Realty bill to give buyers fair deal

Let's hope that this bill gets approved in this winter session of Parliament.

The Centre government has finalised the draft Real Estate (Regulation & Development) Bill and plans to introduce it in the winter session of Parliament after getting cabinet approval. The bill makes it mandatory for developers to register themselves with a real estate regulatory authority to be set up in each state. Developers must also submit project details - approved layout plan, timeline, cost, sale agreement - to the regulator before launching projects.

Dear Sirs,

Please update, if anyone has taken any LEGAL ACTION against BPTP on the issue.

BPTP is demanding more money on pretext that the build-up area has increased in Elite floors !?
At the time of booking for 250 sq.yards floor Built up area was 1203 sq.ft.
They changed "Built-up" to "Super built up" area in agreements later.
This means that 1203 sq.ft. would now include the common areas such as stair case, boundary wall, Canopy, Projections, Shaft, etc.. which was obviously going to be more than 1203 sq.ft. Now they claim the Super Build up area to be 1346 sq.ft.
BPTP has cleverly increased the demanded area and reduced their initial promised area.
Hence, the increased demand.

Please note that only legal action can save us...

Another cheating -
BPTP raised new demand for sewage treatment plant and electrical substaion and demand is approx rs 5 lakh. Have any other received such demand and what is your reaction?

Not clear...

Have you received any demand asking 5 lacs individually from you for sewage treatment plant and electrical substaion? As here the amount is divided and final amount to individual is much less.... Which project urs?

Its not 5 lacs. It is linked to the area of the plot. BPTP is demanding ~ 995 per sq yard. If you have a demand letter then plz scan it and share it in the forum. For a 250 sq yards plot, this works out to ~ Rs. 2.5- 3 lacs, which is again very high.

Why all these issues are coming for bptp project only ?

None of the owners from any other builder's project complaint such thing...

For parkland plot owners, do you also pay EDC and IDC separately or, the builder didn't charge any IDC?

Dear BPTP customers,
I am also the victim of the BPTP excessive demands. Asking for Rs. 5 lakh from the customer for these basic amenties is not clearly not justified. STP and eletricity sub-substations are the basic part of any project and no builder can charge for it.

Ir seems that BPTP is searching the reasons to grab the money from their customers and demanding like anything. 5 lakh amount is very huge becasue the cost for the installation of 10,000 peoples size STP is only Rs. 50,000,00.

Anyway My suggestion is not to give any money to them and ask the BPTP to give the possesion on the plots / flats / units. "Kabja karna bahut jaroori hai".

I would also suggest to start living there becasue the kind of response, we are getting from the authorities is very poor and we can get the value of our money if we keep continue hitting them and it is only possible when u will start living there.

Dear BPTP users,
If I am not wrong, we should approx 20000 users of BPTP properties. So let start uniting and do a protest at site office of BPTP on any Sunday.

Dear Akhil,

The agreement mentions that the builder will charge some amount towards Electrification and STP charges and the amount is not mentioned. So, they are miusing this clause to ask for this absurd amount.

I am in for any protest against them and instead of site office why not their main office in Gurgaon.

Also, does anyone have a clue that what is the normal amount which other builder has charged in a similar case, say plotted development in a township / gated community. Please share

This is very important to know what the other builders are charging for this in any area - whether Noida / Ghaziabad / Gurgaon / Delhi (anywhere out of Faridabad) ?

Also check in your agreement in clause 1.x and at annexure whether they have mentioned about sewerage treatment plant or not. They might have added it in annexure at later-stage.

Also need to know what the other builders in greater faridabad area are doing for sewerage treatment plant / sub-station installation? In one of the omaxe project, already sixty family shifted - what happened with them ? Did they paid such amount ? What happens with RPS project / Puri project ?

As per their new agreement bptp mentioned that all these amounts will be demanded during possession. So, please check whether already received request for possession?

The figure of Rs 5 lac per allotee is very very high. After all what is going to be the cost and capacity of sewage treatment plant ? It needs to be checked and divided among all the residents of Neharpar. Then it will come out to be a very less amount than what BPTP is asking.
Further and most important : How can BPTP charge for the sewage treatment plant now ? As per our DC and the various RTI replies, the roads and sewage lines laying work shall be completed in next 3 years. Then why is BPTP charging for the plant now ? It appears that BPTP is collecting this fund which shall be used by it for its ambitiuos land aquisition spree in Noida and Gurgaon.
BPTP is clearly making fool of the poor investors of Neharpar.
