I am giving some points on which Zee News should exposed the builders regarding Villas Constructed in Sector 88, Faridabad.
1. As per conveyance deed in a villa of 150 sq. meter the constructed area is 126.06 sq.meter whereas as per compounding detail obtained from District Town Planner, Faridabad the total constructed area is 110.039 sq. meter.
Thus BPTP has charged the construction cost of 16 sq. meter excess from each owner which comes out of Rs.2.00 lacs.
2. The BPTP has charged of each Villa owner a sum of Rs.158205/- as STP and Electricity sub-station charges. In my opinion there is no need of Sewer Treatment Plant for this particular project as main sewer line of HUDA is crossing between F & G Block and as per conveyance deed each villa owner has to be obtained individual electricity connection from DHVBN.
3. As per clause 8.1. of Villa Buyer Agreement the builder was supposed to hand over the possession within 36 months of sanctioning of building plan. In this case no building plan was ever got approved from DTP, Faridabad. Now they have compounded the unauthorized construction only on 31.5.2013. Hence we are eligible to claim the penalty after 36 months of signing the agreement.
4. As per Villa Buyer Agreement the Villa was expandable and Phase-I will be constructed by the Company and Phase-II was to be constructed by the owner. As already stated no building plan was got approved by the above said company, now they have compounded the unauthorized construction. Now for Phase-II construction we are being compelled to get the building plan approved from District Town Planner, Faridabad. This will cost each Villa owner Rs.50,000/- to 60,000/- for obtaining building plan, completion, occupation certificate.
We are planning to go to Hon'ble High Court on these points. Give your opinion whether our demand/points will stand in the Court.
