Dear All

I am putting some points to discuss with the media on Friday. Please suggest if you have any more and let us stick to the agenda without getting diverted to other personal issues as discussed in the previous email.

1. BPTP promised units in A & B blocks of Parklands, which is Sector 85 according to HUDA. However, BPTP alloted units throughout the parklands prject from sector 76 - 85.

2. BPTP at the time of selling did not mention any other preferential location charges, apart from Rs. 1.25 lakh for ground floor units. However, later on it raised demands for park facing, corner units, units on roads wider than 12 m and so on. This is breach of trust.

3. BPTP also got an amendment signed from all buyers with revised condition for handover/possession.

4. BPTP also got an undertaking signed from all buyers, absolving itself from any future liabilities.

5. BPTP now has written to almost 4,000 buyers to deposit around 3 lakh rupees each for the increased common areas in the units. BPTP is not providing us with exact measurements and nor is BPTP telling us what these areas are. The increase in area is almost 20% and is against the HUDA guidelines for FAR.

BPTP is engaing itself in systematic extortion without any concrete promises. The floor buyer agreement is heavily loaded in favour of BPTP where terms like "tentative" are frequently used. In the agreement there are no fixed timelines for completion and no dates for possession.

We would like the media to convey our grievances to the authorities and save our investments.

Thanks a lot for your efforts. I shall try best to come on Friday. What is the tentative time ?

As regards points against BPTP. I think BPTP has done a very big fraud on us. If the super area is what which is being claimed now by BPTP, then why BPTP did not mention it in the prospectus ? Why a very less super area was shown ? There was a hidden purpopse of BPTP at the time of allotment. That was the time of recession and no body was committing funds in a costly project. BPTP highlighted the Elite Floor Project as a low cost housing project offering 3 BHK in 16 L. This was a tempting offer to everyone and in return BPTP got a huge response. Had it mentioned the actual super area at that time....it would not have been able to sell even half of its units at that time. So a cleverly laid out plan was made to trap 4000 buyers. BPTP opened its cards only after collecting more than 80 % of payments from us and after getting our signatures on the one sided agreement. Then raised its super area. A CLEAR CASE OF FRAUD AND CHEATING..... UNDER BROAD DAYLIGHT ! And Rahul Gandhi is appreciating the policies of Haryana Government on land and builders. Can Mr. Rahul Gandhi read the whole case of BPTP Elite Floor trap and give his decision ? I am sure he will not. Because we are not Kisaans !

Should we also not post a question to Mr. Rahul Gandhi in the press on his views on BPTP Elite Floor trap ? The iron is hot and it will work. May be we shall have to shell out money on getting our questinaire printed in the press as an Advertisement. Mr Rahul Gandhi has praised the Haryana Government on its policies on land reforms. If we are able to highlight this case in a National Press then I am sure Haryana Government will enter in this case and get us the desired big relief.

Dear Mr Gopal

I think we should take one issue at a time. The problem at hand is our investments in BPTP not Rahul Gandhi's view of Haryana Govt. Talking about Rahul Gandhi will divert the focus from the problem and the reporter might get disinterested. We can make a reference to Rahul Gandhi's statement but I personally feel that we should not make an issue out this.

Let us stick to our concerns and try to make the most out of the opportunity we have.

Dear Friends,
I believe our issues are not being highlighted by the media becasue I did not see any posting in any newspaper. Faridabad is the least developed area among all NCR cities and still no body is caring our issues whether it is media, govt, HUDA. I saw the news of noida extension in various TV news show but Faridabad news is no where.

We are being cheated from years not only by the builders but HUDA, Govt and now villagers are coming with their unwanted issues. Farmers had taken all the money and we had deposited the huge amount to the builders / HUDA but it is regret to say that still a single panny is to be spend.

Why Faridabad is being neglected and we are not getting the value of our money. In Noida, peoples had started to live in Greater Noida which is 20 KM away from the Delhi but Faridabad is still not a good place to live and it is becasue of poor infrastructure and amenties.

The main cause of lacking the GF area is that HUDA did not find it lucrative becasue farmers had directly got the money from Builders and they are getting only IDC / EDC and they are spending our money for other region of Faridabad because they dont have revenue to spend.

I beleive Govt should look after our issue and should approve money for the developement of GF becasue we pay taxes.

I saw one news in channel that Mayawati had approved 300 crores of rupees for the KHODA area. This area is something like slum area. In noida / Gnoida, Govt prepared good roads, infra then they called the peoples to live. But here GANGA IS FLOWING IN REVERSE DIRECTION. Buyers are ready to live, builders had depoisted the IDC / EDC but still the place is like hell.

Hope no body will like to live there and it seems that buyers has to wait for next 5 years to live there becasue I dont think so that this place would liveable before that.

Now only the HUGE RESPONSE FROM ALL OF US can make some changes and it is only possible if we unite and try to do some additional effort. We are sharing our views through this website but where is media.

Those people who are going to meet the correspondents on Friday. Please raise this concern as well that BPTP has not allotted units to lots of members after giving their hard earned money.

