I got some queries from one of my friend and He said I must clear the doubt one person has in his mind. I am trying my best to do so and after reading this still you have doubt, you can ask for clarification. I have shortened the questions to make all this not lengthy.
You must know RWA is long defunct and registration expired long back. However it was registered with good intention to facilitate early possession of the of our flats and after that management of society which we will have to do as per govt. rules. Now, there is no RWA, We are working just like friends, no President, no Secretary, no Members, we all are equals.
Query 1 : How Lawyer Fee was Finalised………?
Ans : We are only 12 people who filed Writ Petition in Chandigarh High Court in Nov. 2014. NO CASE HAS BEEN FILED IN CIVIL OR CRIMINAL COURT TILL DATE. YES, NO CASE. We 12 people do not have anything to do with rest of the Era buyers, even most of the RWA members were not part of this. We were sufferer and we wanted to have our flat without troubling anyone else and we 12 people were of the same view, so we filed Writ petition. WE PAID THE LAWYER WITH OUR OWN HARD EARNED MONEY. DIDN’T TOOK A PENNY FROM ANYONE. IT WAS OUR DECISION. WE PAID 2.5 LAKH TO THE LAWYERS FROM OUR OWN POCKET. People only contributed partially only after when they knew that an Order has been passed by Chandigarh High for early possession of the flats. We did not take money initially but after repeated requests, we started accepting contributions only to facilitate other people who wants to go to Chandiargh for hearing of the matter. It was all voluntarily, there was no compulsion, we asked whosoever have same thinking with the process we are following, may contribute. We have not asked money before also and not ask in future also. And people contributed between Rs. 500 to Rs. 5000 as per their convenience. There was no bar on money of Rs. 1500. It was ones personal choice. All the expenses would be shared from whatever we have collected till date.
Query 2 : Transparency of the Fund collected at the time of Formation of RWA….
Ans : Yes some fund around Rs. 7-8 thousand were got collected during the formation of RWA. All the statement was circulated in Era Divine Court forum on commonfloor.com. Whosoever is member of that forum can check. We have time and again circulated the statement and it is still there. Everything was transparent. We are still circulating all the names of contributors in whatsapp. First expenditure after recent collection had happed this Wednesday while visiting DGTCP office and this will be shared on Sunday.
Query 3: Betrayal by a member and Question on our Intention with a view that we are builder’s agent
Ans : Yes one person took advantage of the situation. But does it mean that all are alike? No, we all are different person with different view. And WHAT IS THE GUARANTEE THAT YOU ARE NOT WORKING ON BEHALF OF ADEL LANKMARKS LTD TO HELP THEM AND YOU WILL NOT NEGOTIATE FOR YOUR OWN BENEFIT? WHAT IS THE GUARANTEE THAT YOU HAVE NOT BEEN HIRED BY ERA TO PERSUADE PEOPLE TO NOT TO FILE CONSUMER CASE, SO THAT ERA HAS NOT TO PAY ANY COMPENSATION FOR DELAY PENALTY CHARGES, UNFAIR TRADE PRACTICE AND MENTAL AGONY WE HAVE GONE THROUGH AS THIS SUM MAY BE UP TO 10 LAKH PER PERSON? If the trust deficit remains like this, we will keep on fighting and Era will take advantage of our situation. We bought flat in 2009 and still here but you bought much later. We could have negotiated long back if we had to exit this project and earn benefit. But we want our flat and that’s why we are fighting tooth and nail. Nothing is hidden, everything is clear. Nobody is forcing or misguiding anyone, one has to follow his instinct whether court case is farce or not. Use your wisdom and you will understand.
Query 4 : Taking decision unilaterally and dividing buyers….
Ans :
We bought flat in 2009 and started organizing in 2010. We organized numerous meetings with Adel Landmarks Ltd and we have video proof and email (sent by Adel to us) for this. Time and again various buyers used to meet at various places. We had meeting at Era site, Town Park Faridabad, Connaught Place. All were invited, no one was barred just as you are trying to do. The result was CNN-IBN episode. First, I do not believe in group culture, it is you who differentiated one buyer from other. IN 2013 WE WERE MORE THAN 200 FRIENDS OF ERA DIVINE COURT FLAT OWNERS ON COMMONFLOOR.COM. DID YOU KNOW THIS? We did not need more support to fight for our flats. But we believe that all the Era Divine Court buyers are brother/sisters so we always tried to walk on same path. Very sad to say you saying is like just like dividing two brothers. I welcome all, you too if you have open mind to understand thing. As I said before, had we intention of settling down with builder, that had been done long time back.
Query 5 : Court Case filed in 2010….
Court case filed in 2010…..wherefrom you got this information which is not even know to us? No court case was filed in 2010. Instead, we have not filed any civil or criminal case as I stated before. Some people tried to file FIR against them in 2013 but that was rejected. We filed Writ petition in Nov. 2014 and Writ is not court case. Now some people are filing Case for compensation in Consumer court. Court Case is going between BPTP and Era Landmarks for payment dispute.
We do not believe in negative propaganda, we believe in truth which should be known to everyone whosoever have bought flats in Era Divine Court. Instead it is you, who removed us from your group, without going through facts. Who is presenting wrong facts? If you know all the truth, you will not say so. The 100% payment comment was made by Mr Naveen on myfaridabad.in. But Mr Naveen is no more part of Era Divine Court Society. He has got flat in Redwood Residency. So he doesn’t have anything to do with Era Divine Court flats and what he says does not concern us. Interestingly, what I read on myfaridabad.in, Mr. Lalaraju, who is also an important functionary of Faridabad development, seems to know all the fact and admire Mr. Navin somewhat. But we don’t have to do anything with this.
We believe in unity. We believe in harmony. We believe in Brotherhood. We believe that once we got flats we will be good neighbors who can make a society worth to name.
