Response from Piyush Group for enhanced EDC revision/refund

Below is the standard response that Piyush is giving to each buyer who had asked for enhanced EDC revisions/refunds. This shows disobeyance by Piyush towards laws and rules of State. Letter speaks of arrogance and indifference towards buyers who have put their lifetime savings in getting their dream home. Also, it contains lies as attached letter by DTCP clearly shows outstanding of original EDC of around 30 crores which they collected from buyers but did not deposit to Govt.

We should bring this to the knowledge of Director General.

Please attach reply you have got and demand action against Piyush Group for not following orders of revision of enhanced EDC by DTCP and not issuing refund/revision for demands of enhanced EDC. Letters should be sent by speed/registered posts. Let DG office be flooded with letters and force him to take action.

With reference to your query , wewould like to inform you that the offer of possession shall be started inNovember, 2012, in phases.



Further the issue of EDC/ IDC hasalready been discussed and we have conveyed our stand on each and every occasion. We confirm that the demand shall remain @ Rs. 310/- per sq. ft. only,which is correct and Company has not demanded any extra interest charges from you.



Therefore we say that the Company has already deposited bank guarantee against EDC/ IDC.



We say that the penalty shall be calculated at the time of possession. It shall be paid if applicable as per the agreement duly entered between you and the Company.

It is very important that any inexplicable act of the builders be addressed to the relevant authority. Some builders are not normal and insensitive human beings so please write about all unethical deeds with relevant proofs (of plot/flat/villa nos), correspondence with builder, receipts, scans of bba. Repeat the same issue in two different ways in your letter as officials have a habit of twisting the meaning of your request. Always mention the powers the officer has and always mention in heading as COMPLAINT against.... for illegal/wrong/cheating.... You dont need to be good to the builder who is cheating you.
Such complaints are no guarantee for getting a favourable response but continuous persistence and repetition of complaints builds a strong proof in case things need to go the Lokayukt or Criminal case. Best way is to send copies of all emails through SPEED POST as well and maintain receipts with details clearly visible.

Emails if sent are substantial legal proof as per IT act.. Now a copy be sent through SPEED POST with details of recipient and sender (with name, address, builder name, unit no) on the receipt

get a common draft and send to builder individually as well on association letter head

get a separate association registered of Piyush group and send legal notice.

Move lokayukt against DTCP and HUDA why action not taken as per statute/act for stealing/loss of state revenue with proof after filing 10s of RTIs on EDC deposited by builder for your plot/flat/appartment , IDC deposited by builder for your plot/flat/villa, Calculation of EDC submitted by builder, Calculation of IDC submitted by builder, Licensing conditions and audit observation reports of STP etc..

All govt receipts are to be maintained by builder in separate registers and deposited/submitted, within stipulated time with details of the payee (allottee of flat/plot/villa)
