Another year gone...
I have three different commitments from RPS in writing now:
-Its our endeavor to start delivering end of 2010. - Promise made on one of the mails to a customer.
-Its our endeavor to start delivering end of 2011. - Replies against EOW and DTP complaints.
-Its our endeavor to start delivering end of 2012. - On their website.
RPS has proved to be most shameless builder of Neharpar. Will not be a surprise if there is another commitment now for delivery in the end of 2013, in view of the below facts:
1. Legally, possession can not be offered until partial occupancy certificate is obtained.
2. Occupancy certificate can not be applied until min 25% of the project is ready for handover.
3. Occupancy certificate is not granted if EDC is not paid by the developer in full, including interest. These guys are fighting a case to avoid paying heavy interest. Case may get dragged for years.
4. Haryana govt is not giving OC until EOW flats are ready.
5. As per the act, along with 25% of the units, proportionate share of amenities promised need to be delivered.
6. To offer possession and get the units registered, the property should be free of any lien from the initial lenders. Not sure whether RPS has paid back its loans to original bankers.
There is now another loot from Neharpar builders - POSSESSION FOR FITMENT PURPOSE - which is nothing but a way out to bye pass all legal formalities and cheat buyers. Buyer is asked to pay all the balance money and signs docs that he/she surrenders all the claims against the developer. A promise is made for delivery in 3-4 months and then god knows when the actual delivery will happen - Worse is that buyer has surrendered all claims as per buyer agreement by this time.
May god answer these cheats for cheating innocent buyers. I say this because there is very little hope from the system.