UNJUSTIFIED AND ILLEGAL DEMAND BY BPTP : Ten Clear-Cut Disturing Questions

This is to bring into the kind attention of media that BPTP has done a big injustice to its customers of Elite Floor Project (BPTP Parklands, Faridabad) by raising an additional demand of Rs 4 to 5 Lacs for its 4,997 units consisting of 180 sq. yard, 250 sq. yard and 300 sq. yard size. For this unjustified and unexpected demand, BPTP has cited the reason that with construction at an advanced stage, super built up area has been measured to be 150 to 200 sq-ft more as compared to mentioned at the time of booking. Interesting point in this is that carpet area has not increased at all. As per BPTP, common area (consisting of Shaft, Mumty, Common service terrace, canopy, boundary wall etc) has increased during construction. Moreover, BPTP is not giving any exact details and justification for this increase of super built up area. On doing queries, BPTP just gives reference of the word “tentative super-built up area” which they have put in Builder-Buyer Agreement, signing on which was not at all optional. Customers are shocked and confused. Media is requested to give voice to this injustice.

From a middle class layman BPTP customer perspective, following are the disturbing issues:

Cost of the house should not increase by 5-6 Lacs as compared to the amount which was advertised on the time of booking, highlighting the Elite Floor Project as a low cost housing project due to which 4900+ customers had opted for this project. Now market being up, is it valid on part of BPTP to raise the cost of these units by 5-6 Lacs.

How could BPTP, having qualified architects and civil engineers, not foresee this 200 sq-ft increase of common area, not even during construction. Proposed construction plan and proposed drawing needs the approval of HUDA Authority, which is another stage of checking. Does this not reflect that mistake is not incidental ?

If this increase of super built up area comes out to be say 500 sq-ft, in that case, will the customer have to pay Rs 10 Lacs more without increase of a single sq-ft of carpet area ?

If customers bow before this unjustified demand and pay it, is there any assurance that BPTP will not ask for further money with same or similar reason ?

Does “Tentative increase” of super built up area as mentioned in agreement have no upper limit? Can this deviation be of 15-20% ?

Why “Super Built Up Area” terminology was not there in the original booking application and later in Builder Buyer Agreement? Why it was introduced later as an “Addendum” to agreement? Was consent (including option of not going for it) from the customers regarding this new term taken?

As per the clause no.1.15 of the Builder Buyer Agreement, the Final Super Buildup Area of the Floors shall be determined after the completion of construction of the said colony. This stage is yet to come, even then BPTP has asked money for increased super buildup area. Is it genuine?

As per Clause No.1.3 and 1.4 of the Builder Buyer Agreement, if the super built-up area will decrease, then the amount will be calculated on the Basic Sale Price and if the area will increase, then the increased area will be charge from higher rate (Rs.2,425/-). Is this double standard not a method just to to be beneficiary in any case.

Most of the customers had taken loan for it. Even financing bank requires justification and proof about the increases area to finance additional loan, in absence of which, it denies the payment. How will they convince their respective banks?

Company has not intimated to the Bankers/Financial Institutions about the increase of super buildup area and not got re-sanctioned the revised plan and Value of the project. It is normal practice in Real Estate, that the Builder gets sanction/approval from financial institutions. Why BPTP has not done it ?

बी.पी.टी.पी. फरीदाबाद का मनमाना गोरखधंधा

बी.पी.टी.पी. बिल्डर ग्रुप का फरीदाबाद के नहर पार क्षेत्र में "पार्क लैंड एलीट फ्लोर" नाम से एक प्रोजेक्ट चल रहा है जिसमें प्रारंभ में बुकिंग के समय ग्राहकों को 1203 वर्ग फुट सुपर बिल्ड अप एरिया के हिसाब से 1860 रुपये प्रति वर्ग फुट की दर से 250 गज के फ्लैट देने का वायदा किया गया था ! इस मूल्य व बी.पी.टी.पी. की साख को देखते हुए बहुत बड़ी मात्रा में लोगों ने ये फ्लैट ख़रीदे परन्तु अभी पिछले सप्ताह ही कंपनी द्वारा एक जोरदार झटका सभी ग्राहकों को दिया गया ! कंपनी ने कहा कि फ्लैट बनाने के बाद पाया गया है कि सुपर बिल्ड अप एरिया 1203 से बढ़कर वर्ग फुट हो गया है, इसलिए सभी ग्राहकों को इस बढे हुए 191 वर्ग फुट क्षेत्र का मूल्य बढ़ी हुई दर से देना होगा जोकि लगभग 4.75 लाख बनता है ! सवाल ये उठा है कि कंपनी को इतने दिनों बाद ही बढ़ी हुई जगह के बारे में क्यों पता चला. हर ब्लाक में उसने पहले सैम्पल फ्लैट भी बनाएं थे , क्या उस समय भी ये पता नहीं चल पाया . इतनी बड़ी गलती इतने बड़े ग्रुप के सिविल इंजीनियरों से हो जाये और वो भी सभी फ्लेटों में, यह अविश्वसनीय है | ऐसे समय में जब फ्लैट पूरे होने के नजदीक हैं, कंपनी द्वारा इस प्रकार की अनुचित मांग करना केवल ग्राहकों की असहायता का फायदा उठाना ही है. 4000 से भी ऊपर ग्राहकों पर यह मार पड़ी है या पड़ने वाली है 7 मेहनत से कमाया गया धन इस तरह के मनमाने गोरखधंधे की बलि चढ़ जाये , इससे बड़ा भ्रष्टाचार और क्या होगा ?
