Piyush Group withdraws illegal Fitout "possession" demand

Please find attached letter submitted by Piyush Group in DTP office and SDM office. In this letter, Piyush Group is contradicting itself by saying that they did not demand money and payment has to be given only when they will offer final possession letter after getting occupancy certificate (usually takes about 6 months). But in actual, fit out letter issued to buyers had 30 days deadline highlighted in bold letters for payment of money.

Request all buyers to send attached letter to Piyush Group and don't give any money for fit out demand as stated by Piyush in this letter.

Dheeraj ji -
I read the letter. they are trying to get away with penal proceedings by proving that they just sent the account statement with fit out letter and no way demanded the money from you. this way they are just trying to pacify the current crisis. I think you and other complaints should challange this letter highlighting and stating that the reply from Piyush is wrong and not acceptable. they should apologise from all the investors and withdraw their letter formally otherwise I see a big mess coming up for you guys.

yup I agree with Suniil.

Actually this letter tells that they are doing everything right and its our understanding that was wrong So they clarified.

2nd part more harmful is that they are still not going back on the money demanded So it will come back again will all those unfair demands.

After going through the letter, its evident that Piyush Group has not accepted that they have demanded money.
I think you should contest this with the "so called" statement of account. If I am correct, Piyush asked for the payment within stipulated time failing which would lead to interest @ 24%.
Why don't you used fit-out letter and its terms and conditions. This should be contested in the SDM court further and ask for penal action against Piyush group for illegally extorting money without OC/CC.

Yes, we will give befitting reply with documentary proofs at right time. But, good thing is that currently demand is stayed until Piyush Group obtains occupation certificate

If units are ready, then its end user's loss. Builder will demand money (whatever was demanded this time) as when get CC. Push for criminal charges so that Piyush doesn't delay possession. This is good to start with but miles to go before we could celebrate. I believe there is a financial bungling case against builder, isn't it. If not then file one with EOW and provide documentary evidences.

I am fully agree with Mr bradoo. The keeping with held of demands is not the solution. Builder has to cancel present demand and we must create pressure to give possession shortly since after all the end users are loosing. We must prepare fresh matter to submit the SDM to start prosecution against builder and all of us must start agitation in front of the office of Town country planner to highlight the issue and expose the exploitation.

बिल्डरों की ओर से गलत तरीके से पजेशन देने के मामले में गुरुवार को एडीएम सुशील सारवान ने एक बार फिर बिल्डरों और ग्रेटर फरीदाबाद वेलफेयर असोसिएशन के लोगों के साथ मीटिंग की। इस दौरान फैसला लिया गया कि बिना ऑक्यूपेशन सर्टिफिकेट लिए बिल्डर लोगों को पजेशन नहीं देगा और न ही इसके लिए चार्ज करेगा। वहीं, अन्य समस्याओं के लिए अगली मीटिंग 13 फरवरी को होगी।
गौरतलब है कि बिना ऑक्यूपेशन सर्टिफिकेट लिए बिल्डर की ओर से पजेशन का नोटिस मिलने पर ग्रेटर फरीदाबाद के लोगों ने टाउन एंड कंट्री प्लानिंग विभाग से शिकायत की थी। इसे लेकर लोगों ने एडीएम के साथ मीटिंग की थी और बिल्डर को अपने डॉक्युमेंट्स जमा कराने के लिए 17 जनवरी तक का वक्त दिया था। गुरुवार को हुई मीटिंग के दौरान एडीएम सुशील सारवान ने बिल्डर को निर्देश दिए कि ऑक्यूपेशन सर्टिफिकेट के बाद ही लोगों को पजेशन दिया जाए। इस दौरान धीरज जैन, तुलिंदर, नितिन मलिक आदि मौजूद थे।

Thanks a lot to Dheeraj & others for bringing the case on correct table where we can expect positive result. But so far the builder has not replied any letter issued by buyers to builder and there is little confusion, whether any authority has also asked to builder for clarifications on illegal demands for which the builder has not been providing the proofs and calculations. What should be the correct platform where we can raise the issue, to pause the builder for illegal demands while offering final possession and legal action can be demanded too. Otherwise the builder will place again the same demands without any documentary proofs at the time of final possession .

Sir, we should not keep quite even for single day and better to be active on the forum each day. The builder is feeling relaxed by issuing a simple letter to the Town & country Planner / FBD. He is planning to delay the possession and the demands are still unchanged. we must plan for agitation against builder if required hunger strike too.

Piyush Group has FINALLY withdrawn illegal fitout demand letter. In an e-mail sent to District Town Planner, Faridabad today, Piyush Customer Care has attached letter mentioning the same (attached). While withdrawing fit out demand, Letter is still trying to justify "fit out" when there is no justification for the same as term does not exist anywhere in builder buyer agreement. This step shows strength of unity of home buyers and justice to home buyers.

As on date demand for money and fit out stands cancelled but letter says buyers will have to pay whenever company want.
Real issue is still there.

Guys file an RTI application to DGTCP and seek information on EDC and enhanced EDC collected from buyers by the builder (holder of license no.....) This can be sought as DGTCP is regulating GH projects in the state and this is public money

This is absolute defiance of law and District Town Planner should take strong exception of this non-apologetic revert.. Reply is given without remorse and refers to the interpretation of honble SDM to be skewed, incomplete and arbitrary. He seems to be mentioning that the demand is withdrawn as a matter of courtesy to the administration.

While the builder is talking of International terminology, he would have done himself a favour, if he would have considered the service levels available abroad from builders. I can guarantee, if he would have done this crime abroad, he would not have shown the dexterity to revert with such tenor and tone.

The builder seems to be guided by someone, who is suggesting to show defiance to all rules and wrongly doing so..

dear Brandoo..

Dont wait for someone to file an RTI, just go ahead on yours and file RTI to "SPIO-cum-accounts officer, O/o Director general, town and country planning (Haryana), Sector-18, Chandigarh-160017"...ask them clearly abt the total original edc and enhanced edc paid by Piyush till date, details of an default in payment by the builder etc...plz keep the total word limit to 500 only...
