Hi, I agree with all of you. So, this should be our strategy:

1. File RTI to Town and Country Planning (TCP) about any increase in EDC amount that they may have planned
2. File RTI to HUDA on how they have utilized our EDC amount.
3. After getting responses from RTI, only then we can plan some further action on legal front.

Hi Dheeraj,

I hope you are doing fine.

I do recall you sharing an RTI reply from HUDA in the past, which actually stated the fact that HUDA wanted to start the developmental work in the Neharpar area after completing the land acquisition. Additionally, during one of your meeting with HUDA, they also informed that they plan to develop temporary roads, if the residents move to their residence before the acquisition is complete (which they refused to acknowledge in reply to one of your RTI later).

So, now that they have not spent even a single penny of the EDC and IDC collected from is, it is not making sense to charge EDC and IDC again!
Since, you would be attending meeting tomorrow, I just thought of discussing this point. (I wanted to attend this meeting with HUDA tomorrow, but it seems that I won''t be able to make it in such a short notice. My apologies for that!)

If we already have more RTIs from HUDA, then can't we build further on the RTI information available if we plan to draft new RTIs? I was also wondering if BPTP has got some correspondence from HUDA stating they are going to ask for more EDC and IDC charges! If yes, and if we could somehow manage to get one such document, then we can contest that with HUDA (and if needed in the court too).

Refer to the copy-paste of the mail from you dated 18 Jan 2011 for your reference.
Additionally, please find the RTI and HUDA's response on that attached with this mail.

Copy - Paste of Your letter dated 18 Jan 2011.

I had filed RTI application (attached) containing detailed queries regarding land acquisition and cleary asking for timelines and milestones in July 2010. After my application going through endless transfers between Govt. officers in HUDA, I filed an appeal in Nov 2010. Even after the appeal and assurance that all queries will be answered, I received yesterday RTI reply from HUDA which has NO timelines , planning or milestones and it only addresses 2 queries. It only says (attached):-

1. EDC services will be started ONLY after complete acquisition of land.

2. Previously, HUDA officer had told me verbally that they will build temporary roads so that people can commute to their residential societies. But, in written reply, HUDA has even denied making any temporary roads.

This RTI reply marks 1 year of receiving RTI responses from HUDA. I have learned now that RTI law is very weak and does not result in actions being taken.

For any actions to b taken on ground, either we should do large scale protests or go to Courts or do both.

Not sure.. but some how I have a feeling that someone at BPTP or may be other builders are playing tricks with.. without offending anyone.. its just my take.. Govt. know and understands that we are all getting together.. and may not accept until we are provided proofs of what was done with the previous money they collected frm us..

So.. lets file the RTI to ask what was done with the IDC/EDC collected form all of us.. and wait until we hear form them.

So, I think there is a sort of consensus on filing of RTI to start with and then future course of action can be decided. What we can do is to wait for couple of days for this meeting with HUDA to happen and if nothing is clear from that meeting then this process can be initiated.

Yes. We should first file a RTI to TCP and HUDA OR somehow get the document from BPTP for EDC increases. BPTP owners, your help required !

BTW, another article from website Hindi newspaper called www.WebVarta.com

Article quotes Mr. Srinivas saying that they will be floating tenders for roads construction in July (but first step is land acquisition). This also exposes BPTP lie that they have been awarded tenders. Also, it mentions that initial estimate of raod construction was about Rs 225 crores which later inflated to 275 crores and now final estimate of roads construction may become more than 3 times that cost (approx 800 crores). So, if we analyze this news, EDC increases seem imminent for Neharpar.

Hi all,

It's unnecessary craeting the panic ragarding increase of IDC charges . So, kindly stop & lets wait for meeting with HUDA officails. There is no question of trust on BPTP such a fraud builder.
It's kind request to all of you that don't justify yourself for paying the additional IDC . They have collected more than sufficient money & getting a good intrest from last 6 years at least.

Dear All,

It is NOT creating panic but analyzing the situation based on facts. Cost of acquiring land in 2008-09 was Rs 16 lakhs and same has now increased to 75 lakhs (more than 5 times) in 2010-11. Whereas interest increase will be only 0.2 times. Secondly, it is information coming from HUDA office itself that revised estimates for roads construction will be 3 times.

So, we should be prepared as a forum and association to take steps for halting increase.

