Demand Letter of increased EDC from SRS even after taking possession

Yesterday, I received a letter from SRS residency sector 88 for the increased EDC charges. Below is the details mentioned in the letter:

"This is in reference to the allotment of flat to you. In this connection, we would like to bring it your kind notice that vide letter bearing Memo No. DGTCP/ACCTS./2011/803 received by us in the month of July, 2011 the Directorate of Town and Country Planning, Haryana, Chandigarh has demanded the payment of enhanced EDC.
After the aforesaid enhancement, EDC&IDC payable by you has been revised to Rs. 291 per square feet of area of your flat.

Additional EDC&IDC to be paid: 1,95,600 on or before 15th September, 2011.

I had taken the possesion of my flat in the January, 2011. I want to know can they demand increased EDC&IDC after giving the possion of the flat in January and this Memo was raised by HUDA in July, 2011? Could you please suggest me what should I do regarding this?

Yes, since increaed EDC charges are retrospective from 2005, builder can send you increased EDC charges letter even after taking possession of your flat. I will advise that please ask from SRS the following:

1. Memo No. DGTCP/ACCTS./2011/803
2. Increased EDC calculations. Should be a detailed audited one and should include all accounts of EDC starting from 2006.

Also, requesting you to share that scanned letter with GFWA legal Team. You can send to me at dheeraj.jain@myfaridabad.in or GFWA core group (core@myfaridabad.in) or you can also post on forum also !

Also, SRS residents, you have bee quiet for long time. Please speak up and share your scanned letters to get JUSTICE from Govt. and builders

All SRS Residency flat owners who are receiving the letters of increased EDC&IDC chareges,

I request you to be ready for the following:

1. As suggested by Dheeraj, ask SRS to give the details of Memo No. DGTCP/ACCTS./2011/803
2. Increased EDC calculations. Should be a detailed audited one and should include all accounts of EDC starting from 2006.
3. Because we have taken the possion few months back and had already spend lot of money in taking the possesion, paying 2 Lakh in a period of one month would be difficult for us. On GFWA letter, we should refer to the case in court regarding the EDC&IDC charges and request them to extend the date of depositing the EDC&IDC charges to at least 3 months. As the case is already in the court and we're pleading to take the stay on EDC&IDC by the court until court final judgement comes, we would get some more time.
4. I request all the SRS flat owners, who have received the letters of increased EDC&IDC charges to spare some time and meet SRS officials to discuss the above points and decide further action.

Yesterday, I too recieved the demand letter from SRS for increased EDC/IDC wherein I also took possession in Feb 2011, itself. Please guide me what should be my course of action in this regard as it is extremely difficult for me to pay 2 lakh rupees by 15th Sep.

In this regard, please be informed that ‘Greater Faridabad Welfare Association’(Regd.), a welfare association actively working in Greater Faridabad area forthe development of the said area, in which < Project Name> flat owners including myself are also Members, has filed a Writ Petition bearing No. CWP No. 14886 of 2011 before the Punjab & Haryana High Court, Chandigarh for quashing the above notificationof the DTCP/ HUDA vide which the External Development Charges (EDC) wereincreased from retrospective.

We would like to further inform you that the said matter was listed for first hearing on 16.08.2011 and after hearing the Petitioner, the Hon’ble High Courtwas pleased to issue notice to the State Authorities and directed the State Authorities to file their reply and accordingly fixed-up the matter for 06.09.2011 for further hearing. A certified copy of the order shall be providedyou as soon as we get the same from Greater Faridabad Welfare Association’(Regd.) for your ready reference.

In view of above, since the payment of enhanced EDC is sub-judice before the Punjab& Haryana High Court, Chandigarh, we request you to kindly extend the date of deposit of the said enhanced EDC amount till further decisions .(and proceed further to offer possession and registration of flats .)

Does anyone know what is the EDC for Group Housing societies in Greater Faridabad now? Earlier it used to be around 66 Lacs per Gross Acre.

This is Ramandeep, I also have 3 BHK unit in SRS Residency. I recieved increased EDC letter yesterday asking for payment by 15th September. Can u please suggest what should be our action plan to increase the date for payment as SRS letter mentions the interest rate of 18% pa on amount after 15th September.

I am really surprised on behavior of HUDA as they haven't done anything since 2005 for development of this area, and still demanding for increased EDC for hugh amount. Is there any kind of legal action we can follow asking explanation from them as on what behalf they are asking for increased EDC. Is any body there who is answerable to us as we all have already paid hugh funds towards EDC already and now as they are asking for more.
As per new rate increased EDC is 291 psf.which comes around 453087 ,(almost cost of new car ) , such hugh amount and what we are getting in return is WORST living conditions .. If HUDA would have spent even half the money of EDC in this area , it would have been the most demanding area of NCR.

I request you to pls become member for GFWA and Support us for Fight against HUDA and Haryana Govt.

As Per HUDA Notification EDC for Urban estate Faridabad for the calendar year 2009 works out as under :

For Group Housing schema 232.84 lacs per gross acre
For Plotted Development 58.21 lacs per gross acre

It further says Based on this pattern these rates may be made applicable for calendar year 2005 to 2008 after reducing the same by 10% p.a. on compounding basis

By this way the EDC comes out to be

What I Understand, SRS along with older projects got their licences in 2005/06 . Based on this EDC should be around 220/SQ FEET .

All the Builders are claiming unjustifiable EDC from flat buyers.

I think we all SRS Residency members should come together and meet to SRS official at sec 12 office on 3rd Septemeber Saturday for DTCP memo copy and breakup of EDC.
