Era Divine Court Project : Door Opened for Legalisation of the Project

Dear Friends,

It gives me immense pleasure and satisfaction to share the order sheet (as follows) of the recent order issued by DGTCP, Chandigarh.

After going thru the order it appears that we , as a group, have been able to highlight and resolve many contentious issues that were going on unresolved between BPTP, ERA & DGTCP for years all together.
I think besides the strong legal recourse adopted by us since last Aug 14 to get these 3 stake holders on the same table to discuss and amicably resolve issues that were creating barrier to early legal possession of our units, its the unity and resolve of our group which has done the wonders. Dgtcp was so much taken aback by the sheer nos. We displayed during each of the hearings held at chandigarh that the presence of sizeable strength of 37 group members even finds a mention in the order sheet.

The orders are specific and compliance is time bound with clear intent of expediting the delivery of our units .
We are confident that with progressively increasing participation during our information sharing meetings and inflow of humble voluntary contributions from team members will add more muscle and teeth to our fight going forward and we shall be able to realise our goals soon enough .

We are discussing the way forward for ensuring speedy execution from both BPTP and ERA as a follow up of this order and the action steps for our group will be shared for discussions and inputs from group within a weeks time.
We have only realised out of our efforts in the last couple of months that the delay in possession was solely on account of lack of unity , strong will and direction of the allottees which became a major disadvantage for us and an advantage for the builders. So going forward , by what time we shall be able to get out flats majorly depends on the unity and action of our group and would request higher participation from all active and not so active members all together.

I salute ERA buyers for being united and working towards legalization of project.

I think that Order falls short of imposing heavy penalties and prosecution of BPTP and ERA. Order seems to let them free of Criminal Offences they have done.

100% agree with Dheeraj.. DTCP is trying every trick in the book, inspite of court orders and is simply protecting the culprits responsible for devastating hopes and promises made to 1000s of home buyers.

IN PUBLIC INTEREST THE DEPARTMENT OF TOWN AND COUNTRY PLUNDERING SHOULD BE CLOSED UNTIL A REGULATOR IS BROUGHT INTO PLACE.

MR KHATTAR DID NOT FIND TIME FOR PASSING STATE Real Estate REGULATORY BILL, BUT CERTAINLY DID FIND TIME TO MEET THE BUILDERS AND OBLIGE THEM WITH REGULARISATION OF "BANDER BANT" OF 22000 acres of LICENSES GIVEN BY HOODA LED CONGRESS GOVT.

The promise of Governance by MODI is proving to be too delayed, too little and all executive decisions/budget etc have a reflection of favouring the capitalists and stock market punters. If BJP does not pass the real estate regulation bill at center, the builders will keep sucking the blood of honest, tax paying and law abiding citizens.

This case clearlyshows the gross bias of the state towards the criminals,the state wants to protect the builder and only because of the court order the state is paving the way for buyers to have a legal home.

Dr Naveen/Dheeraj ji,

All the offences wherein licensees could have been prosecuted have been converted into compoundable offences by the earlier Haryana government.

Therefore licensees will escape/get rid of their offences/loot by way of paying the penalty.

Now after the CAG report submitted before legislative assembly on 24th March 2015 w.r.t. Robert Vadra's evasion of taxes will fetch some big amount to the kitty of TCP office and Robert Vadra/Sky Light Hospitality will be a free man and will not be prosecuted.

Only common men/women face prosecution,not builders or big time criminals.

The DGTCP has also not penalized the licensee financially too.

Whatever money they have to pay that too they can do by bank gaurantees.

We will wait for some days to see the course of action by both builders. In the meantime bptp has served legal notice to Era for payment of dues for transfer of license within 10 days.
If nothing happens, we will again approach High Court.

we need to.keep making pressure on the builder and tighten up the screws and corner them to act in immediatly in favour of all the investors..pay his dues and get their license renewed and complete the project and give possesion to all us in time swiftly...

Thanks. Not only ERA customers but BPTP Park Floors II customers are also affected due to non receipt of OC of Park Floors II :'(

great news..i am being told by era divine floor proj incharge vivek gupta that era renewal license process done yesterday after paying all dues to bptp..in 10- 12 days time paper will sent to authority for carrying out the process of restarting remaining project work in coming months..
