Another year gone...

I have three different commitments from RPS in writing now:

-Its our endeavor to start delivering end of 2010. - Promise made on one of the mails to a customer.
-Its our endeavor to start delivering end of 2011. - Replies against EOW and DTP complaints.
-Its our endeavor to start delivering end of 2012. - On their website.

RPS has proved to be most shameless builder of Neharpar. Will not be a surprise if there is another commitment now for delivery in the end of 2013, in view of the below facts:

1. Legally, possession can not be offered until partial occupancy certificate is obtained.
2. Occupancy certificate can not be applied until min 25% of the project is ready for handover.
3. Occupancy certificate is not granted if EDC is not paid by the developer in full, including interest. These guys are fighting a case to avoid paying heavy interest. Case may get dragged for years.
4. Haryana govt is not giving OC until EOW flats are ready.
5. As per the act, along with 25% of the units, proportionate share of amenities promised need to be delivered.
6. To offer possession and get the units registered, the property should be free of any lien from the initial lenders. Not sure whether RPS has paid back its loans to original bankers.

There is now another loot from Neharpar builders - POSSESSION FOR FITMENT PURPOSE - which is nothing but a way out to bye pass all legal formalities and cheat buyers. Buyer is asked to pay all the balance money and signs docs that he/she surrenders all the claims against the developer. A promise is made for delivery in 3-4 months and then god knows when the actual delivery will happen - Worse is that buyer has surrendered all claims as per buyer agreement by this time.

May god answer these cheats for cheating innocent buyers. I say this because there is very little hope from the system.

hi
all members the time has come to take a strong action against builders like piyush and bptp who is giving possession for fit out this is very big loot in greater faridabad are they adjusting delay penalty ? as most of the projects are going to be final in 2013 . master roads are also constructing on a good speed (till date )the prices will also go to a new high as compared to other parts of faridabad . this resale price increase will give builders a new way to loot old costumers for different facility's names . the price hike in the name of area increase is normal in industry but greater faridabad builders are breaking all industries rules they increase maintenance charges , podium , extra plc , etc ,,... come forward , you have to come for ur better future or these builders will make a big hole in ur pocket last time when we protest there are very less members not even 15 % of our members . in my views more than 1000 families are now living in there happy homes in greater faridabad ( very less than we are thinking in the last of 2011 ) remember our protest in 2011 when the haryana govt is shaken and work of much awaited master roads tender will come in less than one month . so my means that we have much power to give 440 watt shock to all builders and govt ( blogs par sirf likhne se sub kuch nahi hoga take a action and protect ur self and ur hard earned money ) builders or huda are in same boat huda increase enhanced compensation and builders are looting in the name of stp and electric sub station .too rajai chodoo greater faridabad par dhyan do sare protest attend karoo GFWA to 2013 me ek majboot sangthan ke roop me tayar karne me madad karoo

Dear Yogesh Ji,
You are absolutely correct.
At present we have 3000+ GFWA registered mbr but during protest we were less than 10%.

Dear All,
Had a talk with Mr. Jain at RPS today. He says that there is no delay in the commitment of offering possession in December 2012 !! Also, he kept reminding me that there is considerable appreciation in the rates and I should exit if I want to.
Seems that the builder wants the existing owners to exit so the the flats can be offered at appreciated rates to new buyers.
We should either plan to meet RPS in first week of January, for firm answers, in case we are interested in living there at some point of time. Or exit, as suggested by the builder.

When i called up RPS they said there is no delay in possession and said that the will offer possession for fit outs............ is this word mentioned any where in the buyer agreement? then they said if you wish you could exit the project.

Now this kind of attitude RPS is showing to his customer!!! now they will demand during fitouts and actual possesion will be happen end 2013. also be ready for a increase of super area and ecc fcc

There is no timeline when possession will occur in case of fitout. Fitout is not mentioned anywhere in Piyush Builder Buyer agreement and same should hold for RPS. I think RPS has taken cue from Piyush Group in following illegal practice. We should stop these illegal practices and GFWA should provide support for the same.

Do somebody have some suggestion as how we can handle this battle.

This is getting worse and worse......

My understanding is that Legal path actually helps builder as once you go that way... it keeps dragging and and you are left with no option but to wait till the judgement is passed. In all this process other party relax and do other stuff.

Can we get to gather, brainstorm and do something effective. The question is How many customer are actually suffering and can get togather... 100 ?

I think it is a good idea to first build up the numbers and then put pressure on the builder to separate the facts from the "fit outs".
I can join in, whenever there is a meeting.

Dear Friends,

The real issue is if we want to come out and stand against these practices.

FYI, I am attaching excerpt from letter from DTP to DC after our meeting with DC and DTP in 2011. The letter clearly says that possession can not be offered w/o obtaining necessary clearances from government and police can take action against such practices.

I would request Piyush group buyers to join us as they have recd letters of possession for fitment purpose. We can meet DC, SDM and DTP on 1st Jan with below docs:

-Copy of the possession letters from builder.
-DTP letter copy.
-Copy of BB agreement where last installment is mentioned due at the time of possession.

Piyush Heights flat owners will be joining in. Also, I request other housing societies members to join in on 1st January, 10:30 AM at Mini Secretariat, Sector 12, Faridabad. If you think this extortion is happening only in your neighbourhood, then think again. This can happen to you tomorrow. It is good GFWA has taken up cause

Mr.Dheeraj, Can we fix a time and meet Mr. DC faridabad with our grivances and open looting by buliders and ask him, With force ( :@ :@ ), why he is not taking action. If we are atleast 15, we can force him to take action against builder. We dont' need to take time with DC office. Just bang his door.....
