Meeting with Director, Town and Country Planning, Haryana tomorrow (20-Dec)

It is time to raise our voice to authorities. Director, Town and Country Planning, Haryana is visiting Faridabad office tomorrow (HUDA Complex, Sector 12, Faridabad). It is an excellent opportunity to raise our voice and raise our grievances against builders. Also, it is time to ask for what actions have been taken by department with regards to thousands of complaints that were submitted previously by GFWA against various builders of Nehaarpar. Also, a time to raise our voices towards inflated EDC demands by various builders. Inviting GFWA members to join tomorrow at 12:30 PM at HUDA Complex, Sector 12, Faridabad. Please contact Dheeraj (9716240184) and other members of GFWA Core after reaching venue.

Friends,

Pls check the Venue.

I got information that Meeting Venue is Gymkhana Club, Sec-15, Faridabad.

You can make one or Two sheets related to Inflated EDC by your respective builder and then same can be submitted to Director -Town and County Planning.

Pls make EDC comparison of which is demanded by your Builder and the calculation by yourself and the difference, which builder is asking from you.

Attach supporting document with your calculation.

This is the Right time to Raise your voice against your Builder and their malpractice.

what's outcomes in this meeting. Please provide any latest new regarding this meeting and its outcomes. No any information have been display related to this above says meeting.

Dear All,

(Mr. T.C.Gupta did not come yesterday to Faridabad)

GFWA members met Senior Town Planner from Chandigarh when he was coming out of meeting with HUDA/DTCP officials at Gymkhana Club and apprised him of concerns mainly inflated EDC. We also submitted him GFWA letter which he assured us will discuss with concerned officials in Chandigarh. Meeting lasted for about 15 minutes and he sounded negative about our issues. Here is MoM:

1. He told GFWA that it a matter between buyers and builders. DTCP has no role in it and their hands are 'tied' by Supreme Court judgment in this regard
2. GFWA told that EDC amount is demanded on behalf of you and you also have terms of agreement with builders in form on Licence. If builder is violating these contracts, then you have every right to take action against them
3. BPTP members also gave him calculation sheets for EDC for giving to Chandigarh office.

Later we met Geeta Prakash, STP, Faridabad. People from 4 group housing societies Puri, Piyush, SRS and BPTP were present. We had a good meeting. Here is MoM:

1. She directed her staff to visit Chandigarh with calculation sheets of EDC and take clarity from Chandigarh office in this regard.
2. She informed us that it will require much co-ordination between Chandigarh and Faridabad offices of DTCP and it can take quite some time for investigations
3. If allegations are found to be true, then Director, DTCP can take action against private colonizers in Faridabad
4. For EDC rollback, she sounded negative. Better to follow this with our (GFWA) ongoing Court Case at Chandigarh.

If builder is violating these contracts, then you have every right to take action against them" - height of irresponsible answer. yes we have every right to take action, and by bringing this to your (town planner's) notice we are doing that only, moron.

Geeta Prakash appeared to be little more open. As per what i have heard that EDC rollback will be tough as the decision has been taken a very high level. the EDC increase has not been done for development rather to pay the farmers the increased compensation for land acquisition in GB (to avoid any type of G Noida type issue).

I wish to reproduce a TOI article which is of significance to all invested in Private Colonies. This is pertaining to non application of Completion Certificate by Builders from DTCP. This however is a part of Licensing Condition.

The city's municipal body took the initiative to take over the private colonies by seeking a status report from the urban local bodies. But the department of Town and Country Planning (DTCP) that gives licences to private developers revealed that not a single private developer in Gurgaon has applied for completion certificate for any of their projects. This has jeopardized the plan of their takeover by the civic body.

Obtaining a completion certificate is a pre-requisite for transfer of the areas to the municipal corporation. "Despite the government coming out with a piece of legislation that allows the developers to pay a one-time fee to get partial or total completion certificate for over a year, not a single developer has opted for this," disclosed T C Gupta, director general of DTCP.

As per the norms, a civic body can take over colonies developed by private players or any government agency five years after they get their completion certificate. Once the transfer happens the municipal body takes over the maintenance of all such colonies.

Considering that developers were keen on keeping the maintenance with them despite several instances of residents dragging them to court, the state assembly in 2010 had passed the Haryana Development and Regulation of Urban Areas (Amendment) Act. The legislation has allowed the builders and colonizers to pay a one-time infrastructure augmentation charge to get full or partial completion certificates.

The measure was also meant to raise funds that would be used %by the local authorities to provide much-needed infrastructure facilities like roads and sewerage.

"The developers could have taken this opportunity to get the completion certificate. The legislation also allowed the government to levy infrastructure augmentation charges in lieu of the waiver of 15% cap on profit margin for developers," Gupta said.

As per the norms set by the government, private builders were not allowed to make more than 15% profit under the earlier provisions of the Act, but the rule was hardly followed.

Officials said that the developers used to fudge the balance sheets to show their profits always remained under 15%. This happened since the market forces and conditions decide the property rates and the norms %set by the government are rarely adhered to.

Meanwhile, sources said that the private builders are not interested in handing over their colonies to the municipal corporation which %will end their perennial source of revenue. "They get a lot of revenue in the form of maintenance charges and don't want to dry that source. There is also a section of residents which wants the present system to continue since it fears the service level might get worse if the MCG takes over," said a senior government official.

Fail to understand why seats of power take a drumming from builders while the builders are breaking all licencing conditions. This is another one of cases where the official machinery prefers to take a back seat in favour of builders and chose not to take any action against blatant violation of Licensing conditions.
Govt officials prime duty is to secure the revenue for the govt, still builders do not pay the govt EDC collected from subscribers ON BEHALF OF THE GOVT while DTCP prefers to turn a blind eye and continues to renew the licenses of Rule Breakers.
