the forum turned out to be a slugfest which will defeat the entire purpose of creating the forum. Let’s try to contribute something constructive on the forum and avoid posting assumptions which will fuel panic and rumor. The last thing that we need right now is to spread uncertainty among the members and break the morale of the members who still have hope left in the project.

Thanks to you and all meeting member for your efforts.
I think at individual level we might not get this much information from RPS.

Whatever is happening is certainly not very good.
This is high time to make this forum a legal association.


Any way there is no comment on penalty clause.
Did you get a chance to talk about it with RPS.

Dear All,

We all had been eagerly awaiting the minutes of meeting. Its very disappointing to see that the builder has breached every agreement.

I strongly suggest that the resident members in this forum should come forward and form a legal association and start taking up all the concerns with the authorities.


Personally I feel like taking RPS to court. I bought the flat only because of 85:15 Green:Concrete ratio. Please do not take "taking RPS to court" seriously. I am just taking out my frustration of investing so much time, money and effort towards this project.

We mainly debated on the Green:Concrete issue, could not talk in detail regarding the penalty clause.

Dear Sanchay,
After attending this meeting with Rajesh, even i am of the opinion of taking a legal action. We have paid 70% of the money and that, too on trust but the picture which emerged yesterday is quite disturbing.

We should hire a competent lawyer who will help us form the owners' association.
One of my friend's brother who is a fairly experienced lawyer, has done similar cases. He will meet us shortly and advise on the way forward. He is out of station today - have given him the gist of the situation.

As per him this is not new with builders and even the big ones have done this earlier. Being thick skinned, they don' t give the correct answers to individual owners as they know one-two persons can't do anything.
Only when the owners unite have they been able to get their due. And we have to act fast, as much before the possession starts, the construction of the school and hospital will begin. Once they start it will become difficult to get a stay on this additional construction.

Considering these builders have their backs covered with a bevy of lawyers, govt notifications, officials,etc. we have to be a SINGLE unit if want all what was committed to us while purchasing the flats.

After that, the association can initiate legal action.
There will be cost implications on the association on hiring, paperwork, filing, etc, which all members will have to equally contribute to.

Second, we will have to use the media effectively down the line, be it electronic, web or print. This will be a big help to our case and give due coverage.

Why did RPS show this land even to the buyers when the Master plan was not approved earlier. I dont think master plan would have been approved recently considering more than 50% of construction is over. A cheating case should be filed against RPS as even now their site shows that the green areas are part of the apartment.

I dont think cheaters like RPS would have given this land to anyone for free. It is a good business to tap buyers and make them fools as the laws of our great country are in favor of these cheaters.

If RPS cannot provide electricity or water why did they even sell the flats. I dont think Rajesh jain would live in a apartment where there is no electricty or water.

Its apparent that RPS Group has sold the land from RPS Savana to KR Mangalam World School. I think we should also try to get a confirmation from the KR Mangalam School authorities about their plan in RPS Savana.
Mr. Rajesh Jain said that if they did not setup any school or hospitals in RPS Savana, DTCP would not have approved the Savana plan.

I have not seen/heard of apartments where Planning authorities have asked for this kind of thing. If this is true all the apartments in India will have a hospital/school/clinic inside them. They may someday ask to put up a small slum inside some of the apartments ;)

RPS is lying and trying to make more and more money. Did they tell when the labd was actually sold and why they are showing this as green area even now on their site?

I am highly disappointed after our meeting with Savana Management

Its high time for all of us to leave our submissive behavior behind and be highly assertive about our rights as consumers, Their website still says 85 % green .. and RPS management think they can easily make a fool of all their customers..


Secondly, There are a couple of items that Mr Jain is supposed to provide us by 7th April, I think we should send him a minutes, that would help in records perspective

Its obvious that RPS Group is blatantly lying, they must have had plans for selling off the land since the very conception of RPS Savana. Once they enticed all the customers showing a green picture, they sold off the land to KR Mangalam School.

Mr. Rajesh Jain was trying very hard to convince us in vain that its the requirement of large housing complex and we can go ahead and enquire from DTCP about the requirements.

Its a well known fact that ethics and real estate builders is a joke, they are in the business to make money, and RPS Group is no different. And we all fell for it.

This is very serious situation & needs to be tackle with joint efforts from all of us. I am too agree with Mr. Pankaj for initiating legal action against the builder. We should form the association ASAP to fight with builder, otherwise savana will be look like ordinary unplanned society.

I would suggest that lets define a time by which everyone post their thoughts and suggestions and possibly by next week we need to chart out atleast at high level on actions

I understand it might not be possible for everyone to join in, but it would help if we schedule an internal meeting of people who are based in Delhi/NCR to decide out on a plan of action.

Indeed this is frustration. The situation is like love it or leave it!!! We need to do the following things ASAP.

1) Formation of a Legal Association of SAVANA Flat Owners.
2) We need to consult a legal Professional on legality on the transaction done by RPS
3) The Pandora's box has just opend so we have see waht more surprise gifts RPS is going to us and how to prevent them.
4) Most Priority is that possession of all the towers not only 8 Towers.

Though I am based out at Mumbai I am ready to provide remote support as and when required and also fly down to Delhi if required.