Hon'ble C.M.Haryana is visiting Faridabad on 23.4.2011 in Gymkhana Club Sector 15 in which all the Higher Officers of HUDA may be present. Why we should not met him for development of Naharpar sectors.

My point is we paid EDC/IDC in 2006 and HUDA did nothing for so many years .What if HUDA sits idle for another 5 year and subsequently if land acquisition rate or cost of road construction further increased for 4 times, will we pay ?how we(consumers)are responsible? The escalation is due to delay from HUDA side and it is solely responsible for any cost escalation, the reason for buying flats in 2006 at Neharpar was due to lower cost compared to other NCR area. Why additional burden should pass to buyers if they have paid money 5 year back.If there is any such plan or thoughts ,it is totally unfair and we should oppose it through sharp protest and WRIT.

We are discussing EDC charges...Will it be increased or not??

refer the attached file..Gurgaon HUDA reduced the EDC charges.

at Faridabad...BPTP holding Registery for more than a year and asking all Plot owners to pay Increased EDC of
Rs1100/-PSQYD.
and while asking Govt notification from them they straight way refused for the same...
and saying we can't disclose that information.

Can anyone of us take responsibility to file RTI to HUDA and STP to ask all these details, which we are discussing on Forum?

Dear Ajay & Dheeraj,

I also read this news in today's Dainik Jagran and was surprised to read that government has reduced the EDC charges. For sure, in case they try increasing the charges, we have to come together and oppose it.

For our friends, who are concerened that this discussion may result in creating panic, I feel that this is a forum to voice our concerns and all of us have a common agenda which is to make Greater Faridabad develop at the earliest. So, such discussions should be considered as being proactive and being prepared to face things.

And you talk to any broker who deals in Neharpar projects and all of them speak the same language of planned increase in EDC / IDC. It was a concren and I was the one who started this discussion and it was because I heard this from different sources, so lets all be together and even if this is a rumour then also lets clarify it and bury it after getting the facts right, instead of living with the fear of getting a letter of increase in charges one fine day.

So, friends lets cheer up and let us all be united as always for a bright future.

Hi Gaurav,

you are right, this plateform is open for all and it need active members who can support , give ideas and can also give constructive criticism.

Regarding this proposed raise in EDC, i'm listening this from last one year.
One or other dealer taking about this...but all, Off the records.

As, Dheeraj Said he would be filling RTI for the same.
Lets wait for that.
Also, without any written communication from HUDA or STP, we can't do anything.

So for Court case, we do need some written confirmation from Govt office.

Can, we list out some points we need to ask thru RTI ( as Dheeraj is drafting those)?. but we can add some and can help dheeraj for the same.
Definitely, we will oppose that raise in EDC and we will not accept that.

एनबीटी न्यूज।। सेक्टर 12 : नए हूडा एस्टेट ऑफिसर वीर सिंह कालीरमण ने बुधवार को अपना कार्यभार संभाल लिया। पिछले एस्टेट ऑफिसर अरविंद मलहान के तबादले के लगभग एक सप्ताह बात काली रमण ने कार्यभार संभाला है। इससे पहले कालीरमण फरीदाबाद नगर निगम में एनआईटी जोन के जॉइंट कमिश्नर थे। बुधवार को कार्यभार संभलते ही उन्होंने अपने अंडर आने वाले अधिकारियों और कर्मचारियों के साथ मीटिंग कर सबसे परिचय किया और विभाग द्वारा कराए जाने वाले कार्यों को बेहतर तरीके से करने की हिदायत दी।

Hi Ajay,

Absolutely. No point going the legal way till there is a concrete gorund. So, RTI is the right step. In terms of content of RTI, this is what I could think of as of now:

"The builders in Neharpar / Greater Faridabad (Sector 75-89, Faridabad) area have been collecting EDC / IDC charges from all the people who have purchased plots /flats/ floors in this area. This has been collected at the rate of Rs. 1100 per sq yard and given by builders to the government authorities for developing infrastructure in this area. However, even after collecting crores of rupees the governement authorities have hardly done any visible development work. I would like to know the following through this RTI:

1.How has government utilised the money collected till now by way of EDC / IDC charges?
2.Account of money that has been collected and its utilisation?
3.What is the plan to utilise the balance funds?

Kindly share the requsite information.
