Dheeraj ,

Really this is very good news. But next date being 06-sep, then we all might have to give Enhanced EDC charges to respective builders.
For RPS it might be the end of Aug.

My view is that we should not pay the EDC amount until the decision comes from court.

The bottom line is that we failed to get an interim stay!!!!! which is not good !!! did the layer prayed for a interim stay till the hearing started??

Any update on this, i have received the letter yesterday about payment of the increased EDC charges and the last date to submit is 25/08/2011. Also, OMAXE has increased the super area of the 3 bedroom apartment. if the Area goes up then everything goes up with it.

Most of the 3BHK people have started getting the enhanced EDC letter and about increased super area we all were well aware that it has to happen .Get ready for many more things which is already been faced by 2 BHk people.
FYI our Omaxe heights RWA has sent a request letter to Omaxe to exend the date of payment the way it has done earlier.Whatever will be the outcome it will be updated to the members of RWA.

lot of thanx for posting the updates regarding the petition. Is our side attempting to get the stay on the demand of enhanced EDC too ? May we get the stay after two or three hearings ?

Hi All,

Everyone should ask their builder :

- Whether they have deposited EDC that they collected originally from buyers to Govt.?
- If yes, how much EDC amount they collected and how much they actually deposited to Govt.?
- When they submitted?
- What is the basis for demanding increased EDC? Ask them to show letter sent by Director, Town and Country planning addressed to builder and which specifies due date.

Most of builders in Greater Faridabad collected EDC from buyers way back in 2006 but deposited only in 2009-10 after their licences were cancelled by DTCP for non payment. In a way, builders are equally responsible for non-development of Greater Faridabad as they collected EDC from buyers and invested that money in their other projects.

Hi Dheeraj,

I am unsure if the builders will be willing to answer our queries as individuals. Can GFWA Core team drop notice to the builders on the letterhead demanding answers to the above. As a usual practice all the owners names shall be added to make the communication strong. It's time GFWA can take a centerstage as a body which is fighting for the rights of the common man, is an organized setup and can make a far more meaningful impact than any individual.

My experience of 3 years as an individual :

These guys have not even bothered to answer the most basic questions and surely looking at the implications of the queries you just mentioned I am quite sure that they will all but care any more.

Kindly float the ideas to all RWA's in case you deem it's meaningful.

I am also with the same view as these guys have a simple reply for individuals .They don't care.

Also for people like me who are not in India , it will be impossible to get details on Phone or in Mail.

No that they have got money , they can hung up without any respect for questions.

So i would also request GFWA team to drop notice to them.

Dheeraj,

I have had a few discussions with Shiv Sai regarding the issue of enhanced EDC charges. They have indicated the following during these discussions:

1. The builders had submitted an amount of Rs 12 crores to the Faridabad authorities against EDC. I am not sure when - perhaps a couple of years back?

2. The enhanced EDC is being charged separately so that in case there is a reversal of the decision, this amount would be refunded to the flat owners.

3. They told me about the GFWA (of which I was obviously already aware) and the pending writ petition af the P&H High Court. It seems they are also keeping a close tab on the developments.

4. The possession of Sai Park 1 Appts. will be done in May 2012.
