Protest against Omaxe builder on 7th August 2011

Dear all Omaxians

RWA ( Resident Welfare Association) of Omaxe Heights ,Sector -86 Neharpaar ,Faridabad organised the peaceful protest against Omaxe builder on 7th August 2011 at 11.00 AM. to highlight their grievences against the builder who is giving deaf ear to their problems and exploiting the common masses to all the extent

For protest more than 150 flat owners of Omaxe Heights assembled in the main park at the Omaxe Heights site itslf.In the form of a procession all took round of Project rounding 2bhk flats, 3hk flats ,main gate to main road along with media to show the infrasturcture , slow speed of work, poor construction quality. Everybody having banners and placards in their hand shouted slogan against the builders malpractices.

The main Issues/grievences of the flat buyers are:

1. Delay in Possession of Flats – Omaxe has failed multiple times in its written commitments of offering possession causing tremendous financial hardships in the form of paying rent and EMIs together to all the flat owners. RWA demanded possession of all the flat (2BHK/3BHK) at the earliest since the project has completed more than 5 years from inception.

2. Escalation of Registration Costs – As a result of delayed possession all Flat owners have to shell out huge sums of money due to enhanced circle rate implemented from year 2011 for no fault of them. RWA demanded Omaxe should bear this addtional burdern, as may be applicable if the flats were handed over in time.

3. Podium Charges – Omaxe has levied an additional podium charge to all Flat owners in the form of selling the roof of covered parkings for which money has already been paid by the flat owners. This charge was never discussed and agreed by the flat owners/ RWA and is an additional burden on the buyers which should immediately be scrapped/waived.

4. Penalty – Omaxe is paying Penalty to the first allottees on the basis of Builder Buyer agreement not on the basis of commencement of constructon. In case of transfer buyers Omaxe is considering construction period of 36 months from the date of transfer which is not justifiable, the fact is period of construction has no link with transfer of ownership. RWA demanded penalty should be given to all owers from 36 months from date of commencement of construction irrespective of whether he is original allotte or bought in transfer.

5. Change in Layout – Omaxe has indiscriminately changed the project layout which has completely altered the offerings promised at the time of selling the flats. RWA demanded that the same should be done post consultation with RWA and mutually agreed between all parties so as to avoid inconveniences to the end users.

6. Preferential Location Charges (PLC) – RWA demanded immediate reduction of PLC for all flat owners who have been adversely impacted by change in layout.

7. Quality of Construction – RWA is very concerned with the quality of construction in terms of seepages in all flats, quality of internal and external plaster, coloring without primer and water accumulation in covered and open areas within the project. RWA demanded immediate rectification of the above issues.

8. Increase in super Area – Omaxe has also charged additional area from all Flat owners causing additional burden to all buyers. Increase in charged area has not increased any carpet area to the buyers. Moreover the overall area of the project has also not increased. RWA demanded that such unlawful demands by Omaxe may immediately be revoked, this would adversely impact all flat owners in terms of maintenance charges post possession of flats on a recurring basis.

I came to know that protest march has been arranged by GFWA against some builders through news paper. But news paper not mentioned the name of builders for the reasons best known to them. I have already suggested that we should arrange such protest against each and every builders including HUDA and Haryana Govt.on each sunday in which all GFWA members and invester of Naharpar should participate. If such protest gain momentum than it will be very difficult for the builders to sell their unit further and they will be compelled to complete the projects for which they have already collected huge money and investing the same in other city.

Protest was organised by RWA Omaxe Heights and supported by GFWA for Media Coverage.
GFWA wants to do the same what you suggsted but for that first we need strength , more members .
Please help GFWA in uniting more and more members of different projects and contribute onetime membership for funds too.

Dear ms vineeta,

Pl suggest what to do incase of increased Edc charges since 12th aug is last date For omaxe & has rwa done followup with omaxe for waiver or extended date in view of petition .

I am planning to go to Omaxe office on Saturday to discuss about the increase in the Super area of the apartment and all other above points mention Ms Vineeta. If anyone else wants to join they are most welcome.

Hi Omaxe has sent a letter for demanding the extra EDC charges before 25th AUG.What is the STAND of RWA & GFWA on this.Should we pay it or weight for some finalization

As per my information, lets ask for extension time from them till 10th of Sept as there is hearing on 6th Sept and then only we will come to know the outcome and future action. i am planning to go there tomorrow to talk to them regarding the extension and clarification on the extended area.

I have written to omaxe (email & original sent through courier) to extend the date of remittance of enhanced EDC to 15th Sept'11, as the matter is sub-judice. Our RWA has also written to Omaxe, outcome is not known. I think individually too, we need to write to Omaxe & document all such correspondence, which may be useful at a later stage.
