Another excellent attempt by GFWA in the larger interest of the common Home seeker currently reeling under the widespread public apathy caused by the administration and builders.
Going through the minutes, I would like to take point no 3 of interest specifically. From what I understand that the sector roads have to be brought into shape by the builders and the largest being BPTP who holds onus for underdevelopment of the neharpar area along with violation of many licencing conditions.
Wish to draw attention of core team and legal experts with the Association to the particular aspect of development of sector roads which are a part of the licencing agreement as understood from the specific portion of the ACT
" Cost of Development Works.—
(1)The colonizer shall deposit thirty per centum of the amount released, from time to time, by him, from the plot-holders within a period of ten days of its realization in a separate account to be maintained in a scheduled bank. This amount shall only be utilized by him towards meeting the cost of internal development works in the colony. After the internal development works of the colony have been completed to the satisfaction of the Director, the colonizer shall be at liberty to withdraw the balance amount. The remaining seventy per centum of the said amount shall be deemed to have been retained by the colonizer, inter-alia, to meet the cost of land and external development works.
(2) the colonizer shall maintain accounts of the amount kept in the scheduled bank, in such manner as may be prescribed:
provided that where the license under section 3 is granted for setting up a colony for cyber city or cyber park purposes, the provisions of sub-sections (1) and (2) shall not be applicable."
As it appears from the current progress on the ground level, within the BPTP township, hardly any work has been completed that can get them the occupancy certificate or part/full completion certificate. STP and internal electrical distribution set up is yet to be initiated..Possibly water lines and sewerage lines are in place but unconfirmed.
Can GFWA as an association file relevant RTIs to ascertain the finding of audit on the Internal Development Work, under the meaning and purpose as mentioned in the extract of the act reproduced here?? This is necessary as all the projects have paid more than 95% of the money for the Construction Linked Plan towards the township. The Time elapsed since this payment has been considerable by any measure of reasoning. Also this has nothing to do with the Master Road tenders or the NIT towards construction of master sewerage as evident form point no 3 encapsulated in the minutes.
