HOME BUYERS TIME TO WAKE UP !!!!
Are you one of those home buyers who bought a dream house with all you had in bank account and fully leveraged your salary for a loan that's burdened you with a hefty EMI ? And a builder doesn't give a damn to your situation and promise made for delivery date....it's been a long wait already for the possession of your house. You got to read this carefully as soon there could be a ray of hope or all possible options will be crushed by mighty builder-politician nexus !!
There could be lacs of people who will identify with above situation, and some could be facing more grave situation.
We, a group of buyers from project called 'UNITECH VISTAS' in Gurgaon rose to the challenge. We took UNITECH to the National Consumer Court against the common person's belief of keeping away from courts for lack of time and long delays. We were glad that consumer court reciprocated our confidence by awarding a fair justice to consumers. For all mental agony and financial stress of consumers, court awarded 12% interest for delayed period against 18% that builder charges for any delay of payment from consumer. This gave a ray of hope to all consumers who put together their hard earned money to buy their dream home. This landmark judgement by National Consumer Court set alarm bells ringing amongst the builder lobby who were happily using buyers’ money to finance other projects and businesses.
Instead of ramping up the construction and starting delivery of houses, UNITECH has taken the case to Supreme Court where a lawyer charges in lakhs for a single appearance as they know that poor consumers won't have enough to fight it out against them and won't be able to sustain in Supreme Court. To add to our problems, our politicians are supporting the builders cause. Our ex-finance minister, Mr. P. Chidambaram has decided to represent UNITECH for this case. Sir, we do know that as an advocate you have taken up the case but what about the ideology of your party leader, Mr. Rahul Gandhi, who claims to be fighting for home buyers against the unjust builders and accuses opposition of 'Crony Capitalism'. It is not that you are just fighting for your client but more importantly you are fighting against all home buyers and this will end up ruining them of their hard earned money and their dream home.
The question to all of us and fellow home buyers is that should we give up in the face of this challenge? It won't only save UNITECH but it will give levy to all such builders who take us for a ride. This fight has assumed bigger importance as it would set precedent for all such cases at consumer court. And it will take away any chance of forcing builders to deliver!
The VISTAS buyers need financial support from all fellow home buyers who think that we might be fighting their cause so that we could put up a credible name to represent our case against a big name, Mr. P. Chidambaram, who has taken the onus to inflict more pain on consumers by supporting the cause of builders. A small or big contribution from you all towards this cause can do wonders to get your dream house in time as promised.

Most institutions in India are manned by dishonest.

If a dishonest lawyer represents a company that did NOT abide by its agreement there are many who represent others who cheat and rob. The judges also go by so called precedents and do NOT want to give pro-active directions.

As a result the weaker get trampled. Some times it is poorer, women, old, peaceful, those who are not members of a power group are the weaker. The democratic republican constitution of India is probably NOT depedable for the weaker. Not withstanding what it says the Constitutin of India is only for power groups. We all need a strong active constitution; not this photocopy of the British Constitution as it existed in 1946 without the commitment to the moral priciples it is based on.

New Delhi: The Supreme Court has stayed an order of the National Consumers’ Disputes Redressal Commission (NCDRC) imposing a penalty on real estate developer Unitech Ltd for delay in handing over flats to the buyers.

The NCDRC, in an order of 8 June, imposed a 12% annual (simple) interest to be paid by Unitech to its flat buyers of its Sector 70, Gurgaon project called Vistas. The apex consumer forum said that this would “take care of the additional financial burden on them (the buyers)” and provide “some monetary compensation...on account of the delay in handing over possession of the flat purchased by them”.

A Supreme Court bench comprising justices J. Chelameswar and A.M. Sapre agreed to hear Unitech’s appeal against this order. The flat buyers, who are respondents before the apex court, have to respond within three weeks, the court said in its order on 17 August. Further, a stay on recovery of the compensation and certain other dues was imposed till the apex court hears the case.

The NCDRC, in its order, was critical of the terms of the apartment buyers’ agreement that realtors sign with their buyers. Noting that a builder charges an 18% compounded interest annually if the buyer delays in making payment, but only compensates 3% in case the builder does not give possession in time, the NCDRC says that “a term of this nature is wholly one-sided, unfair and unreasonable”.

In fact, a similar observation was made by antitrust regulator Competition Commission of India while dealing with the agreements between buyers and realtor DLF Ltd for certain Gurgaon projects. CCI had imposed a Rs630 crore penalty on DLF, and the case is currently pending before the apex court for its consideration. However, in that case, the apex court directed DLF to pay the entire penalty with the court registry.

Before NCDRC, Unitech had claimed that the multiple cases of the flat buyers were not of a high enough value to be heard by the national forum. Rather, they should have approached the state commission, Unitech had contended. NCDRC, however, did not agree with this contention.

The consumer forum also asked Unitech to pay the excess of the service tax payable by the buyers in view of the latest enhancement in the tax structure. Further, it directed Unitech to pay to the 24 complainants a sum of Rs5,000 each as litigation cost. It also ordered Unitech to comply with the dates by which it would deliver possession to the buyers (in its letter of 27 May). In case Unitech failed to do so, it would have to pay an additional 18% annually for each day of delay.

Dear All,

We should sign a petition on change.org for this Unitech move for going SC and being supported by P Chindabram...Today it is Unitech...tomorrow it willbe any other builder..Also another petition for Rahul Gandhi to stand by his words..!!

Please sign a petition and Wake Up Rahul Gandhi and come clean on promise that he made to home buyers !! Ask him to stop Chidambaram, Sibal, Khurshid, Abhishek Manu Sangvi to appear for builder
